I am rejecting this response because:   This is a pretty simple matter. New Diamond promised a service and they never delivered it. When I purchased the vehicle, the A/C was not working properly and I told them that about it. They said they would contact me to arrange a time to bring the car in and fix it. They never called me to arrange the repair, so the story stops there.   It's irrelevant that it took me this long to remember because it was not my responsibility as a customer that bought the car in good faith expecting this repair. The failure of New Diamond to contact me is the origin of this issue and I have phone records that prove they never contacted me. It's hilarious that they try to dodge responsibility by blaming the customer who did absolutely nothing wrong and is simply being punished for living a busy life. I don't use A/C except on long highway trips, which I do infrequently, so it's perfectly reasonable that I wouldn't notice, and therefore forget about the condition of the A/C.  Furthermore, the diagnosis was performed by professionals who couldn't otherwise find the problem. It follows that New Diamond would have had to perform the same diagnosis and therefore is accountable for the cost. Additionally, the cost of the repair is not some made-up number, it's what the Toyota of Runnemede staff told me it would MINIMALLY cost. Ultimately, none of this would be disputed if New Diamond had fulfilled their responsibility to me, the customer, and followed through on their promise. Period.

New Diamond Auto Sales, Inc. is a small family-owned and operated business, a far cry from the larger, corporate-owned and operated car dealerships so the fact that we can offer any finance options to our customers should be a testament to the high standards that we hold ourselves to, otherwise we...

would not have been able to succeed in this business since 1996.
On 2/10/14 Ms. [redacted] purchased a vehicle from New Diamond Auto Sales, Inc. on credit, meaning that after paying the down payment, Ms. [redacted] would make $150.00 payments on a bi-weekly schedule till the balance of the vehicle was paid for in full.  The payment schedule that Ms. [redacted] agreed to is as follows:
1st payment of $150.00 due on 2/24/14
A tax and tag payment of $675.00 due on 3/3/14
2nd payment of $150.00 due on 3/17/14
And so on, in payments of $150.00 on a bi-weekly schedule (equaling $300.00/month) till the balance was paid in full.
The payments received from Ms. [redacted] were as follows:
2/22/14 - $150.00
3/14/14 - $675.00 (10 days late)
3/31/14 - $150.00 (13 days late)
4/30/14 - $300.00 (16 days late)
5/22/14 - $150.00 (8 days late) - THIS IS THE LAST PAYMENT THAT NEW DIAMOND AUTO SALES, INC. RECEIVED
Ms. [redacted] states that on 6/26/14 she made several attempts to call with no luck and was then told that the credit card machine was not working.  I myself am the Office Manager and have batch reports for every single day with no interruption. (Even though on this date of 6/26/14, more than a month had passed since the last received payment).  Ms. [redacted] then states that the following week her boyfriend called to make a payment of $300.00 in which I myself did in fact tell that individual that $300.00 would only be a partial payment of what was then owed and that we do not accept partial payments.  That was the last correspondence we had with any individual related to this vehicle.  As the Office Manager it is my job to know all of our accounts, including the payment schedules and what is due when.  I personally made numerous attempts to contact Ms. [redacted] with no return calls or acknowledgement.  Ms. [redacted] willingly and knowingly entered into a legally-binding contract with New Diamond Auto Sales, Inc. and are more than willing to provide these documents for your review if necessary.  On 7/8/14 (47 days since a payment had been made) the vehicle in question was repossessed.  That same day New Diamond Auto Sales, Inc. mailed Ms. [redacted] a certified letter stating that the vehicle was repossessed, not that it was going to be repossessed.  Ms. [redacted] received and signed for this letter on 7/16/14.  Ms. [redacted] states that she tried to do everything, however, we are not sure what that means as all she needed to do was make the required vehicle payments in which she did not.  Our contract which Ms. [redacted] signed states that if a vehicle is repossessed the full balance will be due, not the amount that the individual is behind.  Taking into consideration Ms. [redacted]'s payment history we have no good faith in putting her back in the vehicle on a payment schedule.  Every individual has payments and bills to pay, however, you cannot decide when it is convenient for you to make such payments, just as we cannot run a business on good faith.

Review: I purchased a 2005 silver Scion xB from New Diamond Auto Sales in May 2014. Before purchase, after test driving the vehicle, I noticed that the air conditioning was not working. I told the associate and they told me that they would fix the issue. They wrote a note on one of the sales forms saying so and told me that they would contact me with a time to bring the car in and have it fixed. They never called me and as the academic year started (I'm in graduate school) and it got into winter, I wasn't thinking about the A/C.

I recently had the car in at Toyota of Runnemede to have unrelated regular maintenance done and I asked them to check on the A/C. For $180, they determined that the condenser needed to be replaced. Then I remembered that New Diamond had promised to fix the A/C and I called them to have them make good on their promise. The person I spoke with on the phone was very rude and denied having made the promise. He denied failing to call me to set up a service appointment and then asked why it has taken a year to bring it up.

I'm human and have a life, it's very easy to forget little issues like car A/C when you take the train to school. You don't expect people to fail to make good on their promises because THEY forgot to call you. The price of the part required alone is more than $200 and the labor is likely another $200. At the very least, New Diamond should refund the cost of the repair (parts and labor). Additionally, I think they should foot the bill for the Toyota Runnemede service of diagnosing the problem. In total, they owe me at least $580.Desired Settlement: New Diamond Auto Sales pays for the cost of the repairs to be completed at a different mechanic's facility as well as the $180 I paid to have the problem diagnosed.

Review: On June 26, I called the auto place where I purchased the truck. I called 3 times and got no answer, on the 4th call a man answered the phone and I told him I wanted to make a payment on the truck. The man said, can you call back in 5 mins I have a customer, so I called back and said I wanted to make a payment. He said that I couldn't because the machine was not working. The following week my boyfriend called to try and make the payment and the lady that he talked to said he had to make a full month payment, he told her his girlfriend tried to call the week before to make the payment and his girl friend was told that the machine was down. He told her he wanted to pay the $300 owed, she said he had to pay $600, he said he could come and pay the $300 now and an additional $300 the following week which would mean he would have paid a month in advance. She then said she wouldn't take the payment. That phone call was made on the 3rd and they came and took the truck on the 8th. When I noticed the truck was gone I called them and asked why they took it when in good faith I was going up there to pay it up to date. I was told I had to pay the full cost of the truck which is approximately $5455.00 to get the truck back. Then I said I'll pay the $600 plus the repo fee, they didn't want it. I tried everything and they would not let me. In addition to this, on Monday the 14th I received a certified letter saying they were going to come and repossess the truck, but they took the truck on the 8th, before I received the certified letter. In my opinion these are very unethical business practices, and I believe I tried everything to try and work with them.
