In response to complaint that was submitted on 9/15/and assigned ID of [redacted] .? Complaint Involves:? Contract Disputes? Response:? [redacted] signed and agreed to pay New Direction Driving School, LLC a fee of $to provide her daughter, [redacted] , drivers education.? Part of that contract stated that the school would not refund any tuition if the school is ready, willing and able to fulfill its part of the agreement.? It also stated that this agreement constitutes entire contract between the school and the student and no verbal statement or promise will be recognized.? ? New Direction Driving School, LLC was ready, willing and able to fulfill its part of the agreement.? Customer’s Statement of the Problem:? We chose to go with a different company to do the behind the wheel for my daughter and the owner had told us almost a year ago that this was ok but has yet to send over paperwork for us to continueWe were not told until within the last month that we had to pay to get out of the contract.? This would have been nice to know when we first asked.? I sent the money and we have still not received the paperwork.? Response:? ? The balance of $was to be paid when the student received the [redacted] Wisconsin Operator License Application to secure a temporary driving permit to start the behind-the-wheel portion of the course.? That amount was not received? During the start of the program and her receiving the [redacted] form, there was a change in phone numbers which created a problem with follow up with payment owed and to start behind-the-wheel lessons.? In December 2015, I was contacted by [redacted] asking if [redacted] would be able to complete the behind-the-wheel portion of the course with another driving school because her fiancé started working with another driving school which would allow them to get the lessons for free.? I needed to verify with the State of Wisconsin DOT/DMV that I could transfer a student with their temps to another driving school if they took the written temps test with my school.? In February 2016, I was e-mailed from Best Way Driving Academy to provide proof that [redacted] completed classroom which I responded that she had and I would look at processing the transfer.? I reviewed her contract and discovered that the balance of $had not been paid.? In July 2016, [redacted] and I had communication on completing her obligations of the contract that was signed on June 16, 2014.? Since I was willing and able to fulfill my end of the contract and it was her decision to change to another driving school.? New Direction Driving School, LLC offered to accept a reduced payment of $to consider the contract completed.? In August 2016, I followed up with [redacted] to see if she was going to move forward with my proposal or if I needed to address it differently.? She responded that a check would be mailed.? Payment had been received.? In September 2016, I had completed the classroom completion form and followed up with [redacted] to verify the driving school that I needed to forward the completion with.? The e-mail from Best Way that was sent in February had been deleted so that information was not available to me at that time.? It had been resent and completion has been forwarded to Best Way.?
