Here is our copy of original contract with the extras that were authorized by ***, himself As we don't work for free, we accommodate our clients with an ongoing verbal agreement as stated at the bottom of our contracts Our contract is very specific to repairing the front porch facia and soffit, replace two sliding doors, which were completely rotten and broken seals Remove an old rotten fallen down deck and debris pile and build a 6X8' deck landing All of which do not require a building permit [redacted] then ordered all the extras including an additional $1, [redacted] window to match his sliding doors I even took an extra cubic yard dump trailer of extra trash from his yard, including trashed grills, a jacuzzi, broken lawn furniture etcI have numerous pictures, and neighbors for witnesses [redacted] then asked me to remove ten or twenty large bushes to clear his back yard We left them to dry out and made arrangements with him to come back later this fall to assist with further removal of bushes in his front yard He and both sets of neighbors on either side were amazed at his properties' transformation This is why I am flabbergasted at his very mistaken accusations I even offer a payment plan option, if his situation was difficult at the timeThank you for looking into this matter for us Call me if you have any further questions.Paul I [redacted] President of New Earth LLC

I have been battling drainage issue and the damage they causeI needed my gravel driveway regraded to help with drainage and new graveledI also wanted border material installed to keep the gravel in the drivewayHe responded promptly and came by to review the siteWhen here he listened to my concerns, needs and wishesWe discussed options for the driveway and it came up that I need a french drain near the house to help defer all the water that naturally flows to the foundationHe said he was able to handle that work alsoHe was very knowledgeable, friendly and a pleasure to work with throughout the processHe provided me with a written estimate and contractOut of five people I contacted he is the only one who did so and was willing to do all the work neededPlus his price was competitiveHe sourced some railroad ties for the driveway border, leveled out the grade and installed a good gravel base as I requestedHe installed a drain that is working like a charm, I was amazed at how well it handled the torrential rains the following weekendNormally my sidewalk would flood several inches but not even a puddleThe driveway looks fantasticI am so pleased with all the work doneI highly recommend them

Revdex.com: I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear belowFirst off, the copy that New Earth is presenting here is not the original contract and this version I have never seen The two copy’s of the contract are what I submitted This one has obviously been redone New Earth obviously underbid this project because now he is again lieing in this statement regarding what was communicated verbally During this walk through of what was needed to be completed Paul saw and knew and said when I put my finger through the siding that they could not power wash this it would destroy the siding and that all of the siding needed to be fixed or replaced It was PAUL’s decision to purchase the more expensive siding when I clearly stated to him to get the other siding Now he is trying to pass that cost onto me when I said NO Also Paul stated that the time frame was going to be determined by the requirement of building permits and I said that was fine Then all of the sudden there is no building permit and I never asked as I should have It is obvious New Earth changed the direction once they torn the old deck off and saw the work that needed to be done There was only sliding door to be replaced and new windows installed in place of the 2nd sliding door The deck placement could have been started at the single back door and over to the sliding door that was replaced No new location of the sliding door was made just replaced in the same location This would have easily fit the 6xdeck Paul made this decision on his own to start the deck from the side of the house and move over, thus making the deck land in the middle of the sliding door Paul decided WITHOUT discussion with me to make the deck bigger and did so without my consent because he made mistake in his measurement I gave Paul the left over can of paint for the house color with the combination purchased from ***, yet he purchased the incorrect color and had to paint the back of the house separate times because he purchased the incorrect color In fact the final color still does not match the rest of the house The discussions on what was to be done was never done in the presence of my neighbors, so this statement has no relevance Yes he spoke to my neighbors as they were impressed on how it was looking Looking good and quality of the internal work are two different things The removal of the debri from the site was included in the project bid and when I asked if he could take the hot tub he said no problem, we would just throw it in with the other debris which is what he did The removal of the bushes in the back yard agreement was that I would pay for the dump fee Paul removed boxwood bushes and put all the debri in the back of the property He never said anything about letting the debri to dry first, he just never came back to remove it before the job was finished The big storm came in and he assumed I would move it to the back for the city to take during this time Again, fixing the rotten sub flooring and floor joists, insulation was all inclusive in the bid because that is what he was bidding on to do The gutters on the front and back which were both damaged and my conversation with Paul regarding that was in front of a witness My question posed to Paul “What contractor, especially you Paul, would take off clearly damaged gutters, and put them back up when the facia boards and the new roof installed? That shows that the contractor clearly does not believe in their quality of work You clearly saw how badly damaged the gutter’s were so why would you want to put them back up You saw these as I pointed them out, this was part of the whole bid.” Paul’s response was, “ You are right!!!” The extra that I clearly asked for was to take out the old kitchen window and get a smaller one that did not go behind my kitchen counter I clearly asked separate occasions on what the cost would be yet never gave it to me just ordered it and we would figure it out at the end During my discussion with Paul on the final bill with my witness in my kitchen, we discussed the deck, the siding and everything I was not going to be paying for because I didn’t approve any of that and Paul stated that “I’ve learned a hard lesson, I should always make sure to price out extras and put it in writing in addition to the contract.” Paul also said “I will itemize everything out and we will go over it and meet the following Saturday to discuss” Never happened and never got an itemized statement I priced the exact window in my kitchen at retail from [redacted] and that window is not $ I have been lied to, very poor construction, loss of my house key and now I have had to change locks on my house, The fact that it is very clear in the pictures no new insulation in the flooring was used and some floor joists were not even attached to the old joists so the floor moves and the floor in the kitchen part now moves up and down As far as the neighbors are concerned yes, of course they said this looks great after years of how bad it looked In fact one neighbor had agreed to hire New Earth construction to build their deck but as time went on they never heard back and went with a more reliable company Paul should not be flabbergasted on these facts because they are the facts with witness and pictures to prove Thank you for looking at my complaint [redacted] ***

Here is our copy of original contract with the extras that were authorized by [redacted], himself.  As we don't work for free, we accommodate our clients with an ongoing verbal agreement as stated at the bottom of our contracts.  Our contract is very specific to repairing the front porch facia and soffit, replace two sliding doors, which were completely rotten and broken seals.  Remove an old rotten fallen down deck and debris pile and build a 6X8' deck landing.  All of which do not require a building permit.  [redacted] then ordered all the extras including an additional $1,500.00 [redacted] window to match his sliding doors.  I even took an extra 28 cubic yard dump trailer of extra trash from his yard, including trashed grills, a jacuzzi, broken lawn furniture etc. I have numerous pictures, and neighbors for witnesses. [redacted] then asked me to remove ten or twenty large bushes to clear his back yard.  We left them to dry out and made arrangements with him to come back later this fall to assist with further removal of bushes in his front yard.  He and both sets of neighbors on either side were amazed at his properties' transformation.  This is why I am flabbergasted at his very mistaken accusations.  I even offer a payment plan option, if his situation was difficult at the time.
