Refuses to fix substandard work & refuses to fix my furnace that is not working & 2 leaks in the bathroom. Other work, too.I am owed a rebate for my tankless water heater & [redacted] refuses to have the proper paper work filled. In matter of fact, he never even brought up the rebate until someone told me that I was eligible for it. I called him to fix my leak that I had in the master bedroom & the plumber did. I then told [redacted] that I have a water stain on the 1st floor ceiling & he told me that he was going to fix it but he refuses to do it. Now I have another leak in the same master bedroom & he refuses to due it because he claims that I owe him [redacted]I called his HVAC sub contractor ([redacted]/XXX-XXX-XXXX) to fix my furnace (XX-XX-XX). I have no heat. I left him a message. No response. I called him again (XX-XX-XX) & left him another message. 1 of his workers called me & told me that they would be at the house in 30 minutes. I was at work. I told him that my son would be there. He came by & left without fixing the problem. [redacted] then called me & told me that [redacted] told him not to fix my furnace because I owe him money. I told [redacted] the situation & I told him that he was already paid for his work & that the town inspector approved the job back in [redacted] 2013. I reminded him that his work was guaranteed for 1 year. [redacted] told me that he was indeed paid (with my money) but that he didn't care because [redacted] told him not to fix it.My house was suppose to have 5 phone jacks. [redacted] installed none. I called [redacted]. He stated that it wasn't his fault that it was the electricians fault. I reminded him that he was the general contractor & that it was his job to inspect his sub contractor's work. He told me to call the electrician. I called him & told him that it needed to be fixed but I didn't want new holes on my walls. So I told him to put 2 on the 1st floor. He did. He then sent me a bill for [redacted] I told him that I wasn't gonna pay him anything that if anything he owed me money for not installing the other 3. I called [redacted] & told him that I wasn't gonna give him a dime & that he better fix it. A couple of days later, [redacted] told me that it was taken care of.When it came to my vanities, The plumber did not put the water lines coming from the wall instead he put them coming from the floor. I told [redacted] that I never seen this before & that I would have to reorder 1 of my vanities because of this. He told me that they were not going to change it. Then the plumber tried to charge me because [redacted] gave him the wrong measurement to my vanities in my master bath. I told the plumber that I wasn't going to pay him any extra. I then called [redacted] & told him that I wasn't going to pay any extra for his mistake. He then called me a couple of days later & told me that it was fixed.His [redacted]) did my outside landscaping. I payed him [redacted] He then told me that [redacted] told him to do the 12 x 12 cement patio. [redacted] then told me that I should add a 6X5 piece to it. I said ok. I told him to do a patio in the front & told him that I would not pay more than [redacted] for it. He then told me that he would do a trench for the underground utilities. I told him that he needed to give me a quote. He told me that not to worry about it that he would "hook me up." I then told him that I needed a quote because I was going to get 2 other quotes. He told me that he was going to due it for dirt cheap & that he would start immediately. He then finished the job & gave me a bill for almost [redacted] I told him to come to the house. I told him that there was no way that I was going to pay him [redacted] I gave him [redacted] because he stated that he also had an electrician hook up the services (without my permission). I called [redacted] & they stated that they hooked up the electricity & that I had already payed that about a year ago.I am a police officer so I will seek a criminal complaint on [redacted] for larceny over 250 (false pretense). This house was suppose to be build in 7 1/2 mths, it took him 16 mths because his workers never showed up 2 work.Desired SettlementI want him to fix everything that needs to be fixed. Me & my family are freezing & now I have to buy portable heaters. [redacted] claims that he had to do a res check that was required by the town of [redacted] & that I was responsible to pay for it. I googled this res check & fould out that it cost between [redacted] I spoke to [redacted] the town inspector & he told me that [redacted] did do anything. I confronted [redacted] with this & he said that [redacted] is a liar & that he doesn't know anything. This res check...he was billed me for [redacted] I had asked him the week before closing (we closed in mid [redacted] 2014) about the res check & he told me that he didn't do it. Then, the next day he told me that he did do it. Then he told me that my wife & I had agreed to update the windows & the insulation & that was why he was charging me [redacted] I told him that he was a liar that me & my wife never even talked about upgrading the windows. He told me the windows were [redacted] window & they turned out to be [redacted] window. I guess [redacted] makes them but that's not what he told me initially. He then charged me over [redacted] for work that was extra even though it's part of the contract. I can go on & on & on about this. He knows that I am a Police Sergeant for the city of [redacted] & a retired member of the [redacted] & this dirtbag does not care about anything except for trying to have all his sub contractor over charge me for everything. Also, [redacted] sub contractor had the audacity to tell me that if I paid him to fix the control board in the furnace that he would fix it but he won't follow the 1 year warranty.Also, check New England Fine Home Building [redacted] website. Recently, Mr. [redacted] also did this to a homebuilder.Thank you for your assistance.[redacted]Business Response In response to your inquiries regarding the [redacted] job:The house was 100% completed with a temporary certificate of occupancy on [redacted] I met the building inspector at the house on [redacted] to get the certificate but he only gave a temporary CO because the excavation was not ok with the inspector. The house was complete at that time. My company did not do any excavation.I put a final bill together one week later and went to give it to the [redacted]'s. They had no problems with me at that time. They were waiting for the bank to release their money. They did mention that the second floor shower tub leaked onto the first floor ceiling and I said that I would fix it after they paid me. After the final payment is made there is a one year warranty on the home and I told him that I would also be back to fix any other problems they might have during that year. I sent out the plumber to look at the leak and he said the shower stall in the master bath has a door that was left open when they took the first shower.My company did the heating in the home. It looks like a heating system in Walmart. The cost was [redacted] The [redacted]'s had it in the spec sheet. He thought he might want to do his own heating with a friend but in the end he was happy with my job. I installed and paid for the furnace.My company poured a 12' by 12' concrete pad in the back of the home. Advanced Excavation, [redacted], did it as he was doing the other concrete work for Mr. [redacted]. I paid [redacted] for the pad. The last page of the spec sheet shows an addition of a hatchway for [redacted] columns for [redacted] and a transom over the front window for [redacted] These were in addition to the original cost and were okayed by the [redacted]'s and the signed the spec sheet with these additions on [redacted]The window's used are all maintenance free glass windows, vinyl, low E .29.I told the [redacted]'s about [redacted] view windows when we met to talk about the spec sheet. Yes, there was no brand on the spec sheet but the 30 windows that went out to the house had [redacted] view stickers on them with .29 value. This is the lowest in the industry, lower than [redacted] and [redacted] This window also has a lifetime warranty [redacted] This is a top quality window that should last a lifetime.In the spec sheet under windows # 5, 6, 7, all the windows on the front of the house were changed from the original house windows to transom windows which I charged [redacted] for all the window changes. My cost was more than [redacted] And they were ok with the change and signed the spec sheet on [redacted]I worked with them for 1 and 1/2 years back and forth with the spec sheet. I left out the brand of window on purpose because I didn't know if the windows would still be available when I would need them. I have seen many window companies go out of business. I never took payroll while working this job! Not enough money!My lawyer told me this week that Mr. [redacted] has defaulted and has not replied to the courts. I have attached the copies of the contract with the signatures and dates for your review.
