Review: Contracted with New England Painting & Restoration, [redacted] (NEPR) to make repairs that resulted from a motor vehicle hitting our house. NEPR was one of several firms suggested by our insurance adjuster. The original estimate from our adjuster was approx $10,800. This was later revised to approx $17,900 once it was determined that the whole house would need to be sided because the existing siding could not be matched.

The following is copied from a 10/22/15 letter to NEPR as a direct result of their non-performance and ceasing communication with us:

It appears from your and your firm's lack of any response to my many attempts over the past months to contact New England Painting and Restoration, [redacted] (NEPR) that you have unilaterally chosen to terminate our contract.

We entered our contract with NEPR on 5/12/15, paying you $5,400.00 deposit toward the work as outlined in your 4/30/15 estimate, which followed the [redacted]. scope of repairs. These repairs were necessary and directly attributed to our home being hit by a motorist on 4/12/15.

Over the last six (6) months, NEPR and/or its subcontractors have only worked 3.5 days, performing no more than $3,300.00 worth of repairs, as outlined in our contract. Based on this, I respectfully demand that NEPR promptly refund the overpayment of $2,100.00 to me within the next seven days.

The following is the timeline of our experience:

- 4/12/15 – Car hit house causing damage.

- 4/30/15 – Received estimate from NEPR.

- 5/12/15 – Met with Eric K[redacted] (NEPR, Owner) and Bud K[redacted] (Sr Consultant, NEPR) to sign contract and paid $5,400.00 deposit. This represented the approx. 50% value of the original estimate from [redacted]., the assigned adjuster for our insurance claim. You offered that repairs should take approx. a few weeks once started.

- 5/20/15 - Subcontractor [redacted] Construction, [redacted] (2-man crew: Tiago A[redacted] and Orlando M[redacted]) made repairs to the NW corner of the house/living room: exterior plywood sheathing, broken 2x4s, removed damaged interior sheetrock, removed vinyl siding from the sheathing and covered with vapor barrier. (approx. 7hr) The vapor barrier is still the only weather protection on this corner of our home. There remains no downspout on this corner.

- 6/1 & 6/2/15 – NEPR (3-man crew) made repairs to the interior NW corner of the living room (sheet rock), above the dining room / kitchen doorway, the kitchen / family room ceilings, and painted the same. (approx. 7hr each of the two days)

- 6/12/15 – Met with Eric K[redacted] - measured house for siding. (approx. 1hr)

- 6/24/15 – Met with Kevin (supplier to NEPR) - measured house for siding. (approx. 1hr)

- 7/9/15 – Subcontractor [redacted] Plumbing [redacted] (1-plumber: Joe C[redacted]) repaired the hot water base board and cover in the living room. (approx. 3hr)

- 7/20/15 – Met with Eric K[redacted] and Bud K[redacted] to review the remaining work. Requested anticipated schedule and updated estimate. None received.

- 8/14/15, 12:49 pm – Left voicemail on Eric’s cell requesting an update. No response.

- 8/21/15, 2:13 pm – Left voicemail on NEPR office phone requesting an update. No response.

- 8/28/15, 6:24 pm – Text to Eric’s cell requesting an update. Eric (8:32 pm) replied via text - apologized, about office staff on vacation the last two weeks and asked when was a

good time to get together with the siders. I (8:36 pm) replied via text - offered that 9/2-9/4/15 were open.

- 9/9/15, 12:29 pm – Text to Eric’s cell requesting an update. No response.

- 9/14/15, 3:40 pm – Left voicemail on Eric’s cell requesting an update. No response.

- 9/15/15, 8:47 am – Eric returned call. Scheduled visit for 9/17/15.

- 9/17/15 – Met with Eric K[redacted], Tiago A[redacted] and Orlando M[redacted] to discuss schedule and remaining repairs. No estimates provided. Eric promised to provide by the following Monday, 9/21/15. None received.

- 9/25/15, 1:54 pm - Text to Eric’s cell requesting an update. No response.

- 9/28/15, 3:45 pm – Spoke with Eric on his cell requesting an update. Apologized about the delays, noted his busy schedule and to keep calling to help him keep on schedule. Noted that he doesn’t mind the calls. Confirmed my email address and promised that he would email a revised estimate to me before lunch on Tuesday, 9/29/15. None received.

- 10/2/15, 11:20 am - Left voicemail on Eric’s cell requesting an update. No response.

- 10/6/15, 10:32 am – Called Eric’s cell. No answer.

- 10/6/15, 10:33 am – Called NEPR office. Spoke with Ashley and requested call back from either Eric or Bud. No response.

- 10/8/15, 10:02 am – Called NEPR office. Spoke with Ashley and requested call back from either Eric or Bud. No response.

- 10/8/15, 11:20 am - Left voicemail on Eric’s cell requesting an update. No response.

- 10/12/15, 4:23 pm – Left voicemail on NEPR office phone requesting an update. No response.

- 10/14/15, 10:40 am - Left voicemail on Eric’s cell requesting an update. No response.

- 10/14/15, 10:41 am – Called NEPR office. Spoke with Ashley. She first thought that they ( I assume Eric and Bud) were discussing my repairs in their morning meeting, then upon checking the “folder”, told me that she could not help me.

- 10/18/15, 11:03 am – Email to Eric / NEPR. Noting promised schedules, unanswered calls, your request to keep calling / that calls were OK. No response.

I have afforded you and NEPR every bit of lee-way in moving forward with the contracted repairs to my home, yet you have consistently made promises and then not kept them. Our home continues to be an eye-sore and unfinished. I want and need to have our home completed before winter. It has become painfully clear, that you and NEPR cannot complete the work.

Kindly refund the overpayment of $2,100.00 to me within the next seven days and include a release from our contract.

Note - subsequent to emailing and mailing the above noted letter to NEPR, I still have not heard from, nor received any correspondence from NEPR.

I spoke with my insurance adjuster on 11/2/15 and he noted that he too tried to contact Eric at NEPR, but his calls also were not answered and not returned. He noted that he had never experienced this before with NEPR and that he planned to have NEPR removed from our insurance company's preferred contractor list.Desired Settlement: I want the over payment refunded to me and a release from the contract. I am currently working with our insurance company and adjuster relative to securing a contractor to complete the repairs to our home.
