In response to client complaint, New Green Landscape argues that her dispute is inaccurateThere were multiple issues which led to project delayThe following are facts regarding the landscape project:
- Client's home on property was under major renovation during
landscape contractAfter beginning landscape work, General contractor and client requested New Green Landscape to assist with exterior work on the homeThis additional labor resulted in over weeks of delay of landscape labor- Due to the almost month extension to contract, the desert weather was then not conducive to installation of plant materialRecorded temperatures were ranging from - degrees during the summer monthsClient was made aware of this issue and was updated frequently during summer months while weather was being monitored.
- Landscape installation proceeded in the FallDuring the middle of the final phase of the project, the client expressed impatience and became extremely upsetNGL Office manager intervened in an attempt to negotiate a plan to complete the remaining workClient admitted to office manager that she was very happy with work crew and the work that was installed thus far.
- NGL attempted to complete the project, but client stated her wish to not have them return to propertyAfter negotiations proceeded again and NGL was scheduled to proceed with final irrigation installation, client demanded to have work done during the days before Christmas Client was informed that the work crew was on vacation and would be available upon their return on January 7thAfter many attempts to negotiate with client (including her demand to respond to her email on Christmas Eve), she ultimately stated by email that NGL was not to return to the project

Review: [redacted] has not completed the contract (8 months over due) but due to extremely frustrating dealings with [redacted] and after repeated requests to get him to agree to finish the job in a timely manner( contract was for April 30th I was continuously getting excuses as to why he couldn't come week after week despite the fact that I had paid $145,000 of a total $155,000 contract by June 20th. Our inability to communicate without him being extremely aggressive in his language to me that I found it necessary not to speak in person with him preferring to communicate by text or emails. Thus yet after still more delays and more excuses as to why he couldn't come each week...I had to release him from the job as of December 12th. Just prior to this, he planted $16,000 worth of plants and failed to connect the watering system to ensure the plants survival. As a result some of the plants have died and it has left me to hand water the entire front and side yards. I am now concerned that he won't honor the rest of the contract which totals over $145,000. There was only a $10,000.00 balance owing to him, but he made it impossible with his delays and he was insistent that I now pay him by cheque the day after he was supposed to be finished. I was asking for reasonable terms and had questions regarding warranties and lien releases. Now I'm left with a mess and having to look for a company to finish the job. I do not really want to deal with him or his staff, however I feel he still has to honor the parts that do include all the work he did do and I did pay for.The total contract was 90% complete and a significant amount($145,000). I am unsure as to whether I have overpaid or not. He has left dg in my driveway, holes where plants were to go, no lights at all, and a watering system that is not hooked up yet. Many other unfinished parts but too much to mention here.Desired Settlement: I do not know for sure how much the actual amount is between what I paid him and how much he has left to do. In addition, I am very concerned over the Xmas season that many of the plants may die due to lack of water. We are not able to communicate with each other in a reasonable manner. I find him aggressive and defensive when I simlpy want him to honor what he says he is going to do and quit making excuses as to why he can't show up this week or next. I asked for details of the plant material, and some other itemized items to no avail. I also added for a warranty period for the plants which are 3 weeks old now and have not been watered. I did fire him and ask him not to try and contact me, but of course I am now stuck with potentially $16,000.00 worth of plants to all die if I don't get the watering system connected. I think he acted very unprofessionally and irresponsibly by even planting the material without a concrete plan as to when the watering system would be properly connected.
