Review: My relative has been residing at New Homestead Home - an Adult Assisted living facility, since December 2010. He had a severe stroke after which he has been unable to work, nor to take care of himself. I am his sole relative handling things for him. This facility employs a social worker on the premises who's job is to assist the residents to apply for the benefits they are entitled to. The social worker, [redacted] never provided me with any guidance in regards to this matter. Subsequently, my relative has run out of funds to pay his rent for this facility and I have been in the process of applying for his benefits all by myself. In May 2013, Social Security Administration approved my relative's disability application, however there is a delay in obtaining the benefits my relative is entitled to due to the SSA's request to see his Permanent Resident Card. I discovered that my relative did not complete his Permanent Resident Card renewal properly before he had his stroke, so I have been in the process of dealing with the government bureaucracy to re-apply for his Permanent Residency Card. New Homestead Home has been harassing me and trying to intimidate me about paying my relative's bills: 1) They have accused me of stealing my relative's money. Both the owner. [redacted] and the manager on the premises, [redacted] has accused me of stealing my relative's money several times. 2) The owner of New Homestead Home, [redacted] has threatened me and tried to intimidate me. He left me phone messages on my cell phone accusing me of stealing my relative's money, and saying that my relative is asking for his money. [redacted] tried to intimidate me claiming that he has reported me to the police and the District Attorney's office. I have saved his July ** phone message for documentation. 3) They have violated my privacy by contacting my place of employment. [redacted] found out where I work and on July **, contacted the corporate office of my place of employment and left a detailed message of a very personal nature. 4) They lied about my relative's condition and well-being. On July **, [redacted] contacted the corporate office of my place of employment and left a message that was all lies. His message claimed that there was an emergency in that my relative was ill and needed to be taken to the hospital. I spoke directly to my relative later and he told me this was not true. Also, my relative's COBRA rep spoke to him and confirmed that this was not true. 5) They have violated my privacy by providing a collection agency, [redacted], with my cell phone number and address without my permission. This collection agency has been harrassing me by calling my cell phone and sending me threatening mail. I have their phone messages saved. 6) I have been unable to visit my relative in the facility because they have instructed the staff to be on alert to report to them whenever they see me so they can harass me. 7) I cannot call to request to speak to my relative from 8AM to 6PM because they instructed the receptionist to hand the phone to the manager, [redacted], who then verbally abuses me and accuses me of stealing my relative's money. 8) I need to know how my relative is doing/progessing but New Homestead Home never provided me with reports about how my relative is doing/progessing when I requested it. The on-site psychiatrist and psychologist never returned any of my phone calls. I even told my relative to make a request to the resident psychiatrist to call me but he never contacted me. If New Homestead Home had done their job from the beginning and provided me with the proper guidance for applying for my relative's benefits from when he was first admitted in December 2010, then my relative would not be in this predicament where he is unable to pay his rent and medical bills. The government would have taken over paying his disability benefits and I would have been able to transfer him to a governement facility by now. I am not financially responsible for my relative's bills and should not be harassed by New Homestead Home. Once the Social Security Administration's request to see my relative's Permanent Resident Card is satisfied, they will pay my relative's benefits retroactively and then the bill for New Homestead Home can be paid. However, since New Homestead Home failed to provide my relative fully with the services he paid for, there should be a reduction in the outstanding bill. New Homestead Home has only been interested in getting their money without providing the service they are paid for. This facility has harassed me, caused me extreme grief, contacted my place of employment without my permission and they should pay for damages. I have experienced loss of income due to the time I have to spend on applying for my relative's benefits because they would not do their job in providing me with any guidance or assistance. Please let me know if you need additional information. The New Homestead Home is a private adult home, licensed by the DOH of New York, owned and operated by the [redacted] family for over 38 years. We take pride in providing quality care to all of our residents and have gone above, and beyond to service [redacted] even though his bills were always paid late, this after much effort in trying to contact [redacted] who is the representative on the admission contract and is legally responsible to uphold the agreement signed on 12/**/10 by she and resident

In addition to the above mentioned [redacted] has never paid the pharmacy co-pays for medications that a re needed to treat his medical condition. Currently [redacted] owes, Chem-Rx Pharmacy over $3,000, till now they continued to service him due to the fact of the long standing relation we have with them. Last week we were informed, that they will stop servicing him as of September and the account was sent to collections as the bill has still not been addressed by [redacted] and no payment has ever been made.

The below comments represent our position on this matter as well as the discrepancies on the complaint submitted by [redacted].

• We are a private pay facility. We are not an assisted Living or Nursing Home, therefore we cannot bill Medicaid and he is not able to have any "benefits" pay for his stay.

• Upon admission we were not given any ID other than a copy of his driver's license and insurance card. At no time before, during or after the admission process did [redacted] make any requests for assistance of any sort. We had no way of knowing he had a permanent resident card or that it needed to be renewed.

• As a private adult home we are not required to have a social worker Our case manager has tried on numerous occasions to reach out to [redacted] with no success, and whenever we reached out to his,brother we were told to speak with [redacted]. This left us with no other option than to call to Adult Protective Services for neglect.

o During this period with the assistance from Adult Protective Services we arranged and paid for a n escort to accompany him to the social security office only to find out he was not found in the system. Once corrected we made another appointment to request for a work history, the case manager emailed [redacted] and she showed up the day of the appointment and took him without speaking with any facility representative. She did however storm into a therapy session demanding documents from our on-site psychologist (mentioned in complaint) which is an outside vendor and is not affiliated with the facility.

•Facility reps did reach out to [redacted] several times in an effort to get paid and because she would never return our calls. The few interactions with her always resulted in her storming off not to be heard from again. This left us no choice but to send the account to collections for failure to pay rent for 2013, despite continuous medical care being provided.

Recently we found out that all of his bank accounts were closed and there was a large sum withdrawn from his account on 12/**/10. This information has been forwarded to Adult Protective Services for further investigation.

New Homestead has made a valiant effort to try to resolve this matter without having to bring him to court for eviction, so as not to compromise the mental health of resident. It is disheartening that [redacted] is not meeting her obligations and has resorted to filling a com plaint that is truly fiction and offensive as we have not only taken care- of him but rehabilitated him.

At this time the resident fears that he will be left alone and is upset but not surprised of [redacted]'s behavior and lack of accountability.

It is our hope that this will be resolved soon with mini mal da mage to the resident. Please let us know how to proceed as we have an impeccable record and would not want to tarnish it with [redacted]s fabrications.
