Mr*** called in and stated his complaint is resolved
Review: On September 04, 2014 I signed a contract for bathroom renovaation work to be done by [redacted], owner of New Hope Tile LLC, balance due on job to be pad upon job completion. The job estimate came in at $1880.00 with a request for initial deposit of $880.00. I mailed the signed contract to Mr. [redacted] at the given address: [redacted], along with my check #4345 in the amount of $1,000.00. We had delayed this job at one point and I wanted to show I was serious about getting started.
I was originally scheduled for job start on October 01, 2014 but that was later changed to October 13, 2014 . Unfortunately, I next heard from Mr. [redacted] on October 09, 2014. His email said he was in the hospital for an MRI for a back injury that just happened on the job before mine. At that time we both thought he would be back to work within a few weeks. Contact continued between us on October 15, November 04, November 07, and November 25 when Mr. [redacted] emailed that our December 01, 2014 job start date could not be met. He also stated he would refund my contract deposit if I couldn't wait any longer.
On Tuesday, November 25, 2015, I answered Mr. [redacted]'s email requesting the refund of my contract deposit.
While I do not doubt the sincerety of the intent nor the fact that Mr. [redacted] was injured, I am wondering why the deposit is being held up for so long. It was implied that Mr. [redacted]'s accountant sent out checks every Thursday. Initially, the accountant had a problem understanding the situation but he would be instructed to refund the deposit of $1,000.00. That statement was made at the end of November.
I have contacted Mr. [redacted] several times and have not yet received my refund.
I have informed The [redacted]'s that I am now paying interest on the credit cards I used to pay for plumbing and electrical work already completed for the job. If I had that contract deposit refunded, the use of credit cards would not have been necessary.Desired Settlement: A cashier's check for the return of my contract deposit amount of $1,000.
If not received within the next 10 days, I will file a claim with Delaware Small Claims Court and ask for court fees and interest.
