*** hired my company to do both tree work and Ivy removalWe began working with *** immediately upon contract being signedUpon inspection of the trees and Ivy I explained to Mrs *** *** that she has poison IVY growing over several trees
and that she would need to spray several times to keep the IVY away from her home and off her treesTo be exact Mrs O' Malley had several hundred yards of ivy growing through her wooded lot onto her home and its surroundingsWe applied coats of commercial Poison Ivy Killer to all areas she was concerned aboutI than explained to her that this was only going to kill what was on her sidewalks and surrounding areas around her homeI gave her the option to do additional spraying to areas that were in her wooded lot at an additional charge*** did not want us to do any further spraying to these areas due to costI than explained to her Ivy that is not sprayed will continue to growShe said that her handyman would address these additional areas and she did not want to spend any further moneyJans job was completed PER here specifications and to the agreement madeMy team and I were delayed about a day or so due to severe weather conditions but nevertheless provided services she wanted within hours of signing onRoughly about weeks later I received a call from *** with concerns about the IVY still growing on the propertyI addressed here concerns and explained to her a second time that IVY growing from woods will continue to grow because she did nothing with itI agreed to help her out FREE OR CHARGE and respray areas she did pay for agaian to ensure death of IVY growing in those areasI applied more heavy applications of Poison Ivy killer upon arrivalUpon my inspection I could already notice dried up and dead vines from the first application, however I sprayed again as promisedI received the last call from *** with more concerns about IvyShe explained to me that its still growing and out of controlI setup an appointment with her and met her onsite to handle the complaint only to find dead vines, barbs, and IVY (WHERE SPRAYED PREVIOUSLY) I explained to *** that we did exactly what she wanted, in the areas that she wanted to pay forShe became upset about this and I then explained for a fourth time that she did not pay for spraying in the woods and "the handyman" was in charge of cleaning up those areas
New Image and its reps have done everything to contract and have went above and beyond to make this client happyThe multiple free spraying and trips taken out to the property have been excessive but completed as a way to show professionalism and successful extermination of IVYAt this time we feel *** is trying to take advantage of us in a way of excessive spraying and free workNew Image works with many clients to help beautify there homes and has never "promoted poison IVY growth" as stated in her complaint*** has stated that we did nothing more than increase growth and expansion of IVYFor the record there is no product known to man to promote growth of poison IVY or create poison IVYShe is simply calling us back to spray areas that she does not want to pay for and knows that its growing consistently

This response is a blatant insult; painting me as a cheap, senile old woman who had to be told "4X's" and wanted something for nothing*** I'm not MRS*** I'm DR*** I've been a practicing psychologist for over years and see right through the feeble attempt to twist the facts and timeline of the work in question: I signed the estimate with a man,NOT the response writer, on 4/At that time, the poison ivy was just beginning in the ground coverIt was not on my walks, climbing on the house or treesThis man assured me that the product they use would eliminate the ivy while leaving the ground cover undisturbedOf course I wanted all the ivy extinguishedIt would be stupid not to eliminate it allI was NEVER given an option or said I didn't want to spend moreI was assured it would all be treated and retreated if neededThe job was completed and paid for the next day, 4/Since I wasn't there, I trusted that it was done properlyThere was no delay due to weatherNew Image did NOT receive a call from me weeks after completionI didn't make it back to Niles (due to surgery) until May 30th, over a month later .This is the first time I called, upset over the abundance of poison ivyI never met the respondent until July 18th, when he pointed to the overgrowth of ivy (as though I couldn't see it!) This plus the dead trees I paid *** to feed, which included re-feeding each spring, was the reason for my call
This response doesn't address the 2X's they confirmed appointments (7/@9:and 8/@ 10AM), causing me to reschedule patients in Chicago so I could be there..AND THEN BLEW ME OFF!
Obviously there is no amicable resolution to this complaintI can only warn people dealing with this business not to trust anything that isn't in writing and to watch them do the work

It has come to my attention that [redacted] Reinholtolz, has filed a complaint against my company New Image Tree Service. This letter is to provide supporting documentation and clarification on any concern that she may...

have.
On 4/13/17 I met with [redacted] to discuss removing a large tree behind her home that bordered properties with her neighbor. [redacted] and I discussed how the tree would be removed and the process and actions needed to be taken to remove this large tree. This tree was positioned directly on the property line and the canopy of the tree stretched roughly 25’ into both [redacted] and her neighbors yard. I explained to [redacted] that we would need to get access into the neighbor’s yard to successfully remove this tree. She assured me that this should not be an issue and we proceeded to fill out all details on the contract between New Image and [redacted]. At this time, I was instructed by [redacted] to stack and pile all good usable wood that is not bug infested or destroyed into her yard. She instructed me that the wood was to be piled to the back right of her pool. As the work began this is where all the good wood was placed for [redacted] as the job continued into completion. The contract which I have enclosed a copy of signed by Mrs. [redacted] says “Firewood Stays” directly on it. In addition, “No Stump at This Time”. This contract is an agreement that New Image and every customer we work with abide by for all work completion and questions regarding services. [redacted] was given a copy of this as she signed our agreement onsite on 4/13/17.
Work began the morning of 4/19/17. The tree was removed per contract and wood was placed behind the pool according to [redacted]’s request and the contracts agreement. As work on the tree came to a completion my supervisor was given a check from [redacted] for services completed onsite. [redacted] was onsite most of the time my team was working on the tree, and was onsite for final inspection because she inspected the property before she handed out payment. She thanked my crew and we finished any small cleanup around the premises such as branches, leaves, twigs around the work zone. Roughly 10 to 15 days later I received a notification from my financial institution (First Source Bank) that [redacted] check # [redacted] was rejected for Non-Sufficient Funds. I have enclosed a copy of this for Revdex.com as well. Please note the bank marking and notes “nsf” and “returned”. In addition, my company was charged a returned check fee and incurred charges for receiving a “bad check”.
I contacted [redacted] immediately and explained to her the issue at hand. She laughed it off and said that other bills must have come out of the account. She then explained that she will mail a check for payment. At this time, I explained to her that this was not our agreement and a breach of contract. All payments are due when services are rendered. This is clearly is stated on the New Image agreement in which she signed. [redacted] then told she would issue another check in replacement for the first. At this time, I was very leery that this second check would be bad as well. I told [redacted] that was fine and I would meet her onsite to grab the check. At this time, she explained to me that she had a concern about the wood onsite and 2 patches of grass that were worn from the tree removal process. I explained to her that I would look into this for her as we met and address her concerns then.
I met with [redacted] on 5/4/17 and she explained her concerns about previous work. Her concerns were wood size and placement. In addition (2) spots of wear on the neighbor’s property line. I instructed [redacted] that I would apply a layer of dirt onto the wear spots so that grass would grow as time went on. She was fine with that and we met with her neighbor and he was also ok with that. In addition, the neighbor had a concern about his sprinkler heads and wanted to activate them all to make sure there was no damage. I gave the curtsey and time for him to activate his system only to find out that everything was in working order and no damage was apparent. [redacted] and I walked back onto her property to inspect the wood pile left onsite. Her concern was that some pieces were a bit to larger for her to handle and she wanted to know if we could remove a few of larger pieces and possible “scoot” the pile over a bit away from the property line. I obliged [redacted] and said this is not an issue and I will take a few larger logs and move the pile over a bit. [redacted] then explained the need to get additional work completed in the form of haul away and demo.
[redacted] explained to me that she needed all of her “garbage” in the backyard to be removed and ground flattened out. Also, she wanted the old broken shed onsite removed from the property. Upon inspection she had old tires, shingles, wood, scrap metal, toys, rail road ties, lumber, and car parts within the backyard area. Also, the shed had several broken sections and glass shattered around it. I pulled out a new contract at this time and began writing [redacted] a new agreement. The agreement stated removal of all trash, demo of shed, and grade backyard. I explained to [redacted] that new soil for the grade process will be needed since she is very low in spots. She then told me my main focus is to remove the shed that has already partially collapsed and remove the trash. “I’m not interested in bringing in material just yet” I obliged and told her that we would focus on haulaway and demo of the broken shed, followed by the smoothing and grading
That weekend the work began for completion of the haul away and demo. My crew upon arrival took 8 of the larger logs from [redacted]’s woodpile and also put down soil to fill the worn areas of grass for the neighbor. Following that the haul away and demo began. I hauled 6 dump truck and trailer loads of debris from [redacted]’s residence. In addition, graded the property as contracted with what extra soil and fill that was available onsite. Once completed [redacted] was not home to walk down the property. I instructed my Manager Mr. [redacted] to collect and speak with [redacted] to close out the contract. Mr. [redacted] did just that and [redacted] left a check taped to her door completion of her demo work. This check was collected and brought straight to [redacted]’s bank for security reasons the check was written to the owner’s name to directly cash the check without risking another “nsf” issues. At this time, the teller said please contact the check issuer as the funds are not in the account at the moment. For a second time [redacted] passed * check that funds were not available.
At this time, I became very suspicious of [redacted]’s trust and had Mr. [redacted] call her directly to see what the issue was. [redacted] then explained to Mr. [redacted] that she did not transfer funds. This conversation was on speakerphone with [redacted], Mr. [redacted], my office manager, and myself. Three representatives from New Image were all in the office and on the call with [redacted] when the call was placed. For security reasons, I had them listen in and include themselves for our protection if anything ever perspired from this. [redacted] then explained that she has been trying to get in touch with us to explain the second check issue and also talk about moving more wood. I explained to [redacted] that PER our agreement that she has a copy of and signed clearly states all wood stays on property. If I move anything else offsite I need to charge accordingly for it. She said “well I didn’t realize how much wood it was going to be” I politely told her that we can do it for a charge, I cannot offer any more free labor or services. She then explained the funds for the check would be available the following day.
This has been the last time I have heard from [redacted] to date. Her complaint list multiple days in which she claims to have called into my service only to get a voicemail not setup message. Our main number is always operational and up and running with a voicemail system that can hold up to 125 messages if need be. In addition, it also has my personal cell phone number attached to it for any concerns or emergencies to be directed to me instantaneously. I have read [redacted]’s complaint and she is complaining about spending [redacted] in services that have been completed per contract with her signature of acknowledgment and acceptance. All work has been completed at this client’s house and extra work at no additional cost.
I would like Revdex.com to review all paperwork I have attached showing where [redacted] accepted the terms and what she paid for. Also, please let me know if I should contact my banking center for a statement from them explaining the conversation I had with them in regards to [redacted]’s bad check. What is not clear to me is that [redacted] claims to have had another company come in with a dumpster and do additional work. Work in which she claims was never completed. Why would a client pay for a service that they inspect before payment and then claim that the work was never done? I don’t understand what she is trying to do here.
At this time, we have pulled in our company lawyer we are ready to pursue and legal action if need be against this client. [redacted] is taking advantage of free work given and obviously has some financial issues that are creating problems for her. I highly encourage her to read her contract and understand what she has had completed and paid for. We have done everything we can for this client and now she wants reimbursements on services that have been completed. In closure, I will say we have had multiple rain delays on both of these projects which did indeed slow down the work but did not prevent us from finishing any work we were hired to do.

As owner of New Image Tree Service I wanted to apologize for this slight oversight. We are in a industry that demands immediate attention to...

hazard scenarios. In this such case my attention was pulled away from this minor detail do to hurricane Matthew and its destruction. I was dispatched to South Carolina for the state of emergency that Matthew caused to the state and its residents.Mr. [redacted] is a great client of ours and we are here to help assist him in his tree care. In addition to this oversight my office manager went on maternity leave at the same time I was dispatched. Mr. [redacted] will be adjusted accordingly. A check will be issued immediately to satisfy his concerns. Work has been completed as contracted to his liking, however a slight paperwork error has occurred which has caused this issue. New Image Tree Service apologizes for the mix up in paperwork and have issued a check for the discount as promised. Have a wonderful day.
