Review: This company fraudulently charged me $ 104 to my credit card in September whereas I canceled their membership in January. I have not visited this establishment ever in last 7 months neither I possess their membership card any more. how can they charge my credit card without my consent?

I want them to stop charging my card and refund my money immediately.

I have cancelled contract after 12 months obligation. I have not renewed contract.

Response:

The member who filed the complaint came in to our facility on January 11, 2014 and filled out membership freeze instead of canceling their membership entirely. We give our members this option so that our members whom may not be able to use our facility for an extended period of time (i.e. medical, travel, personal, professional, etc.) are able to keep their membership and not have to re-enroll upon their return to our facility. This is use a convenience to the members.

When freezing your membership a member is not able to use the facility but can come back at any time to reinstate their membership. We denote on the Membership Freeze form the duration of the freeze form as well as when the members normal membership dues Will begin again.

The member signed this agreement at no fee which was waived by our management staff due to their travel. The membership was to remain frozen from February 1, 2014 to September 1, 2014. Their normal membership dues would begin again on September 1, 2014. I have attached the from signed by the member to this letter.

When speaking to the member on September 10, 2014 I made the member aware of the terms of the membership freeze and that the member signed and agreed to this form. The member was then sent the signed membership freeze agreement showing why the membership was charged their monthly membership dues for the month of September. The member agreed and asked if there was anything we could do to help since the member was unable to use the facility for travel but the members spouse would still like to use the facility. As a courtesy I allowed the primary member dues to be applied to his spouse’s membership for the month of October. The member agreed to the terms and asked that the primary membership be cancelled immediately which was then processed and cancelled as of September 10, 2014.

Review: New Jersey Athletic Club (NJAC) is unable to provide me with the personal training service at the quality and level for which I have paid them. I purchased a package of 36 training sessions with female pro-trainer [redacted] This package included one-on-one training sessions with use of the PCT area which allowed for use of extra equipment and a multitude of exercise options. I was charged a higher package rate because of [redacted] pro-trainer experience level. Over the last several months, personal training clients have been denied use of the PCT area which has been given to their new cheerleading program. No concession was made to clients. [redacted] was then terminated as pro-trainer at the gym. NJAC could not offer a comparable female trainer. They instead offered me the only remaining female trainer who had not yet received her actual certification and had no practical training experience. No concession was made to me for the move from a pro-trainer to a new trainer. They continued to bill me at the higher rates. After losing my experienced trainer and the amenities I was sold I provided notice to NJAC in person of my intent to quit the gym. At this time I requested from the GM, [redacted] a refund of only my 18 unused sessions. He declined. I have reached out to him via certified letter to address this issue and have received no written reply.Desired Settlement: I would like to be refunded for the 18 unused sessions ($1200) from the package of 36 sessions I purchased.
