Good afternoon,This is in response to a complaint filed against our business, Retro Fitness of LawrencevilleOn September 26, 2013, [redacted] signed a "Minor Membership Approval" form for his son [redacted] The form states the following: "I approve my son's or daughter's membership at Retro FitnessI have read the terms and conditions of their membership agreement and fully accept and understand all terms and conditions" [redacted] also signed a "Credit Card Authorization" which states, "I [redacted] authorize my credit card/bank account to be utilized for [redacted] membership at Retro FitnessI authorize Retro Fitness/ABC Financial services to draft monthly dues from this account on a recurring monthly basisI have read the terms of the membership agreement and fully accept and understand all terms and conditions" The contract he agreed to is a month agreement with an automatic renewal which requires the member to provide a day written notice to delete the automatic renewal or request cancellation once the contract has renewed We have notes in the member's account of the member's mother calling on 11/20/verbally requesting cancellationWe told her at that time that the member was still within his one year contractWe asked her if there was anyone she would like to transfer it to and she said she would be in with her older sonThey never came in to transferThe next note is dated 7/28/The members mother called about cancellingShe was told about the written cancellation policy and she said she was filing bankruptcyWe told her we would just need the paperwork showing the bankruptcy information to cancel the membershipWe did not receive any bankruptcy paperwork or a written cancellation requestNote dated 2/26/Member's mother called upset about the collection calls she was receivingShe asked how we could allow a year old boy to sign a contractWe told her thatthe members father had signed all paperwork approving the membershipShe requested a copy of everything and said she would be in to pick up the fileShe has not been in to pick it up as of 3/17/All of the notes we make on a members file are time and date stamped and can be printed out should you need them for your recordsI can also provide you with a copy of the members agreement and all of the approval forms, waivers and release of liability forms signed by the members fatherLastly, please note that [redacted] is no longer employed by Retro Fitness and his name should be removed from any correspondence

I am rejecting this response because:The employee who signed me up for the membership misled me and I just signed the papers according to what he told me. My wife is the one who tried to work with them but I know I was misled in signing those contracts 
She wasn't there and had nothing to do with the whole process except trying to work with Retro when she shouldn't have. The employee told me it was monthly but had me signs contract saying something else.

We told her at that time that the member was still within his one year contract. We asked her if there was anyone she would like to transfer it to and she said she would be in with her older son. Review: I spoke to a guy at the Retro gym and he told me that the membership for my sons would be on a month to month basis and you could cancel at any time. On that basis I signed my sons up for the membership. My wife calls to cancel about 9 months in and she is told that it is a yearly membership. I am positive the guy told me month to month but my wife says just wait it out its almost over there was only like 3 months before the year was up. Well then they are still debiting my account after the year is up and then we are told that the membership rolls over you must cancel 60-90 days in advance. Now I have [redacted] sending collection letters to my 15 year old son. Neither of my children went to the gym much one child went 2-3 times in the year and one went 10-14 times in the year. I felt that the sales associate misled me. I was told it was a month to month membership, cancel anytime and that is the reason I signed up for the gym membership. Now its nothing but a mess I am not paying for a service that was not used and was supposed to be monthly.Desired Settlement: Cancel the roll over contract, clear all monies that you are saying are owed after the year was up and contact [redacted] clear the debt that they are trying to collect.
