I would like to preface this reply by saying at no time did Mror Mrs [redacted] have any conversation or correspondence with Mr [redacted] , the owner of Mid-West Grounds All contact was with Landscape Designer [redacted] During the original meeting with Mrs***, Mr [redacted] was not present, the project was outlinedThe objective of the project was discussed as well as where the debris that would be created would be placedIt was expressed to Mrs [redacted] the large amount of material that would be created and asked if she wanted it removed from the property for an additional fee of $***She expressed that we should just pile the material up in this area in the yard, where she pointed toShe stated that her and her husband would cut up and discard or burn the pileThe property lines and corners were not marked by any stake or painted markerThe property line was difficult to decipher due to a very curvy creek that abuts their property and their neighbor’s property The day before the project was to begin [redacted] stopped by the property to make sure the conditions were applicable and the ground was not too wet to begin the projectMr [redacted] happened to be home At this time they conducted a walk thru of the property and project details Once again the area for debris was discussedMr [redacted] stated he wanted the debris material to be placed in the same area Mrs [redacted] had prior authorized and pointed it out The area in question was in the southwest corner of the propertyToward the back of this area he pointed to, along the creek, his son had created a play area with plastic buckets, tools, and toysTwice, during the conversation it was expressed to him that we would be placing the materials in the area his son had created to playHis response was that his son would just find somewhere else to play, indicating he knew exactly where the materials would be placedThe conversation turned to a discussion on the areas in which large piles of wood chips would need to be moved to and again he pointed to two areas along the creek lineAll the debris from the project where placed in the three areas as discussed prior with Mrand Mrs*** We feel that Mrand Mrs [redacted] did not realize how much debris would be created by the project and could not cut up, remove or burn the material in a timely manner to satisfy their neighborsWe completed the project described in the contract and placed the debris in the areas discussed with the client After completion of the project, Mr [redacted] did not try to contact us until we asked to receive final payment, which was days after the project was completedDuring that day period, neither Mr nor Mrs [redacted] tried contact us in any way to express dissatisfaction with the project or the mentioned problem with the debris locationAgain it was only after we asked for final payment that Mr [redacted] expressed a problem with the project After hearing from them that they were not happy with the agreed placement of the debris Mr [redacted] met again with Mrs ***The problem was discussed and it was mentioned that the pile of debris was much larger than anticipated and could we remove it from the propertyIt was then that Mrs [redacted] was told that for Mid-West Grounds to come back in the property and remove the debris it would cost an additional $ [redacted] to $ [redacted] dollarsShe quickly discarded the idea and said they would just take care of it, but could we send someone back to rake the chips back that we had pushed those too far onto the neighbor’s property The following day we had employees back on the property and raked back the chips and the crew spent some time pulling the debris back from where it was onto the ***’s property Mid-west Grounds feel that we completed the contract as it was written and verbally discussed on occasions We also believe that Mrand Mrs [redacted] did not imagine the amount of material that would be created with this project and just could not physically handle the debrisThe neighbors complained and they realized they had made the mistake, and now, do not want to pay the balance to recuperate the monies that they had to pay another contractor to clean up the debris, which they didn’t even completeMid-West Grounds would have happily come back in to the property and removed the debris and reseeded the area for the $ [redacted] they paid the other contractor and we would have completed the addition At no time did Mid West Grounds forge any signatures After repeated phone calls ,leaving voice mail, sending emails and even sending faxes to Mr ***s workWe called one more time to inform Mr [redacted] that we would be charging his credit card for the remaining balance the following day A month went by with no response from Mr ***, until we where alerted to the dispute charge from our bank Again we tried numerous attempts to try to contact Mr *** Mid-West Grounds strives very hard to satisfy all of our customers, we are very sorry for Mrand Mrs***’s dissatisfaction, but we do feel we tried to accommodate their needs even though they disagreed with our solution / [redacted] Style Definitions */

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below First, I admit I may have been mistaken on the name of the man who had contacted us; I had thought he said his name was ***, simple mistake I did, however, briefly meet with Mr [redacted] personally the morning of the day the work was done (before the work took place), and clearly identified the property line to him (which would've been the second time it was indicated to him).In the initial meeting, which was with my wife, she was very clear on where the debris should be placed and she had a lengthy discussion about the problems we've had with the neighbor to the rear and emphasized where it should be placed, and that "they should not even step foot on his property" She then pointed out the property markers that have been there since we had the property surveyed about years ago; they have bright pink ribbons on them and make a nice clear visible property line that connects the rear property line to the fences on either side of our property The companies that we had to eventually have come out to give estimates on moving the debris back onto our property all expressed shock that any professional landscaping company would do this, as they all felt it was very evident that the debris was CLEARLY not on our property And yes, we were perfectly content to have the debris placed on OUR PROPERTY.At no point in our conversations with Mr [redacted] did we once ask them to remove the debris from our property; we simply asked that it be put in "the southwest corner of OUR property" as stated in the contract We were absolutely fine with the amount of debris; we were just upset once we realized they had dumped every last bit onto our neighbors' property, and that we had to deal with two very irritated neighbors We even have emails from the one neighbor stating that Midwest had dumped the debris onto "THE PROPERTY LINE MARKER" We contacted Midwest after realizing the problem and well before we received a final bill It was somewhat delayed as we found out around labor day weekend and it was a hectic time When Mr [redacted] came back out and talked to my wife, she simply asked that they push it back over onto our property and we would be happy He even admitted to her it was clearly on the two neighbors' property and he remembered her explaining the property lines because of the conversation she had with him detailing the issues we've had with the neighbor in the past She even said she didn't care about him reseeding the spots where the heavy machinery would tear up the recently planted grass seed (Mr [redacted] seemed concerned with pointing out that they'd have to reseed) She was shocked when Mr [redacted] said it would be $***-$ [redacted] just to push the debris back onto our property when it should have been put there in the first place; in other words to fix their mistake She said she would have to discuss it with me and then the following day, she sent an email to Midwest asking in writing to just fix their mistake and push the debris BACK TO OUR PROPERTY We never received a response to that, indicating to us that they were still refusing to fix their mistake unless they got more money to do what should have been done in the first place.At no point did ANYONE from Midwest come back to do any work, especially not rake any woods chip or move any debris That is a blatant, out right lie After reading their reply, it definitely appears to me that they were really just wanting that extra money to remove the debris, and were upset that we didn't agree to do that We were fine having the debris in the corner on our property Had Midwest simply agreed to come back out and move the debris, there would've never been any dispute at all (I wouldn't have cared about raking up wood chips and burning the heavy debris) I would have been more than happy to pay for the remainder of the balance owed, which would've negated me having to contact a separate contractor, and then eventually go through a lengthy and annoying dispute process with an obviously disreputable company Any company with the nerve to tell blatant lies they way they have is just that; disreputable We at no point received any word from Midwest that they would charge our card without our permission It was only after we received an email from the third party vendor that our credit card had been charged and it showed a copy of "MY SIGNATURE" that was clearly not mine, as I had never given permission for them to charge my card, that we knew Midwest had to decided to respond, and I was absolutely floored that Mr [redacted] had the audacity to sign my signature on a transaction Just because a company has a card number on file does NOT give them permission to charge whenever they want, especially when they had not even completed the work properly That, in a word, is FRAUD Regards, [redacted] ***
