Greetings, Following is the response to the complaint filed by Mr [redacted] I have also attached copies of the original contract and the final billing statement which were both paid in full by Mr [redacted] The deposit of $1,was paid to New Visions the week of The deposit was used to obtained the proper permits to complete the lath and plaster on Mister [redacted] HouseThe removal of the vinyl siding began on at which time we found there were issues with the evesSome of the issues were: double framing; split rafter tails and unpaintable plywoodMr [redacted] had us install two windows in the front of the house, and a rear doorThe house was lathed using the Total Wall Exterior Insulation Stucco One Coat SystemUpon completion of the lath the first inspection was called inAfter passing the inspection Mr [redacted] paid in full for the lath drawThe house was then brown coated, using Omega One Coat and washed plaster sand, at which time Mr [redacted] paid us in full for the brown coatThe condition of the eve’s were so poor that Mr [redacted] requested that they be plasteredWhen a quote to add them to the contract was given Mr [redacted] didn't want to pay the extra costWe agreed to do the extra work at no charge if he paid for the materials just to finish the project this was then added as an extra to the final billingExterior paint-able plywood purchased from Home Depot was applied on the eves as well as the incasing of some exposed wires from a previous room additionMr [redacted] then wanted more EPS foam shapes attached on the back of his home than the contract called forThis would have also been an extra charge to the contractMr [redacted] didn't feel he should have to pay for the extra foam because it went over his budget, but said that he needed it done to make the house look goodThis extra work was done for free in an effort to get the job done and stop Mr [redacted] from being so belligerentThe finish coat of Omega Exterior Acrylic Stucco was applied, and the final inspection was called forOnce the inspector passed the final inspection and signed everything off, Mr [redacted] refused to pay us until additional extra work that was not included on the contract was completedThe additional work included painting the EPS foam shapes a different color, finish painting some of his interior walls, and paint the rear doorAfter we did this too he finally paid us the balance due on the contractA few weeks later after the first rain, the paint started to bubble up on the plywood that had been purchased from Home DepotWe went out to Mr [redacted] ’s home to look at the plywood and saw where portions of the painted plywood was indeed bubblingOur intention at this time was to repair the pieces of wood that were bubbling however Mr [redacted] insisted we remove all the plywood and replace it with new woodWe agreed with his request and returned Approximately a week laterThe plywood was removed and new plywood purchasedThis time we decided to paint the plywood before installing itThe paint started to bubble on the wood again, which is not normalMr [redacted] was informed that the plywood needed to be returned to Home depot to find out what the problem wasMr [redacted] became belligerent and started cussing at us and saying we were the worst contractors he had ever seen and that we couldn’t even paint woodStating that one of the workers was the devil and that the real problem was the pet Mexicans we used as workersI tried to explain that it was warranty issues with the plywood not an installation problemWe had passed all the permit inspections and I also reminded him he was happy with the work that had been completed and that he had paid us in fullWe then returned to Home depot and talked to the mangerHe said it was the paint we used so we went to [redacted] Paint where the paint was originally purchased fromThey agreed to test the paint to see if it was a bad batch, they found no problems with their product, but they were willing to do whatever it took to help us solve Mr [redacted] s issueWe returned to home depot and spoke with the manager again to further research what could have caused this issue to occur twiceDuring this meeting, they said it might be oil from the processing of the lumber causing the paint to bubbleWe then let Mr [redacted] know that it was a warranty issue not an installation issue and that it would take another day or two to work out the detailsHe again became very belligerent and threateningStating he would rather sue us and get ten times the money than let us complete the workMr [redacted] order us off his premises immediatelyAs we tried to load up our tools he refused to allow us to do soWe called the police department but they said it was a civil matter and they couldn’t help usIt took two weeks before we were allowed to return a pick up the toolsLastly, my contract was for the lath and plaster of the outside of his home, which we did according to code, passed all the inspections, and had the job finalized and signed off by the county inspectorThe electrical problems on Mr [redacted] home has nothing to do with the work we completedHis electrical work was done by whomever he hired to do his room additionWe did put nail guards over some of the wires to protect them, and encased some of the others as required to pass inspections and the inspector passed all the workThe charge that Mr [redacted] is leveling against us, that all the work has to be redone is unfounded, because the work was inspected and passedI offered to return the $paid to us and still warranty the plywood installion which he declined using a few expletives, and again stated he would rather sue me for more money insteadRespectfully submitted [redacted] New I have to get more estimates because its the holidays every stucco company is booked outMy lawyer said I have to get estimates of what it takes to do demo new stucco and new gutterI have to wait for the county inspector to give me the paperwork tomorrowThis is the paperwork that says they didnt even do a preinspection and this is not ok with the countyThis pre inspection was very important to doing stucco and they skipped it to hide the faulty wiresThey covered up wires that are supposed to be in conduitTons of things are not up to codeNothing but problemsSo I cant sue until I have all the paperworkShould be in the next few daysIm trying my best to get through this its been so crazyThey have tried to shortcut every single step of thisThey have tried to buy the least expensive materials and they have had to replace everything many times

Mr [redacted] sent me an offer to have another company do the repairs for $3200.00, which I agreed to payThen he pulled the offerMr [redacted] still hasn't given me the ok to allow my workers on his property to do the repairs

After consultation with my attorney, speaking with the contractor that originally installed your gutters and looking at the California contractor’s responsibilities act, this is what I as the owner of New Visions am willing to do.First: We will upgrade your eves to a dens glass gold stucco systemThis consists of one layer of Dens Glass gold exterior ½ board with a medium, white, exterior acrylic sand float stucco finish over itThis is both highly water resistant and will not need to be painted.NOTE: Because your eves are not straight or even, the stucco will not be straight, it will follow the framing of your roofIf you want the soffits to be straight you will need to have a framer re-cut the tails so that they are straightThe reason we put the foam trim under your eves was to help take out the look of waviness due to the unevenness of the evesThe foam was used as an optical illusion to make them look straight, not to hide any imperfections.Secondly: We will pay a gutter company of our choice to install new gutters, after we have finished the stucco on the evesIf we do the gutters first, we could damage the new gutters when either nailing up the Dens Glass board onto the eves, or in the stucco processNOTE: As your E-mails and texts have related, you believe the gutters should be installed firstIf we do what you want, you will have to assume all the liability for the gutters, meaning, that if we damage the gutters in any way, we are not required to, and will not, have them repaired.Thirdly: If you agree to our terms before the work begins we will need you to remove any and all reviews you have posted on any and all web site and advertisers, as well as closing any and all complaints or charges against New Visons or ***n [redacted] from the CCLB, Revdex.com, Yelp, and Home AdvisorYou will also need to send a certified letter to ***n [redacted] /New Visions stating that after the work is completed you will not repost any reviews or remarks about ***n [redacted] or New Visions.I believe this offer will satisfy both parties and will make this a win-win situationI look forward to your response.Sincerely, [redacted] New Visions

He already told me they cant do the stucco under the eves because it would look terrible or we would have done this in the first placeAlso I have security cameras up and did before he took the jobThese cameras cant go on stucco they have to have woodHe knows this tooSecond my eves were fine before he came and the gutters were installed professionally before himNow hes saying I have to hire another contractor a framer to come fix his mistakesThey have had nothing but problems with this and wants to put it on a framer or anyone else but his company that caused the damageWe didnt need a framer before and we dont need one nowThird he says he will pay for new gutters because he caused the damage is this not him admitting he screwed up my placeHe has damaged everything he has worked on! I am rejecting this response because: First of all he just lied about everythingWe agreed before he started that it would be a custom job*** his foreman said himself he would make sure it had something custom so they came up with the coins ideaI said ok and half way through he only did corners saying that we didnt pay him for this so hes going to leave it like it isWe agreed that the eves would be done in wood and he said okI had nothing but problems the entire way through this buildAll the way through the build there was problemsHe fired or different people because they caused damage to my houseIm pretty sure that none of these people were on the booksThey would cause major damage and then get fired and then a new guy would finish and redo itThis happened all the timeHe would leave these spanish speaking people at my house by themselve for days on endNot watching over these people until I would complain about somethingBefore you know it I have to watch every singlwe thing they did because they were screwing up everythingMaking holes and huge cuts in my houseWe agreed to have a door and windows put inAfter I paid him he said oh were not going to do anything with the insideAgain trying to screw me over because they kept screwing everything up and having to redo everything or times now hes loosing money on my job and try to half as everythingIt started from super cheap materials to just forcing me to fight with him over itHe told me times that hes ready to leave and you can take me to courtThis is because I wasnt happy with any of the sub par work being doneMy wife was really upset that they were messing everything up so badThen they said they were going to put up wood and it was the cheapest wood you have ever seen I told them right then that this wont work its too thin and cheapHe yelled at me saying this is all you get or im leaving and you can take me to courtThen they finished the most half assed job ever and I just wanted them out of my life because its been over months on a week jobI run a business and its super busy so I just wanted them goneI payed every single time on time as soon as they askedFinally after week it rained at my houseAll of the wood they put up completely came apart and I have pictures of everythingI called them up and they got to my house saying its not there fault this happenedAfter fighting with them for days they finally came out to look at it and it was falling apart everywhere I saidAfter they took the wood down you could see the guttersThe gutters have been cut from a power tool and beat up everywher causing major damage and when it rained the water went right through the holes they caused and ruined the wood they put upThen I got in a major fight with his foreman *** who said they didnt do itHe swore they didnt do it because they said they had no power tools that would do thisAt that point I was so mad I kicked him off the job and told them to leave as I had to go out of town for an emergency*** asked to get his tool but I wasnt home so I made them wait until I got back in town and had them come get them right awayThey wont take responsabiltiy for the gutters and its very obvious they did itI had the roofers come out that installed them and they said a total replacement because theyre seemless gutters and they cant be patched*** kept telling me he will just put some caulk on it and it will be fineThe guys at the roofing company said that you cant put a patch on a seamless gutter and this would void my lifetime warrantyI told this to *** and he doesnt care he wouldnt even come out and look at itHe just sent *** to fight with me and purposly get kicked off the jobThey made me wait weeks with my house torn apart to come fight with me and say they didnt do any of the damageI had a brand new roof, Solar, and gutters put on before *** came outThese guys are the worst people I have ever met before in my lifeHe employs people from home depot because none of them spoke english at allI have pictures of everything and my house is torn apart right now after I paid this guy 15kPlease come out and I can show you all the damage that the other contractors said they caused

Run dont dare hire this company!!!!!! I have had nothing but problems from day 1. Everything we agreed to they half assed and bought the cheapest products ever! My whole place fell apart 1 week after they were done. They cut my gutters that were brand new and seamless and then says oh they didnt do it. Well who else did why would I take a powertool to my gutter. Its at the exact place were they tore down the roof. This company is so full of bs. Every word they said was a lie. They put up such cheap wood on the soffit that after the first rain it buckeld everywhere. None of the paint stuck to it. So after weeks of my house just sitting completely torn apart. They send someone out after its convenient for them. I already paid them so they dont care anymore at all. This guys word is crap. Now they come out today and said the paint wont stick to this new wood we got either and were just going to put some caulking on that huge cut on your gutters. I said no you have to replace the gutters because theyre under warranty. They said they didnt even make the cut and yelled at me. Now im so mad I cant even work. they have tried to halfass every single thing at my house. I just cant take anymore stress from these guys! Its a living nightmare. Do not use this company. I saw there good reviews on home advisore so I went with them and they were more expensive than any other bid so I said yes thinking it was because they were good. Wrong what a disappointment. It took months to complete a 3 week job and now my place is torn apart and I have to get a lawer and sue them. I have to file a complaint with the contractors board and this guy doesnt care at all. Hes laughing at me saying go for it. You have been warned. Shady work with these guys. I have lost so much money dealing with this company and years of stress I will never get back. They dont have a website or anything or a facebook just so they can screw people over. I have never had a worse experience with a company before in my 40 years of living.

After consultation with my attorney, speaking with the contractor that originally installed your gutters and looking at the California contractor’s responsibilities act, this is what I as the owner of New Visions am willing to do.First: We will upgrade your eves to a dens glass gold stucco system. This consists of one layer of Dens Glass gold exterior ½ board with a medium, white, exterior acrylic sand float stucco finish over it. This is both highly water resistant and will not need to be painted.NOTE: Because your eves are not straight or even, the stucco will not be straight, it will follow the framing of your roof. If you want the soffits to be straight you will need to have a framer re-cut the tails so that they are straight. The reason we put the foam trim under your eves was to help take out the look of waviness due to the unevenness of the eves. The foam was used as an optical illusion to make them look straight, not to hide any imperfections.Secondly: We will pay a gutter company of our choice to install new gutters, after we have finished the stucco on the eves. If we do the gutters first, we could damage the new gutters when either nailing up the Dens Glass board onto the eves, or in the stucco process. NOTE: As your E-mails and texts have related, you believe the gutters should be installed first. If we do what you want, you will have to assume all the liability for the gutters, meaning, that if we damage the gutters in any way, we are not required to, and will not, have them repaired.Thirdly: If you agree to our terms before the work begins we will need you to remove any and all reviews you have posted on any and all web site and advertisers, as well as closing any and all complaints or charges against New Visons or [redacted] from the CCLB, Revdex.com, Yelp, and Home Advisor. You will also need to send a certified letter to [redacted]/New Visions stating that after the work is completed you will not repost any reviews or remarks about [redacted] or New Visions.I believe this offer will satisfy both parties and will make this a win-win situation. Sincerely,[redacted] He's not trying to do anything to resolve this. I gave him a month to get it fixed then I gave him a 2 week deadline. He has no intention of getting this resolved. My house now has birds living in the attic because he tore the wood down covering the eves. Hes a terrible person who doesnt care about his word or quality of work. Im not happy with any of the work he did at my house and im stuck with it. Its a nightmare. He half assed every single thing on my house and it looks terrible. Im so over budget its insane. I want to have all the work he did taken down and redone by a professional company and I know this will never happen. He caused damage to the house that is not ok. This is the estimate just to fix the damage he caused. Even if he fixes the damage I will still have a half assed stucco job the has patches everywhere. Im so screwed its not even funny.

Mr [redacted] sent me an offer to have another company do the repairs for $3200.00, which I agreed to pay. Then he pulled the offer. Mr [redacted] still hasn't given me the ok to allow my workers on his property to do the repairs.
