Review: I purchase beverages, sodas and bottled water from this company on a regular basis. I discovered after serving diet ginger ale at a party that the ginger ale tasted foul and in fact had expired over a year ago. I then checked my most recent order of close to $601.33 on 10/** and $62.36 on 10/** and found that the diet cokes were two months from their expiration date. I am not in the habit of checking expiration dates on sodas as they have a long shelf life and I have not had expired ones. When my employee, [redacted] called the store, (she places all my orders) the gentleman told her she was lying and there was nothing wrong with the sodas and then hung up on her. I have been a long time customer and have spent $1730 in the last two years with them.Desired Settlement: I want all diet ginger ale purchased in the last year replaced as well as the small cans of diet coke.

Thank you for speaking with me this afternoon in connection with complaint ID [redacted] filed with your office by [redacted]. As you know, I am the sole owner and day to day manager of New York Beverage ("NYB") for over 18 years and take extreme pride in providing excellent customer service and quality products to all of my customers. I have reviewed the letter dated 7.*.14( received in the mail today 7.*.14 and first notice of this complaint) and wish to respond accordingly:

-Letters allegedly sent by the Revdex.com dated 10.*.13 and 11.*.13 were allegedly sent to an address not used by NYB since 2001. Thus NYB was improperly notified of this claim and I respectfully request that such improper notice not be held against me.

- [redacted] mentions that she has " purchase[d] beverages, sodas and bottled water from [NYB] on a regular basis." In fact, [redacted] has placed 25 orders with NYB since 2001.

- Soda, particularly diet soda has a shelf life of 90-180 days at best per the manufacturer depending on the artificial ingredient used (ie. aspartame). [redacted] by her own admission says she "doesn't read the expiration dates" on her inventory. My records show that [redacted] had placed an order on 5.**.13 for 3 cases of diet ginger ale cans with an approximate 5 month gap from her order in dispute on 10.**.2013 which was for 4 cases of diet ginger ale cans, 5 cases of diet coke cans and 3 cases of diet coke mini-cans, as well as other product. The order before that was on 12.**.12 which consisted of 5 cases of diet-ginger ale cans and 5 cases of diet coke cans. Again- a 5 month gap from her previous order. In my experience in the beverage industry, when customers order infrequently and in such large quantities, it is likely that [redacted] and her staff are not rotating and using the product in a timely fashion.

- NYB is a customer service oriented business and upon notice of a bad product will take back expired product within reason to accommodate and maintain the good will of our customers regardless of the customer's fault. However, in this instance NYB was never notified of [redacted]'s dissatisfaction until today. I would have been receptive to meeting [redacted]'s customer needs had she or her staff got in touch with me or a NYB team member directly. My staff and I are always courteous and polite to our customers and [redacted]'s claim that our staff "hung up on her staff" is suspect at best. Our team at NYB is highly trained in providing kind and courteous service to all. While we would have been willing to work with [redacted] to achieve ultimate customer satisfaction had she been in contact with me or my staff from the onset, we do not feel that her claims and accusations are justified.

-[redacted] must provide the facts and details pertaining how often she and her staff rotate products; who rotates the products and who oversees the rotation process;

-[redacted] must provide the fact and circumstances as to how she reads expiration dates/finds the expiration dates;

-[redacted] must provide cans of all products containing defective goods, including remaining product;

[redacted] must provide proof that the defective products actually came from NYB rather than any other deli, store, supermarket, etc.;

- [redacted] must provide details of individuals who had contact with the defective product.

I do in fact rotate my stock on a regular basis and only reorder when I am almost out of stock. My employee did in fact call the company and was responded to rudely and with no attempt to resolve the issue. This is the second time ever that I have contacted the Revdex.com, I do not do this frivolously. I am not on trial here and the fact that this company decides to respond to a complaint from last year until now only demonstrates how poorly run they are. By there own admission I placed 25 orders. In addition to that I placed orders from my company as well. This letter demanding information and making accusations only further demonstrates the attitude of this company. I am not attempting to return a diamond ring here. We are discussing soda. I stand by my complaint.
