Review: A deposit was given prior to the purchase of a car. Car was purchased and the deposit was not applied. Finance person rushed through the paperwork and I did not notice it until I got home. I called back right away to ask for the deposit back - was told it would occur that day or the next as soon as someone could run it - did not happen so I called again and was told no one could speak to me - went into the dealership and was told it would be done within the hour - 24 hours later and it is still not done.Desired Settlement: After seeing some reviews on this company it appears this is normal practice for them. - They should be fined for deceiving customers!

Review: My husband wanted to lease a Nissan Frontier and found one he liked at Thruway Nissan. On June **, he test drove the truck but he wasn't ready to complete the transaction on that day. The sales rep Thomas told my husband that if he left a $500 deposit on the truck, it would be held for him indefinitely. Thomas also said that if my husband decided not to lease the truck, the deposit would be immediately refunded to us. We signed a contract showing that the $500 deposit was for this specific truck and the contract included the VIN number. When my husband called Thomas on Friday July * to say that he wanted to move forward with the lease, Thomas told him that the dealership had transferred the truck elsewhere and that my husband wouldn't be able to lease it, even though we had signed a contract and left a deposit. We requested an immediate refund of the $500 deposit and Thomas said that it would be processed within a few days. When I received my credit card bill for the billing cycle ending on July **, 2015, the $500 credit had not been issued. I spoke to Thomas on the day that I received my credit card bill and was once again told that the credit would be issued immediately. When I called my credit card company on August **, 2015, I was told that the credit still had not been issued.Desired Settlement: I want the $500 credit immediately made to my [redacted] credit card. It is outrageous that we were coerced into giving the deposit based on false information (the signed contract and "guarantee" that the truck would be held for Ruark), and now we've been made to wait two months for something that should have happened within a few days. These people are liars and scammers. Do not buy or lease a car from this dealership!

Review: On August **, 2013 I purchased a used 2012 Nissan Versa at Newburgh Nissan in Newburgh, New York. I was about a month away from filing Chapter 7 Bankruptcy and I had to get into a cheaper vehicle before I turned my old vehicle, a 2010 Nissan Rogue in for repossession. I was in the middle of a divorce and I could no longer afford the large car payment. It's just me and my 3 year old daughter so I needed a reliable car with a low car payment. I explained my situation to the Customer Service Manager, [redacted] and I told her that I needed a vehicle ASAP. It did not have to be fancy, but I wanted my payments to be no more than $300.00 a month. My mother, [redacted] co-signed for me. [redacted] showed me the 2012 Versa which I test drove and it was fine. The vehicle was priced at $13,500. I put $500.00 down and when all was said and done, my final amount financed was a little over $17,000. When I inquired with the Business Manager, [redacted] when it was time to sign all of the documents about why the final purchase amount was so high, I was told that it was due to fees and interest because of my poor credit score. A few weeks ago, I was looking over my contract and I saw that I was charged $2000.00 for a warranty that I was led to believe was free and included with the certified used vehicle. Also, upon closer inspection of the fees that I was charged on my 2012 Certified Used Nissan Versa, there was also an additional amount of $400.00 for a NYS Tire Recycling Fee which is also outrageous as I did not trade in a vehicle so there were no tires to be recycled. If there were tires to be recycled, NYS charges a total of $2.50 per tire I believe so there is no way that fee is legit either. I am upset because I could have purchased a brand new car for the amount that I am paying for a car with no power windows or locks. When I inquired with [redacted] about the possibility of purchasing a brand new car, I was told that I would not be able to afford a new car. So, if a new Versa would have come to about the same price after taxes and fees, why would they put me into a used one without power locks or windows just to charge me an extra $2000.00? It is so hard sometimes when I have bags or when its dark or bad weather and I'm carrying my daughter to take time to unlock the door with a key or adjust the side view mirrors let alone panicking about the fear that I may have locked the keys inside of the car. Then on extremely foggy days, attempting to roll down the passenger side window before making a turn so that I can see better is not only a huge inconvenience but dangerous. Then, I have to drive with the window down until I come to a stop light before I can roll it back up. Newburgh Nissan was extremely dishonest and because they wanted additional money in their pockets, they gave me a sub-par vehicle and told me that it was the best that they could do. They acted as if they were concerned when in the end all they cared about were themselves. I just wanted to make you aware of the situation. On January **, 2014, I went back to Newburgh Nissan and filled out all of the appropriate paperwork to cancel the warranty so that I can have at least a little money credited back towards my loan as they have made it clear that the full $2000.00 will not be refunded. They told me that I will receive a prorated amount. I have not used any part of the warranty at all and I want the full $2000.00 refunded to my lienholder, Hudson Valley Federal Credit Union along with the $400.00 “NYS Tire Recycling Fee”. As soon as I can do so, I am trading in my Nissan Versa for a brand new car with power locks and windows but I definitely will not be purchasing it from there. My monthly car payment is $285.00 and I know that it could have been a lot cheaper if all of these extra fees had not been added on by Newburgh Nissan. This experience has really shown me that people will take advantage of you even in your lowest moments. I was so excited that I had been approved for a car loan at a time when I so needed it that I didn't stop and pay attention. In the end, it may be my fault. I should have read the fine print. What I do know is that I will never ever go back there again.When [redacted] sold me the car she was a sales consultant, now she’s been promoted to Customer Service manager. It seems that sneaky underhandedness at the customer’s expense gets you far at Newburgh Nissan.Desired Settlement: I am requesting a full refund of the $2000.00 for the warranty plus accrued interest as well as the $400.00 NYS tire recycling fee plus accrued interest to be sent to my lienholder, Hudson Valley Federal Credit Union and applied towards my current principal payoff amount of $16,635.00.

Review: I turned in a leased Nissan Murano and leased a brand new Nissan Rogue. Advertisements on Nissan Finance's website and at the dealership were that if I leased a New Nissan, I would NOT have to pay for excess mileage, excess wear and tear and any other fees associated with turning in a leased vehicle. I called Nissan Finance and told them I turned in my Nissan Murano for a brand new Nissan. They told me "no worries" we will take care of this with the dealership. I followed up my telephone call with the paperwork associated with leasing the new vehicle in place of the end of lease vehicle. A letter from Nishass Finance stated that as long as we leased a new vehicle additional charges would be taken care of by the dealership. After 60 days, Nissan Finance contacted me via letter indicating the I have to contact the dealer to settle this $2,090.00 balance. I am now stuck between the dealership and Nissan Finance over settling this bill. I was also told at the time of purchasing the new lease I would not be responsible for these excess charges because I am leasing a NEW Nissan.Desired Settlement: I would like the $2090 balance settle in my favor for misleading information by the dealership and Nissan Acceptance Corp.

On all websites, including Nissan Finance Company, statements to this effect appeared. I feel I was a victim of false advertising and sales tactics because one month after leasing the new Nissan Rogue and putting a cash down payment, I received a bill from Nissan Finance Company for wear and tear and mileage fees that the dealership did not pay. I am at risk of accruing bad credit because of the delay in payment from the dealership to the Nissan Financial. Review: I had 5000$ in equity in my Acura,I was 4500 ml under my lease terms and the truck was mint!!!!!My wife wanted a Pathfinder,when I went to Newburgh Nisan to work a deal I was told by the salesman Tony and the sales manager that That they could not honor the equity in the vehicle because they weren't going to buy the vehicle they were going to return it to Acura.Which was a flat out lie they bought the vehicle it is on there lot right now!!!!!!So basically they robbed me for 5000$ and I was a return customer!!!!!!!!!!Desired Settlement: Compensation of some kind!!!!!!

In response to the above mentioned claim for customer [redacted]; I have enclosed a copy of o\U' Payoff Verification Form showing the amount Newburgh Nissan paid to Acura Financial Services. I also have enclosed copies of the books that we use to appraise our vehicles and as you can see the payoff was within the range of the value.

Additionally, we invested more than $615.00 into the vehicle before we had to wholesale the unit as we were unable to retail it.

We stand by the numbers that were presented to the customer and no further compensation will be made.

Review: I purchased a used vehicle with approximately 82000 miles. 2000 miles later the transmission failed completely leaving me stranded in New Jersey. The repair on the vehicle is going to cost me $3600 plus the issue of having no transportation for a week. This vehicle was supposedly inspected thoroughly and somehow the service department did not identify the transmission problem.Desired Settlement: Newburgh Nissan should pay for the repair in full as well as reimburse me for the towing and the transportation needed for the week I had to wait for the vehicle to be repaired.

the option was made available for Mr. [redacted] to purchase an extended warranty for his vehicle, Mr. [redacted] declined. Per New York State Lemon Law his

vehicle was covered for 1 month or 1,000 miles from his delivery whichever comes first, he states in the complaint the problem occurred 09/**/13.

Several different repair attempts were made including incorrect diagnoses and failed repair attempts. The back ordered part is just another excuse, nothing was ever said to me about back ordered parts at the time. Additionally I was denied the service records when I asked for them. Many of the miles were put on the vehicle with repeated test drives during the month long service visit.

Review: I sold my 2009 Nissan Frontier on 10/**/13 & contacted Newburgh Nissan on 10/**/13 that I sold the vehicle & wanted to cancel the 7 year extended warranty I had purchased with the vehicle in 2009. [redacted] of Newburgh Nissan faxed me the necessary paperwork for me to complete & fax back to him which I did on 10/**/13. I waited 3 weeks & called [redacted] again leaving him a voicemail that I had not received my refund. I never received a call back. I also contacted Chad at Nissan USA & left a voicemail with no response. I called again on 10/**/13 & left [redacted] a voicemail to call me and again no response. I then sent an email directly to the GM of Newburgh Nissan, [redacted] stating my situation. Immediately [redacted] called me back after sending his boss the email & said it takes a full 4 weeks for a refund. On 11/**/13 I called & left [redacted] a voicemail telling him it had been 8 weeks now and still no refund. He did not call me back again. I emailed his boss again and finally got a response from [redacted] who said my $921.00 refund was going out in the mail the next day (11/**/13) and was being mailed. I confirmed my address with him. Now it is a week later and still no refund. I don't know what else to do at this point. I am not getting any satisfaction with Newburgh Nissan. They have my money and are refusing to refund me.Desired Settlement: I get my refund

Review: I was at the location on March [redacted], 2014 in search of a car. I sat down with the [redacted], his name is [redacted], who asked me to fill out a sheet. I told him I did not want to have my credit run as I was just browsing for cars. He told me they would not run it they just needed the information to get an idea for a payment. I then filled out the application and signed it. Immediately after signing it I realized that I did not want my signature on this form. I told him of my concern and he told me to just cross out my signature. I then crossed my signature out before ever giving the paper back to him.

A couple weeks later I check my credit report and notice a hard inquiry from them. I then contacted them and was told by the [redacted], that it was hard to see if the signature was crossed out or not. He told me I could come in and pick up a copy which I did. It is clearly crossed off and have prof. Also, they are stating that I crossed my signature out after they ran the credit. This is an itic statement because why would they hand me back a confidential document with my signature after they ran my credit? Why would he even bring that paper back to his desk? This document after it is signed and handed to the finance guy should then be locked up not floating around on his desk so it does not make sense that he would bring the document back to me. What he is saying is a lie because him and the finance guy are trying to cover their butts because they know they should be fired for what they did. I have contacted them multiple times since then and the GM or no one will return my calls.Desired Settlement: I would like to them to remove the inquiry from my account and I would like a written and phone call apology for the negligence of the [redacted], and the finance person. These two should be fired but that is not my choice.

Review: I traded in my vehicle and purchased a vehicle from Thruway Nissan dealer August *, 2015. The dealer was to pay off the vehicle that was used in the trade and the financing was done thru MHVFCU, a local credit union bank. As of today September *, 2015, NOTHING has been done to pay off my old loan or have my new loan processed. I opened accounts at the bank to have my loan automatically deducted for monthly payments. I called the dealer at least 16 times, leaving messages with no call back or speaking with the finance manager assistant who couldn't answer my questions. I have called the bank also numerous times with no answers either because the dealer had not submitted my loan paperwork. As of today, I have called them both again and it turns out that the dealer was missing a title transfer form that was not filed to the bank' new standard. My previous finance company has been calling me twice, sometimes 3 times a day for the past 11 days regarding my payment. I explain to them that I no longer have the vehicle they financed and that the dealer was to pay off that old loan. In 5 days, if I don't pay what is past due it will go to collections and be reported to my credit report. I was told to make the past due amount payment and have the dealer reimburse me.I was also told that I shouldn't have to make a payment if the dealer gets the funding to pay off the old loan within 5 days. I am on a fixed income being permanently disabled and cannot afford to make two separate car payments. I was assured time and time again not to worry about it, that it will be taken care of. Had I not called today the dealer and bank, the dealer would not have known what was missing to rectify this issue. Also, I added gap insurance to the vehicle contract 9 days later, and they cashed the check 22 days later. It was paid but funds were not available and I incurred a fee from my bank. Also I was told in order to get the loan, I had to purchase an extended warranty. Bank said not mandatory.Desired Settlement: I need this problem to be resolved expeditiously,and seek your assistance in making that happen. This company should be held accountable for the stress and worry they have caused so callously. I need reimbursement for any and all fees I have incurred because of their negligence. If this cannot be resolved in the 5 days I have been given by my old finance company, I wish to cancel contract and return vehicle. I cannot conduct any business with a company that is so irresponsible. please advise.
