My apologies for the delay in respondingWe, in the securities business, need to run all "complaints" into our Compliance Deptfor handlingThese have been cleared for me to respondThese complaints of Ms*** have already been addressed by our regulatory agencies, both FINRA and the SEC
First off, Ms*** was not a client of ours, but a beneficiary of a her father's, who was a client for a number of yearsWe have extensive e-mail history communicating with Ms*** to show diligent service and intent of handling her distributions, and she is factually incorrect on several issues:1) I did offer to assist her with rolling out her share of the IRA, and we even have documents showing we opened a shell accountHowever, we never funded it because she has a claim against the Trust portion of the estate, and I advised her to go elsewhere to roll over her proceeds intoI felt it was a conflict of interest and I didn't agree with her course of action. 2) I did not obstruct her in any way to obtain her share IRA proceeds...she came into our office and completed documents which my staff diligently processedI think she thought it was like going into a bank and filling out withdrawal slipIt doesn't work that way, and she actually obstructed it herself by contacting the money manager directly and putting a stop payment on one check she received to have them send anotherIt took much longer than it should.3) She has a claim against the estate and has hired an attorneyHer sister, Mrs***-***, is Successor Trustee for their father's estate, and they are apparently not on good speaking termsI believe her issue is that she is not getting the share of the estate that she feels she is entitled toI gave her my opinion in a e-mail that a lawsuit seemed to me to be ill-advised, but I stated clearly that I am NOT an attorneyOnly she and her lawyer can determine whether to move forward4) I refused to giver her copies of her father's IRA statements...that is correct as she is not entitled to themThey are private information, yet she contends her own privacy was violatedI don't see how I violate one (hers), yet she expects me to violate someone else's (father's)5)Finally, her sister, *** ***-***, should have been her first point of contactShe is Trustee, and also a beneficiary of the IRABut, there are issues between the sisters and they are not communicatingWe feel responsible to the Trustee
