To whom it may concern, Please find the attached files showing what happed at Mr [redacted] 's house To give you a short version, we were hired by another company to perform crane work at Mr [redacted] 's houseWe did our part and collected paymenta year and a half later Mr [redacted] contacted us directly to perform work at his homethe crew went out and did the contracted hours of workat the end of the hours he asked the foreman to do another hour of work, which they didwhen they were done and tried to collet payment, Mr [redacted] brought up that he thought he had some sort of creditthis was the first time he stated thatthe foreman happened to be the one who was on the original job site that was done for the other company and tried to explain to Mr [redacted] that he was under the wrong impression of how we do our crane rentalsthey could not come to an agreement and the foreman collected a check for $toward the $balanceWhen the crew got back to our shop the GM contacted Mr [redacted] to discuss and it was agreed that we would just have to take him to court to collect the balance dueWe attempted to bill him numerous times and got no responseWe filed a small claim against him for the balance of $plus court costsMr [redacted] has also tried to file with the Attorney General in regard to this matter and after reviewing his claim it was dismissedI have attached all contracts, court papers and the claim he filed with the AG [redacted] Office Manager Newcomb's Tree Service [redacted]

Attached is a copy of the invoice I received from Newcomb tree serviceAs I have stated the invoice calls for the use of plastic mats not plywoodThe original contact states the cost of these mats is $ 200.00, which I have deducted from the payment I have given themI had asked at the time these services were rendered to speak to an owner to resolve this issueThis request was made to both *** *** and *** ***. This was the last bill I had received from them and my request for a call from an owner to resolve this matter was not returned

To whom it may concern,We did provide service to Mrs***. Her contract did include an additional charge for ground cover. We have different types that we use, is large heavy duty plastic sheets and the other is plywood. The day that Mrs***'s service was done the
truck had plywood on it. The crew laid the plywood to protect extensive damage to the lawn. This service is not included in our pricing and we charge extra for it because it takes time for the crew to lay it down. When the work is complete the crew rakes and leaf blows the entire work area. We get lots of compliments from multiple customers on how well our crew cleans up. When the work was complete the crew did not collect a check. When we did receive the check it was short $200. Mrs*** stated she wasn't going to pay the fee for the ground cover because we didn't use the mats and we used plywood instead. When it was explained to her that we have cranes and depending on which one comes out would decide which ground cover was used she said she didn't care that she was told it would be mats. The plywood is used to protect her property. If they had simply not laid anything down she would have been left with ruts and torn grass. We offer the additional service so that the crew can provide the best possible protection against damage to the lawn. The trucks are about 60,000lbs and when driven onto grass can sink in and cause rutsThe plywood or mats reduce the damage by not letting the tires sink into the soil. As to the statement that there were splinters left I don't see how this is possible. The crew does a great job in raking and leaf blowing so if anything was left it would have been cleaned up before they left. We provide mats and plywood on countless jobs and I have never once, other than Mrs***, ever heard of splinters being left behind. I believe the reason for this complaint is because after billing the customer multiple times we were unable to collect payment and we filed suit against them in small claims court*** ***Office Manger Newcomb's Tree

The owner is not a part of the day to day operationsThat is why *** *** the GM is here. *** is here to handle complaints and the day to day operations. *** has spo*** to Mrs*** on a couple occasions and no resolution was able to be made. We cannot deduct the fee for a service that was rendered. If a service was not given we would not charge for it. After trying to collect for over a year we had no choice but to file a court claim in small claims at Plymouth District court. The argument is that we used plywood and not the mats. We feel we completed the work as outlined in the contract and expected to be paid for the services rendered. I do not see that we will ever be able to come to an agreement with Mrs***. She cannot see past the wood and plastic which there is no difference in, there is no difference between using the plastic mats or the plywood. To us who do the work every day, ground cover is ground cover. *** ***Office Manager?
