Dear **& [redacted] ***, We truly apologize for any inconveniences you may have gone through To clarify: we started construction of your home on 6-18-at [redacted] *** Due to a series of circumstances, some outside our control (like the weather), the construction of your home has taken longer than normal It is to our advantage for production to go as fast as possible; however, quality and workmanship are far more important and will never be compromised for quicker production Sometimes, we have to move backwards a step or two to make sure things are up to our standards before we can proceed This may appear as other homes are getting more attention but this is far from the truthWe offer a product that is unique and sometimes things arise that may delay the product Rather than knowingly continuing and possibly having problems later, we will always choose to get it right and then move forwardWe hope this will help in understanding our mind set and we can retain you as a customer We will gladly proceed with refunding all of your deposit and canceling your contract if that is your wishPlease advise your sales person in writing Also, as this is now documented with the Revdex.com, all further communications with us shall be in writingSincerely, Newleaf Homes

I am rejecting this response because:Correct Timeline is listed below:Contract signed for Winter Cherry: 7 July 2015 (we were
asked to move lots 11 October – original estimated completion date was
December, but construction had not started in October )
[redacted] suggested we move lots: 11 October 2015 (construction
had not yet started, [redacted] said February was our new completion date)
Loan Prequalification letter expired: 23 November 2015
Construction Begins on Begonia Rock: December 2015
New completion date on Begonia Rock:  February 2016
Actual completion: April 2016
Your timeline is incorrect. 
We signed the contract on 7 July 2015 and were told construction would
be complete in December.  We were asked
to move lots by [redacted] in October (because the Winter Cherry lot was next to a “convict”)
and the house did not start construction until December, but [redacted] assured us
the home would be complete by the birth of our son on 4 February.  Construction had not even started in October
when we were asked to move, so the December completion date would have been
impossible to meet. 
The inconsistencies on dates show the lack of true
understanding of our situation.  The home
was supposed to be complete in December on Winter Cherry as told to us by
[redacted].  She moved the estimated
completion date to February after we moved lots to Begonia Rock.  The home was completed in April (almost May).  Our old lot (on Winter Cherry) had a home
completed before our home on the new lot (Begonia Rock).  We feel we were asked to move lots so the
other home (on Winter Cherry) could be completed on our previous lot before
ours on the new lot (Begonia Rock).
[redacted] was not honest with completion dates.  If we knew the home would not be completed
until after February we would not have bought a home with New Leaf because our
son was due in February. 
The timeline was not told to us in good faith.  [redacted] told us our home would be complete by
December; however, it did not even start until December.  We moved lots in October and were told in
October that the home would be done by February.  It was not complete until the end of April
(3.5 months after we were told that it would be complete). 
[redacted] knew our situation with renting a 3rd
floor apartment with a newborn, but would never give a straight answer on our
completion date until after we submitted a letter of concern.  The builder and [redacted] truly did not concern themselves
with our difficult situation due to the home delay that was caused by them.
We request the earnest
money back and upgrade fees since we are not buying the home and the home delay
has cost us thousands of dollars in rent in a three bedroom apartment over the
total 3.5 months in delays.  These delays
have also caused hardship since we never intended to have a baby in our current
third floor apartment, especially three months post-birth.  Recovery for the mother has been difficult
hauling a baby upstairs.  We have had to hire a doula to help with obtaining
groceries weekly.  We understand that
delays can occur in construction, but there has been no event that would
justify 3.5 months of delays for the building of a single family residence.
From the time we signed the contract to our final decision
we were avoided and told different, delayed completion times by [redacted].  We never got a straight answer and had to
drive out to the site to follow up with [redacted] because she would not return
phone calls, emails, or text messages. 
The construction and quality of the home were not in
accordance with the design center upgrades on our contract.  We followed up the following week and have
pictures of the missing extra shower head and also cabinets instead of a tub
sink in the laundry room as we paid for. 
We told [redacted] twice and she assured us the upgrades would be included,
but they never were.  If something as small
as a tub sink and extra showerhead were overlooked, the other upgrades (which
we already paid for) would have been shirked as well.
We can provide photos
of the home's poor construction indicative of a larger problem with delays and
lack of quality control and oversight.

Not sure what else we can offer, our employees are very capable and have the authority to do what is necessary to resolve all issues.  We are here to help! Below is the response from our HVAC company:[redacted]We have bent over backwards for this home buyer.  There are two ladies that occupy this home.   We seem to be able to satisfy one but not the other.The AC system is working properly and to specs.  We are the solution, not the problem.   [redacted] 2 Sides to every story!

I am rejecting this response because:The builder New Leaf did not act in good faith in building the home.  When we signed the contract in July, they told us the home would be done in December.  In November, they still had not started. I was prequalified in October for a home loan expecting the home to be done in December.  In December, we were offered a new lot at 11206 Begonia Rock (because as we were told by [redacted], this would be a more desirable location since the Winter Cherry lot was next to where a “convict” lived) and we were told it would be completed by February, in time for the arrival of our son.  In February, the home was not complete and we were told our date would be end of March. Later, this date was pushed to 15 April, then again to 18 April.  Since then, we decided not to buy the home.Because we were worried about the completion date of the home, we called New Leaf ([redacted]) after the birth of our son from the hospital to see the status of our home.  We called twice and never were called back.  First the poor follow-up led to a letter of concern to [redacted], but nothing was done in response to the letter.  At the time, we didn’t know our home was still months away from being complete.Second, once we knew our home would not be complete by March or even the beginning of April we began checking status of the home construction, we notified New Leaf ([redacted]) the upgrades we already paid for were missing from the home under construction. After checking the home again a week later, tiles were installed without many of the upgrades we had paid for at the contractor’s design center.  Generally the construction quality was poor with daylight visible from inside the home attic and birds living there, poor insulation, and damaged finishes.  If these kinds of mistakes are noticed in roughly 30 minute weekly walkthroughs and then not acted upon, it brings into serious question what kind of quality control is actually occurring, not to mention what may be wrong with the house that isn’t readily visible.  The builder should build with plans in hand and not expect the customer to verify that the home is being built to specifications.  Finally, the lot we originally selected at Winter Cherry already has a home complete on it, while the Begonia Rock home is still weeks away from completion.
