I am rejecting this response because: MrN*** did not address the issue of making his clients sign an uncompleted contract missing allowances and specs before collecting his $5kAlso, the contract states the $5k would be retained "toward the final payment due under this Agreement"Well there was no final product delivered so one would assume that the $5k should be returnedMrN*** also stated that he gave me three options, one including to" cut budgeted allowances to stay within budget". This option was never discussed and the option I have proof of is a budget of $324k, which again is $39k over the signed contract priceMrN*** also did not address the issue of continuing to move forward with "his own soils engineer" and charge me $3,for a foundation layout that included piers even though he knew from the very beginning that we would not move forward with piersHe also quoted this foundation layout to be "between $1k-$2k". I asked MrN*** for these "soils samples" and he said I would have to pay additional money (over $1,000) to give to an expert to reviewBy this time, I was sick of giving MrN*** money and getting NOTHING in return

licensed structural engineer.  His/her design is exactly what we follow every time.  If we have a second opinion we always go with the safer method.  When the structural drawings came back and there was added cost for piers I gave my client the following options.  A) Keep budgeted allowances for finishes as is and pay added cost for the additional foundation support. B) Cut budgeted allowances for finishes to stay within budget.  C) Work together to find a new lot that would not require piers under the foundation.  Through more research I also found out that the geo-report that Mr. [redacted] supplied to me was no longer accepted by the City of Billings.  This was due to failing recommendations by the soils engineer.  I then hired my own soils engineer to go out to Mr. [redacted]'s lot and take soil samples.  This was at no charge to Mr. [redacted].  His recommendation was right in line with the way the structural engineer designed the foundation.  All business owners do things in their own way.  I do not design a home, spend days collecting bids, putting a city permit package together for free.  Once the deposit is collected the spot is held and the design process begins.  Once I found out that the original geo-report was no longer accepted by the city [redacted] contacted his realtor to pursue getting his money back on the lot.  I assisted with that process in anyway he asked.  After he didn't get anywhere with the developer and talking to multiple attorneys the project was at a standstill.  Months later he texted me about windows I was going to sell him.  He asked if he could have the windows because he felt I owed him 5K.  He then asked me to build him a fence when I told him I couldn't sell the windows at this point let alone give them to him.  I again explained what the 5k covered when the contract was signed.  I got no response from Mr. [redacted] until I received this complaint.  I put contracts in place to protect both parties for this very reason.  Mr. [redacted] agreed to the terms and was treated with fairly and with respect.
