We started work on *** ***'s basement project in Feb , a deposit was given and a contract was signed by Newman's Home Improvement LLC. I completed any demo that was needed, all the rough framing is complete, all the rough plumbing is complete - including ground rough and all the
rough electric is completeWe moved the basement steps and extended her kitchen wall after moving the basement steps and installed a person garage door. The heating and cooling vents have not been installed at this time and is the only portion of the rough work not completedShe made mention that over half of the rough is yet to be completed, this is completely false, all rough work is complete to this point according to the contractShe also made mention that not all materials were purchased, this is also false, all materials including all lumber, garage man door, door knob, all electric material including wire, outlets, recessed can lights, junction boxes, all plumbing PVC, all water lines etchave been purchased and installed as per the contract. Any material not yet purchased that was not due to be installed yet like drywall and insulation was the next phase of this project as per the contract, these items have not been purchased due the circumstance which I find myself in. My contract with the customer states that once the rough work is complete, there will be a second payment due. As we got closer to the rough being complete I informed the customer that the second payment was coming dueShe said, "no problem, I have to go to the east coast on business which will pay me a bonus which will in turn will pay you (me) the second payment."As it turned out, it didn't go well for her on her visit to the east coast and she was unable to get her bonus. After she returned from the east coast she was hard to get a hold of and didn't respond to text messages right away or even waiting a little while to get back to me , so naturally, I began to worry about getting paid, so we slowed the work down at this point. At this point all the rough work was complete and ready for inspection, except the heating/ cooling vents and sump pump pit she wanted to add. I was nervous to keep moving because her money situation was clearly up in the air. Obviously, I have subcontractors to pay, myself to pay, materials to buy and I can't be left holding the bag on all these things. As time went on, I communicated with her through email and text, never once saying that I wanted off the job or that I was never coming back - matter of fact, just the opposite - which I have documentation of all of these emails clearly stating that I have every intention of getting back there asap once her situation is taken care ofShe came clean as to what was really going on and said to me she understood if I wanted to put the job on hold until she received the rest of the money - this is what she said to me - I also can provide a copy of this email as well. So I waited to hear from her, I finally did, she was able to come up with some of the second payment, so we waited until she got the rest of the second paymentOnce she did, we began to schedule coming back. We were communicating through email; she asked when we were coming back. I told her Wednesday or Thursday to deliver materials and get heating / cooling vents in and dig sump pump pit. But I was still nervous, because there was no guarantee she would have the money to pay me at the end or as went forward because there were still remaining payments to made as other work was being completed - these payments were not due yet - which would be total in the end; plus she still had to purchase all of her flooring, vanities, faucets - all of her cosmetic items. If she didn't have these items, then I couldn't finish the job at all and would cause even further delays.So somewhere along the line, it came up in conversation about her ability to pay moving forward, and one thing lead to another, she got upset - all the while I had my heating and cooling guys and plumber ready to get back in there. I tried through email, text and voicemail to let her know that they were scheduled to be there the next day and that I just needed to hear from her so they could be let in and we could continue. She never responded at allBecause things had escalated and communication had broken down, I offered her choices in moving forward with her project; once again, no responseI have email documentation of thisEven though I was very nervous about moving forward because of her very uncertain money situation I was prepared to do soAt this point, since this complaint has been filed and she has slandered my business on Google, I want to be clear that once I received notice that she had made a negative review on google and then the complaint to the Revdex.com that I was waiting to hear from her on the options that I gave her, up until this point I had waited to hear from her which she did not respond at allI was hoping we could have continued on the project. I have made arrangements to pull my name off the building permit with StCharles County as of 4/13/I have asked StCharles County to have the work that we have done this far to be inspectedThis inspection is scheduled for next week
