Good afternoon,
In response to the complaint that Mr. Williams filed, our Sales Manager will be reaching out directly to the customer to address their concerns.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.There is no way that any structure builded in my back yard makes any difference from the amount of water coming from my neighbor's and golf course. The drains placed by Newmark can not handle the water coming in; The berm placed outside also did not resolve the issue. if anything done by Newmark would work, there is no reason for me to be making this complaint.The lot where my home was builded was the draining point for this area, I do not think Newmark took this in consideration, my home and backyard were not builded to handle this amount of water. Newmark has not proven me with any professional or technical report that I do not have a problem, just relying on their opinion. They also told me that water would never come into my home, but their "never" came a few weeks ago. I am highly concerned that on a next heavy rain, water will not only get into my back porch, but inside my home also.Please find attached videos and pictures from the last heavy rain, looking at them, do they look normal to you? I have several pictures, emails, videos, from 2014 up to date, in addition to my neighbor's that have told Newmark they had an issue with this home getting flooded when it was builded in 2013.I have not agreed not signed any agreement that my problem has been resolved.Newmark did not have any permission to come in to my home and take pictures of my backyard (pictures they attached on their response back) what type of Company is Newmark?   Regards,

Our construction manager and our customer service representative met with the buyer Tuesday. 1. Rug insert tile at entry – poor quality of install.
a. Agreed to remove rug insert and have it re-done completely.
2. Un-even grout lines in wall tile in both front right side showers.
a. Agreed to remove both shower walls and have tile and insert re-done completely.
3. Stain fading on grout in entry and utility areas.
a. Once rug insert is complete, we will stain all grout lines in the entry and utility areas.
4. Drainage on left rear side yard.
a. Drain will be added to existing drain. Will tie in gutter down spout to drain as well.
b. Note. Neighbor is overwatering and could be causing yard to stay soft.
Buyer stated that these were the only issues he wanted addressed. He stated all other items from his complaint had been taken care of.

In response to the complaint from Mr. [redacted] to the Revdex.com regarding alleged drainage issues in the backyard of [redacted], Newmark Homes has made numerous efforts to appease Mr. [redacted] with the water issues that he has in his backyard.  In March 2015 there was an original...

complaint filed with the Revdex.com and request for arbitration with our warranty company, [redacted].  Newmark went above and beyond our normal practice; installing drains, catch basins, re grading of the swale designed to carry runoff around the house and tied in an 8” drain line directly to the storm sewer at the street.  Additionally Newmark worked with the developer and golf course owner behind Mr. [redacted] property to re direct some of the water that overflows the golf course during heavy rain events.  Newmark doesn’t control, nor can be responsible for water coming from the golf course.  After these changes were installed Mr. [redacted] signed off on our improvements and did not choose to proceed with arbitration. The Houston area, in particular south of [redacted], has had at least 3 “100 year” storm events in the past 18 months.  During and directly after heavy rain events there should be an expectation of ponding or standing water in the yard.  This is described in our “performance standards” section of the HOME BUILDER’S LIMITED WARRANTY. (b) The homeowner shall maintain the drainage pattern and protect the grading contours from erosion, blockage, over-saturation or any other changes. The possibility of standing water, not immediately adjacent to the foundation but in the yard, after prolonged or an unusually heavy rainfall event should be anticipated by the homeowner. Newmark Homes has inspected Mr. [redacted] lot on occasion directly after heavy rain events.  Specifically on March 10, 2016 Newmark inspected and videoed the lot after a 4-6” rain event on March 9, 2016.  There was tremendous saturation and washout, but no standing water during the morning hours of March 10, 2016.  Newmark is happy to supply this video to the Revdex.com. Additionally, during recent inspections of Mr. [redacted] yard it was noted that structures, landscape beds and patios have been erected by Mr. [redacted] in and adjacent to the drainage swale.  This will and has greatly impacted the way the lot was designed to drain.  See attached pictures.  The swale and drainage improvements that have been installed by Newmark Homes must be maintained and kept free of blockage to work in the intended manor. Newmark Homes has tried to work with Mr. [redacted] for better than 2 years, but does not believe that there is a “warrantable” issue and if there is additional water being directed to his lot it is likely coming from the golf course.

 I accept the response however, this is a note.  It was stated our neighbor was watering to much, the area of our flooded back yard is approx. twenty feet away from the area of interest.

Newmark Homes has decided to help assist the homeowner and the developer as a courtesy.  We will be cutting the grade on the left and right sides of the yard to allow water to pass without going through a drain system.
