There were two agents involved with this transaction: one being the listing agent who represented the Landlord and the other was the leasing agent working with the couple It appears that there was a lack of communication between the two agents and the renters It is the responsibility of the Landlord to provide a clean apartment, however, not the agentsThe leasing agent, mentioned in this complaint, did his part in finding them an apartment The listing agent was the one who needed to follow through with the walk through, condition statement and keys Their manager apologizes as he thought a check for cleaning the apartment had already been sent Please let the Tenants know we will send them $they can put towards any cleaning expenses they incurred The management at Centre Realty Group apologizes for the lack of communication on many levelsWe strive to make move in days as stress free as possible It is clear we should have done better in this case

Broker repeats its original response, as though fully and separately set forth here Broker, who was merely the agent of the Owner, justifiably relied on the truth of Owner's description, and acted honestly throughout this matter In any event, the Buyer has expressly acknowledged that she did not rely on the MLS in completing the transaction, but rather relied on her own home inspector who is the person she chose to ensure that property was acceptable to her, as is clearly stated in the Purchase and Sales Agreement Buyer incorrectly looks to make the Broker a scapegoat; if there is a problem, she should look to the Seller or the inspector who guided her and upon whose work she did in fact rely - Thank you, [redacted] ***

The MLS listing merely repeated what Owner told CRG Broker was only the agent for the Owner, who simply relayed the information reported by Seller Broker justifiably relied on the truth of Owner's description, and acted honestly throughout this matter In any event, Buyer did not rely on MLS listing in completing her purchase For one thing, the Buyer had her own home inspector, as she acknowledges, and had full opportunity to investigate the condition of the premises in every respect Additionally, the P&S expressly states at Paragraph 34: "BUYER represents and agrees that BUYER has been provided with ample opportunity to conduct any and all inspections of the Premises desired by BUYER including, without limitation,...utility systems..., and that BUYER is fully satisfied with the results of the same, the condition of the Premises, and accepts the premises "AS IS"...and is not relying on any representations of the Seller or Seller's agents regarding the Premises (structural or otherwise), including, without limitation, as to the character, quality, use, value, quantity or condition of the premises....Any statements which may have previously been made...are specifically hereby voided and superseded by this AgreementThe provisions of this paragraph shall survive the closing and delivery of the Deed." Buyer takes Broker's words out of context, and is merely trying to make the Broker a scapegoat; if there is a problem, she should look to the Seller or the inspector who guided her and upon whose work she did in fact rely - Thank you, [redacted] Director of Sales Centre Realty Group
