Review: NYSEO constructed a website for my Orthodontic practice, which misrepresents me professionally, has made false claims in regard to the scope of my practice, and ascribes credentials to me which I do not possess. I complied with NYSEO requirements to furnish

my CV, background, and professional services offered and all other relevant facts, and descriptions. Despite my numerous edits (emails, dropboxed corrections & phone calls from 2/*/2014 through 5/*/2014) the website content was not changed. NYSEO failed to respond to my emails in May; it was only after I withdrew my payments of over $11,500 that she contacted me on 5/**/14. Such fraudulent misrepresentation, gross inaccuracies about patient treatment, misleading the public as to expectations are not my way of conducting business. NewYorkSEO created a liability for me and my practice. Local, state, national professional organizations & governmental parameters can hold me responsible for unethical/fraudulent advertising. NYSEO did the following despite my written and verbal protests: 1. changed the name of my business on the website 2. misrepresented me as a myofunctional therapist, practicing surgery 3. descriptions of orthodontic treatment modalities was a complete fabrication 4. claimed that I completed two sub-specialty residencies, aside from orthodontics 5. incorrectly listed educational institutions attended 6. made claim to procedures that I do not perform and techniques that I do not use. 6. sentences rambled on without attention to grammar which gives a terrible impression to prospective patients. The practice received two calls from the website, only, requesting myofunctional therapeutic services. I requested that the website be removed, as it puts me and my practice in a very negative light and leaves me vulnerable to repercussions. NYSEO will not remove the website now as they are no longer being paid and will do nothing further.Desired Settlement: To disassociate me and my practice from the website and from NYSEO; not be responsible for any monetary obligations, and all money paid be refunded.

At this time, I have been contacted directly by NewYorkSEO, LLC regarding complaint ID [redacted], however my complaint has NOT been resolved because:

[Your Answer Here] In their email response NYSEO does not take responsibility for the outcome of their work; they maintain that my edits were sent to them in the wrong format and on one occasion that I sent them a nearly empty file. I did send them an early and a recent (May) edit in which all the incorrect and untruthful material was edited out; hence the file contained a few lines only. I followed with an explanation that most of the substance she put into the website MUST be deleted as it was sloppy, overly repetitive and without truthful information.I spent several hours trying to correct their mistakes and rewrite the misinformation, but it encompassed the entire website. I also sent them my rewrite of all the substantive material both via email and Dropbox in word.docx as they required. From early February until early May I sent and resent corrections, edits and rewrites, none of which were incorporated into the website. As I am not very computer savvy I did make a mistake early on when I scanned before and after photos of past patients into dropbox files. [redacted] finally asked that I bring them to her in a flash drive as my dropbox files were apparently very time consuming to open. I complied with all of her requests but almost nothing that I provided was incorporated into the webste. There were also a few phone conversations during which I expressed my concerns in regard to using a different business name than that registered with the Secretary of State, not using any of the material I provided and creating her own "facts" about orthodontic treatment. I also cautioned her by phone and via email that she could not call me a surgeon nor a myofunctional therapist. I do not have such credentials as she claimed on the website. [redacted] wrote that I approved the website. I DID NOT and I have saved emails, edit files, etc in my support.

I asked them to disassociate me from the website or to remove it from any web visibility as the fraudulent credentials that she ascribed to me, misleading advertising claims and blatant misinformation makes me vulnerable to scrutiny and repercussion from professional associations and other state consumer or advertising boards. She refused to remove the website & said that it would remain exactly as is since they are no longer being paid (I so far paid just under $12,000 between February and May,2014.); they own the website. I can not understand why [redacted] failed to acknowledge and use my not-infrequent input and frank emails criticizing the website. She had promised to "exceed my expectations" during our first meeting. I am at a loss without a websiite that I can use and market in order to buildup my fledgeling orthodontic practice. The American Assoc of Orthodontists' legal counsel advised that I have a good case against NYSEO with the liability incurred due to inattention to my feedback. I do not want to pursue a civil suit and hope that NYSEO will understand that they have done me a significantt disservice and followed through with nothing that was promised.
