To Whom It May Concern:First, we would like to apologize for the delayed responseIt appears as though the message received this morning was the second message, of attempts to contact our company, however, this is the first message to which we have actually seenAttached is an email sent to Mr [redacted] on December 9th, one day after this complaint was submittedThe email provides a link to a YouTube video for our move out inspectionThe email also includes a couple of attachments such as a refund letter itemizing the breakdown of any charges, copies of invoices (please note, tenant was not charged for entire invoice, only what would fall outside of "wear & tear"), as well as copy of the tenant's ledgerPhotos prior to moare available upon requestThe file became to large to uploadMr [redacted] was the first tenant that we placed in this housePrior to renting to Mr [redacted] the house was professionally cleaned and painted as wellIt was referenced in the complaint that the house was not cleaned, and that painting request were deniedAlthough I cannot recall those request, I can confidently state that the house was cleaned and a vast majority of the house was painted as wellAttached you will also find invoices for the painting and cleaning prior to Mr [redacted] moving into the houseI would like to conclude by addressing the two points made about the timeliness of the return of the deposit, as well as the allegations of our company wrongfully withholding funds, as well as the assumption that NGB has done this multiple times in the pastNGB takes these allegations very seriously, and as you can see from the attached documentation, our company strives for full transparency, as well as honesty, and integrityWe also keep very accurate recordsAs to the timeliness, NYS says that landlords are awarded a "reasonable amount of time" to return a tenant's depositThe claim that Mr [redacted] had to follow up with our company for three months to receive a refund is falseMr***’s lease expired at the end of September The time of the original complaint with the Revdex.com was December 8, 2016, so within that time window (Oct – Dec 7) of Mr***’s lease expiring and the complaint with the Revdex.com, the tenant had already received his deposit, as well exchanged back and forth communication with our companyNew York State says that landlords are awarded a “reasonable amount of time” to return a tenant’s depositOur business practice is to send out all refunds 30-days from the tenant’s lease expiring, which is acceptable per NYS lawSince starting business in 2011, we have turned over several hundred apartmentsI estimate that at least 95% of those turnovers require a professional cleaning after move-out, as well as some minor maintenance to handle repairs outside of “wear and tear”.Our company policy states that all deposits are to be held by our property owners, NOT NGBThis policy is in place so that we don’t get accused of stealing or wrongfully withholding a tenant’s depositUltimately, the owner is holding those funds and ultimately makes the final decision as to what charges should go against the tenant’s depositSincerely, Jerid [redacted] , Co-Owner, NGB

We try to maintain a strong, professional relationship with all of our rental owners and tenantsOur business reputation in the capital district is something that we take extremely seriously, and we would be more than willing to provide multiple references and testimonies from existing tenants and rental owners with respect to their experience with NGB Property ManagementThis particular tenant moved out of the property which he resided in at the end of June New York law states that a landlord must return the tenant's security deposit within a "reasonable" amount of time after the tenant has vacated the property and surrendered their keysA "reasonable" amount of time would need to be defined by a small claims court but generally refers to a 21-day windowNGB has been in communication with Mr [redacted] many times since he vacated the apartment (Approx days ago)At no time did our company communicate to Mr [redacted] that he would not be receiving his depositIn fact, it was communicated that we are in the process of reviewing his file and once we have completed that process we will be notifying the appropriate parties to mail a checkIt is our understanding that Mr [redacted] is disappointed in the amount of time (approx days today) it has taken him to receive his deposit, but please know that this is a very busy time for us and will be working through his file in the very near future.If the Revdex.com needs any additional information regarding this claim please don't hesitate to contact us.~NGB Property Management
