The response from the business is a lie. The owner never offered to honor the card. In fact, his final stance on the matter was that we were just out of luck and that he couldn't do anything for us since the gift card had a zero balance. The following quote from the owner is a lie, "She told me that she talked to the gift card people and was told that the funds were reversed back to her card."

The response from the business is unsatisfactory. I have proof that I purchased the gift card, including the initial balance. According to California law, the business may not decline a gift card that does not have an expiration date. I request a refund of my initial amount.

Review: I purchased a gift card from Nhu Y 8 Courses of Fish restaurant on 01/2009 containing a value of $30 dollars. I forgot about it for a while and recently (10/2014) tried to redeem it at the restaurant. At the time of purchase, I asked if the card had an expiration date and was informed that it does not expire. When I tried to redeem it on 10/2014 for food (I sent my daughter), the owner told her that it had no value and they would not accept it, nor did they offer a refund. She did not want to argue at the time and ended up paying for the food with cash. After that, I made a visit to the restaurant and spoke with the owner, first, and then his wife several times, in an exchange where they gave me the run-around. The owners basically told me "tough luck," argued with me, and told me that was the way he does business. If the card says it has a zero balance, then there was nothing he could do for me. He even insinuated that I could be trying to scam him, for all he knew. Luckily I had the original receipt to prove that I am the owner of the gift card but he was still not convinced to change his mind. After repeated visits to their business to try and resolve the issue, I was very rudely informed that they would not honor my gift card in any form, nor would they offer a refund. I happen to know that California law states that it is illegal to refuse services (or goods) to the owner of a legitimate gift certificate. California Civil Code [redacted] governs disclosures regarding expiration dates on gift cards. The gift card for Nhu Y 8 Courses of Fish restaurant contains no expiration information printed on either side. I know it is illegal for them to refuse accepting my redemption of the card for their goods, or refusing to offer a refund. I do not recommend anyone patronize this business because the owners are rude and have no shame. They have no problems arguing, insulting, and taking advantage of customers.Desired Settlement: I would like a refund for the value of $30 dollars or the ability to redeem the gift card for $30 dollars worth of services, in this case, food. But at this point, a refund is preferred.

Response:

Thank you for giving us the opportunity to relate our side of the situation.

A couple of days prior to my face-to-face meeting with Ms [redacted], her daughter came into our restaurant to purchase some food. She tried with a gift card at which time it was confirmed that there was a zero balance on the gift card. The daughter told me that there is money available on the card. Together, the daughter and myself, called the gift card provider at which time the daughter was notified of the zero balance.

The next day, Ms [redacted] called me regarding the same problem. I explained the situation to her. She told me that she talked to the gift card people and was told that the funds were reversed back to her card. I asked her to come into the restaurant so we can straighten the matter. The next day, she came in with her card. We called the gift card company together and was informed that the balance is zero. I told her that I will honor her card as soon as the company reverses the funds as she had stated to indicate the actual balance. Until then, I could not help. She became belligerent and said that she would report us to Revdex.com.

Have a great day,

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
