Dear ***,We did notify you in regards to the backordered item via email Our system notifies customers of backorders as soon as the order is processed That is within the FTC guidelines We are allowed to charge a customers card upfront as long as we are able to ship the item
within a reasonable time frame (days) or within our stated shipping times, which in this case was business days Our system notified you of the backorder the day the order was processed We had a production issue with this badges that prevented us from being able to meet our delivery times, and the only options at that point was to either upgrade to a custom version of the badge, or to cancel the order for a refund, which we offered you in the emails We had no other options since our supplier had quality control issues, and we were forced to use another supplier to fill these orders at a loss for our customers, even with the additional small charge You had a badge for that was on backorder for less than a week, and you were notified in a timely manner of the situation when we were not able to fulfill the order You were given an option to continue the order with a modest ($10.00) price increase to get a $custom built version of your badge, or you were given the option to cancel the order and obtain a refund, in which you accepted and we honored by processing the refund the same day you requested. Yes we have since updated the prices on the web, as I stated, we had to change the supplier for these badges and increase the prices because of the issues surround the quality of the product We take the position of losing a sale, vs sending poor quality products to our customers All of affected products have been updated on our site and the customers have been notified and given the same option as was presented to you 70% of the customers chose to upgrade their badge and 30% canceled and received and refund We only had one complaint regarding this issue We attempt to take a reasonable approach to solving issues like this Sometimes manufacturer issues, delays and quality control issues are beyond our control and we take steps to correct to the best of our abilities. The Mail or Telephone Order Merchandise RuleThis rule covers merchandise you order by mail, telephone, computer and faxIt requires merchants to have a reasonable basis for claiming they can ship an order within a certain time.Ship DatesBy
law, a merchant should ship your order within the time stated in its
ads or over the phoneIf the merchant doesn't promise a time, you can
expect it to ship your order within days.The
shipment "clock" begins when the merchant receives a "properly
completed order." That includes your name, address and payment (check,
money order or authorization to charge an existing credit account -
whether the account is debited at that time or not).If
the merchant doesn't promise a shipping time and you are applying for
credit to pay for your purchase, the merchant has an additional days
(days total) to establish the account and ship the merchandise.DelaysIf the merchant is unable to ship within the promised time, it must notify you by mail, telephone, or email, give a revised shipping date and give you the chance to cancel for a full refund or accept the new shipping dateThe merchant also must give you some way to exercise the cancellation option for free, for example, by supplying a prepaid reply card or staffing a toll-free telephone number.If
you ignore the option notice, and the delay is days or less, it's
assumed that you accept the delay and are willing to wait for the
merchandise.If
you do not respond - and the delay is more than days - the order must
be canceled by the 30th day of the delay period and a full refund
issued promptly.If the merchant can't meet the revised shipping date, it must notify you again by mail, email or telephone and give you a new shipping date or cancel your order and give you a refund.The
order will be canceled and a refund issued promptly unless you indicate
by the revised shipping date that you are willing to wait.If
you do not respond at all to the second notice, it's assumed that you
are not willing to wait, and a full refund must be issued promptly.RefundsIf you authorized a charge to your credit card account, the merchant must credit the account within one billing cycle - not give credit toward another purchaseIf you pay by cash, check or money order, the merchant must mail you a refund within seven working days.Regards,Charles T***NIC
