I will provide the file as she requested, however I disagree completely with her assertion that any licensed contractor would provide a file with all the actual costs associated with a projectI know of no other contractor who would do thisPrior to this project, I have worked for the homepwner on many other home related projects in several different houses and have invoiced her in each case without any backup whatsoever and she has never questioned that method2.I will have the patio door screens and patio door locks delivered by an uninterested third partyI will purchase the proper finish faucets (brushed nickel) and have them delivered by an uninterested third party for installation by the plumber she chooses, however I will assume no responsibility for any damage to the granite counter top and back splashIf any damage occurs during the course of replacing these faucets, it will be the sole responsibility of whatever plumber she chooses to perform the actual workIt is beyond the pale for her to request that I be responsible for something over which I have no control The homeowner recently had a new furnace and electrical panel installedHer request for me to be responsible if a plumber she hired did some damage to the counter top would be akin to her asking the electrical installation contractor to be responsible for any damage caused by the furnace installation contractor 4.Regarding the carpet, during the course of the project, there was discussion about trying to maintain some semblance of a budget and as a result of this discussion, it was mutually agreed that the carpet quality would be reducedThe initial pad install was not that which it was supposed to be , however that issue was subsequently corrected at no cost to the homeownerWith regard to the windows, several things are at play hereI did in fact provide the homeowner with an invoice which included a number of items including the windowsthe invoice specifically stated that it was for $ 4,for the windows only and did not include installationThe window amount did in fact contain some markupThat being said I did provide the homeowner with an invoice in the amount of $ 6,which stated it was for the materials and labor to remove the existing windows and replace them with new vinyl windowsThese windows were the one's mutually agreed to by the homeowner and myselfThe $ 6,invoice was presented to the homeowner so she could include it with her income tax filing, and clearly states that it was for labor and materials, not the $ 11,figure she claims I had billed her forThe window invoice was $ 4,150.00, installation was for $ 2,for a grand total of $ 6, With regard to the homeowners groundless accusations that I am trying to hide some kind nefarious behavior because I won't provide the job file, that simply is not trueAs I stated in my previous response, I have never been asked to turn over a single job file in all the years I have been a contractorI also refer you to my statement about previous dealings with the homeowner However, I will admit that the entire project did not go as planned and that the delay was primarily my fault In an effort to bring this issue to a close, I will make the following offer to the homeowner: In her original complaint, the homeowner stated that there was a $ 15,disputed amountEven though I disagree with the amount , I am prepared to offer that amount of refund in the following manner as I simply do not have $ 15,laying aroundInitial payment in the amount of $ 5,in cash to her attorney's office, and $ per month for months to her attorney on the first day of the month until the entire $ 10,is paid I this offer is contingent on the homeowner accepting the terms and agreeing that the complaint was resolved and that no further action will be taken by the homeownerNick D [redacted] 720-276-

While I agree with some of the items [redacted] has listed, there are others with which I disagree completelyI agree that I did hold on to money for the windows for several months, the windows were nontheless ordered, delivered and installed ,( the installlation of which I have not been paid for, while the installation contractor has been paid by me), The patio doors did in fact open the wrong way due to a miscommunication between myself and my supplier, they were in fact revised prior to installationI the faucets are simply the wrong finish, chrome instead of brushed nickel, the switch of which would only require a couple of hours I have indeed taken on additional clients, during the course of this projectAs I'm sure you are aware in the construction business, a contractor has to keep a number of projects in the pipe line in order to maintain a cash flowI simply cannot function as a contractor by taking a single project to it's conclusion, and then start the search for another project With regard to the client file she is requesting in order to determine "proper job cost" in all the years I have been in business, I have not nor will I ever turn over a job file to a client, nor have I ever been asked to do soThe job cost is whatever the contract amount states, or whatever the client and I agree to with a handshake which is the case in this projectI am entitled to a mark up on costs billed to me by contractors and I am entitled to a reasonable profit and overheadWhether I made $or $ 5,on her project is quite frankly none of her businessIf I handed the job file over to every client, it would provide them with insight into my business and open up their perception that made too much money on their project In terms of a settlement, I will offer the following: I will deliver and install the window screen, and install the patio door locks which were not ever included in the original window quote,Here is the balance of they settlement offerSince she has yet to pay me for the window installation in the amount of $ 2,800.00, I will forgo that amount

I accept the offer of $15,000 with the immediate turn over of the file at same time as first payment, contingent on the contractor calling my attorney today at 303-832-5400 to discuss terms.  He must call her immediately, and without delay.  Homeowner does not accept payment plan as outlined by contractor.  It is up to him to locate the funds to pay close to 1/2 of what is owed.  Contractor must put up more money up front, and payment plan has to be on a more accelerated time scale (significantly less than 6 months) with the understanding that late/missed payments voids homeowners obligations under the settlement.  Contractor must turn over screens, handles and faucets within 3 days of signing the agreement.  Failure to timely call my attorney will void the agreement.
