Revdex.com,I have reviewed the response made by the business in reference to complaint ID *** and have determined that this does not resolve my complaintFor your reference, details of the offer I reviewed appear below.Lowering the payment was not our issueWe didn't have a problem with the payment amountThe repairs for the car was well over the $that Nickle Auto wanted to take off the loanThe issue was the fact we were paying for a non working carThe car did not last a week, and we were paying triple what the car was worth after it broke downAs we talked, I tried to tell them that I would accept any other car for the same payment amount as long as it was drivable and would not possibly kill us in an auto accidentWhen I took it to Don K, they informed me that it was unsafe to driveThat was before I replaced the timing belt and other preventative maintenance and only a couple of days after the initial saleWhile I was on the lot of Nickle Auto they had what they called their "parts guy" working on a few of the vehicles, if they are working on these cars, this problem would have been addressed before putting this car up for saleThe problem was that I was sold a car that could have harmed me, that only ran for a few daysI will contact Don K to get ahold of all the records on the car, I left my paper copy in the car itselfThey had to repo it due to the fact I wasn't going to pay for a car that I could not fix, drive, or even move with out safety concerns.Regards,*** ***

Review: My wife and I went to look at vehicles at Nickel Auto Group in Kalispell, Montana. We found a 2003 Cadillac CTS we really liked. We were told by the salesman that it was $6900 but if we came in with cash, we could get around a thousand off the price. So I took my [redacted] home and asked my friend, [redacted], if we could borrow the money. He agreed but wanted to look at the car with me. So him and I returned to Nickel Auto. We asked very specific questions. #1 - Where did the car come from? We were told [redacted] Motors. #2 - Why did they sell it? We were told that [redacted] Motors didn't sell used cars. #3 - Is there any mechanical issues with the car? We were told that [redacted] Motors had their mechanics check their cars before they are wholesaled. #4 - What if we drive off and the car breaks down? We were told that if anything goes wrong with the car within 24 hours, let him know and he would have it fixed.

So we went in to buy the car. I asked what the cash price was. He said $6900. I reminded him of our conversation earlier about how if I came in with cash, I would get it cheaper. He changed his story and said that the $6900 was the cash price. He said it was advertised for $7900. So I knew how much my wife wanted it so I paid $6800 for it. I signed the "As Is" agreement based on what the salesman had told me in front of a witness. ([redacted]) I later found out that [redacted] Motors does sell used cars. They DO NOT have their mechanics check out the cars they wholesale. The salesman lied to us so we would sign the agreement. This is a Deceptive Business Practice!! We signed based on Nickel Auto's LIES!! They came out to the house and removed the external part from the transmission. They said they were having it rebuilt. We haven't seen it since. Now we have a $6800 car that has been driven once. It has been two months of waiting for them to resolve the issue. All they do is argue with my wife, yell and cuss at me when I went to talk to them, and use excuse after excuse.Desired Settlement: I just want them to come and get the car and refund my money. I have two kids and this was going to be our only source of transportation. Now we are being taxied around by our friend, [redacted], because they wouldn't even give a loaner car. I just want a refund.

Response:

The vehicle was purchased as-is, and we generally don't fix vehicles after a purchase and/or give refunds. We got the vehicle from [redacted] Motors and was told everything was good on it. Someone prior to Nickel Auto Group put the incorrect part on the Cadillac. We have been extensively trying to find the correct part to solve this problem, but the codes have to match exactly and there are hundreds of different codes, we have even been searching across seas in China to find this specific part. The customer has not been forgotten, we just haven't found the right part for the customer. We appreciate their business, and are trying to remedy the situation.

Regards,

They are not addressing the issue. The issue was not the signing of the AS IS agreement. It is the fact that I was lied to IN FRONT OF WITNESSES by the salesman in order to get us to buy the vehicle and sign the contract. It is a deceptive business practice. We had to borrow even more money to get a different vehicle because after bringing it home, it broke down. We notified them within 24 hours of the problem. They came out and removed the part off of the car which completely disabled it from even a limp. If it had the wrong module in there, then it wasn't the one from the factory. Is the reason they came out and removed it because they put it in? Were they merely disposing of the evidence?

It has been sitting in the garage for months now. All we are asking for is for them to take the car back and give us a refund addressed to the person that wrote the check ([redacted]). They can fix it and sell it again to someone else so they won't lose money. We don't need it anymore due to having to buy another car because it didn't work. As I said, "we were lied to by the salesman so we would buy the car and sign the agreement." Had he been truthful, we wouldn't have bought it. Nickel Auto wouldn't lose money by this arrangement. They would just have to resell the car. I will even pay to have the car towed back to them. If going through the Revdex.com doesn't work, I will file a very public civil suit. I will advertise through classifieds, [redacted] and letters to the editor of multiple newspapers to find others who have been lied to and taken advantage of by them, and hopefully turn it into a class action suit. If this is the type of reputation they want, I will help them achieve it. If this is the type of reputation they want, I will help them achieve it. I already have people wanting to form a picket line but I am giving them a chance to do the right thing and refund the money. Everybody wins this way.

Revdex.com,

Sorry this has taken so long to respond to the complaint ID [redacted], I have been waiting on a response from [redacted]. I talked to his wife and she gave me his cellphone number I called and left a message for him to call me. I have been looking into finding a part for the vehicle and I would have explained that to [redacted] if he would have returned my phone call. That is all we can do here. This vehicle was sold AS IS with no warranty, we have all documentation to support this

Thanks [redacted]

Does Nickel Auto even read the complaint? The "AS IS" Agreement was signed because WE WERE LIED TO BY THEIR SALESMAN ON MULTIPLE QUESTIONS IN FRONT OF WITNESSES!!!!!! Further, all contact was supposed to be made through Revdex.com. Why are they trying to call. All they are doing is stalling. Bottom line is that they lied to get us to by a car that they temporarily fixed and then came out and removed the evidence from my house by taking the module out of the car. Nobody has seen it since and the car has not moved. If they do not refund my money soon, I will very publicly sue for Deceptive Business Practices, write letters to the editor of every local paper about their business practices that we experienced (all verifiable) and start the picketers. You decide if you want the negative publicity and the potential for a class action law suit. Please tell Nickel Auto to send all responses through Revdex.com.

Review: Illegally sold a car in April 2006 to a person that had taken or stole my drivers license without a proper back ground check, employment check, ect. Just learned about this fraud of a auto loan in Oct 2013 from a collection company [redacted] case # [redacted] I was sent a copy of a loan paper that has my forged signed name on the paper, and a amount of 4880.00 owed on a car I never purchased, saw, drove or new about till I got the collection notice on 10/22/13 and it took the collection company till 11/26/13 to send me one sheet of the many pages of paper work I requested from them reguarding this auto loan. Remember this loan was taken out in April 2006 and they waited this long to try and collect from me. This is illegal to do to a person and wait almost 8 years to try and collect from them on a forged auto loan I knew nothing about. It also was never reported to my credit report as of today 11/26/13 A Police report has been filed with the MCS department if requseted I can give you the number of the police report. If they continue to try and collect this money from me I will counter sue the Collection company and Nickel Auto Group for Fraud and all damages acuredDesired Settlement: Drop all Collections on this Auto Loan by certified Letter and $ 500.00 in Damages to me by December 31st 2013 by Nickel Auto Group. A Certified letter dropping collections on this matter from [redacted]. with a fine of 1,000.00 to me for not sending the right paper work requested on this case and illegally trying to collect on such a old case ect. If this matter is not resolved by January 1st 2014 I will counter sue for the full amount of all illegal collection

Response:

We at Nickel Auto Group take precautionary steps to make sure we are not fraudulently selling a car to someone who is not who they are claiming to be. We copy driver's licenses and verify signatures to match the license. We also take a picture of the customer on the day they purchased the vehicle next to their new car. The picture matches the customer that is making this complaint, and the signatures throughout the deal match the signature on the drivers license. If needed I can provide these documents to show we had no wrong doing in this matter. There is a 10 year statute of limitations to try to collect on a debt, and it has been less than 5 years since the sale date, we are within our rights to collect the debt from the customer. If she pursues this complaint, we will also counter sue for the full amount and any damages.

Regards,

At the time all this was going my wallet went missing or/stolen, was on food stamps, receiving TANF(welfare money), had no job, was 8 months pregnant, was in and out of the hospital and I could not drive. I requested ALL accounting information from the collection agency on this case, and only received one page which is for a "as is agreement" The date that is shown on their response states it is 7 1/2 years old(April 13 2006) where the message reply to Revdex.com from them states the loan is less then five years old. When I went down to Nickle Cars after learning about this whole affair(Oct.22 2013) the gentleman behind the counter was very rude, wanting a check now and didn't do anything but make snide remarks. The lady who helped me showed me the picture they(Nickle Cars) are referring too After looking at the picture Nickle Cars has, I learned the woman is my ex-husbands now ex-girlfriend, who looks very similar to me. I now have a Sheriff case open on the whole case. After the sheriff contacted the attorney for the collection agency, he (the sheriff) contacted me and said the attorney even said the pictures do not match, and will more then likely drop the matter, but as of now(Dec. 5 2013) I have not heard anything from the attorney. I do not intend to drop this matter and will counter sue Nickle Cars for all the legal violations they have violated. I am not admitting I owe/possesses this debt in any way.

Business

Response:

We have a copy of the picture from the day of the deal showing a woman who looks remarkably close to [redacted]. We also have the driver's license with the signature that also matches the signatures throughout the deal. If [redacted] continues to dispute and threaten to sue we will counter sue as well. We took our necessary precautions selling not only this vehicle but all our other vechicles, and this is the first instance like this we have ever received. [redacted] has taken over some of our older accounts to try to collect on, and they are within their rights to collect on this debt.

Regards,

Same as the afore reviewed!! They sell cars that drive long enough to get it off thier lot. All the staff are arrogant and rude! Bunch of cons working over the aftermath of a bad economy and peoples circumstances.

Sales person insisted 1996 Chevrolet Lumina was reliable and in excellent shape. Purchased vehicle on March 30, 2013. The transmission went out April 24, 2013. Nickel Auto Group will not tow, repair or deal with this. Finance person, [redacted], was extremely rude stating, "I have good credit so I was able to finance through a bank. I don't get to call them and complain if something goes wrong." I did not call the finance department, I called my salesperson and was transferred. I do understand that used cars are sold "as is" however it has been less than 30 days since purchase! They refused to offer a tow, a loan vehicle or any type of repair. THE AUTOMATIC TRANSMISSION IS OUT-no reverse, no gear shifting at all. Happened while driving to work. What kind of customer service (better yet, lack thereof) is this? How does this business obtain accreditation with Revdex.com? I wish I would have listened to the advice of many friends and steered clear of Nickel Auto Group.
