[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because:The snow fall totals in Newtown for the February 14-snow was less than one inchThey simply created an invoice for no services.I did not yell out the windowI tapped on the glass and said there is no to shovel and they shook their heads and said yes.Perhaps we need to talk to the two men who were there to shovel.There was a drift of snow that was feet long and inches high and one inch in widthThey started to shovel that when I stoppedthem.I have an email from the people who plow the snow in my development and he concurred there was less than a half inch in the entire development.I have attached a picture of my sidewalk, which shows you that there was snow to shovel that day.Thank you so very much Regards, [redacted]

February 24, 2015Dear Sir/Madam:Thank you to the Revdex.com for taking the time to be an intermediary in this situation[redacted] has contracted snow removal services from us for several yearsIn order to become a snow removal customer, she needed to agree to and sign a maintenance contract (see attached.) Among other items, clients are required to contact our office in order to avoid visit charges during a storm [redacted] has used our services in the past as well as called to skip services.The storm in question was a 2" – 4" storm with blowing windsThis is supported by [redacted] .comWebsite: [redacted] This website shows projections and actual snow totalsIt is searchable by different cities or zip codesThis is a commercial weather forecasting service that culls data from numerous sources including the government and other meteorological and non-meteorological organizations [redacted] reports 4.5" were received on 02/15/in Newtown, PA.A second source we have double-checked in the past is the National Weather Service Public information statementThis uses weather stations and trained snow spotters to provide snow totalsThis site does not directly reference Newtown, PA but recorded snow totals between 2" and 4” in surrounding towns.While our crew was servicing [redacted] 's property on 02/15/15, she saw them and yelled out a window for them to stop.When [redacted] called to complain that the storm was not a 2" storm, she did acknowledge while parts of her property had been blown clear of snow because of the high winds, that she should be billed for the snow removal that occurred because of the drifted snow between her carsUnfortunately, our maintenance agreement does not pro rate for services performedThere is a set charge for performing a service or for coming to the property in the case of a homeowner not calling to skip services[redacted] cited two websites she felt would support her argument of less than 2" of snow fallingThe first website, [redacted] .com provides its data for the Newtown, PA area from the weather station at [redacted] airport (approximately miles away.) The second website, [redacted] .com, provides its data for the Newtown, PA area from the closest government weather station that is reportingIn this case it is the North Philadelphia airport (approximately miles away.) Both of these sites report.08" of snowfall was receivedI tend to believe neither site was updated at the end of the storm.In the past we have tried to work with [redacted] by removing charges she felt were questionableIn this instance, the online data supports the amount of snowfall she was charged for, she did not call to be skipped as she has done in the past (this automatically generates a minimum charge per the maintenance agreement) and she did ask to be billed for the snow removal of the snow that drifted between her car and garage door [redacted] did not attempt to compromise make a good faith effort in resolving this chargeShe stated she would not pay the charge and per her email to Nickett Landscaping of 02/17/“we can go to court to settle thisNot a problem...” If [redacted] would like to like to submit payment of $50.00, we are willing to accept that as payment in full for services charged for 02/15/15.Sincerely,November N

January 21, 2015Dear Sir/Madam,Following please find the answer to [redacted] 's rebuttalPlease note any further correspondence should go to PO Box ***, Doylestown, PA ***[redacted] 's primary complaints are we do not address her issue that the services were not performed and we are rudeWe have spent an inordinate amount of time addressing the issue of services were performed.aMonthly bills were sent – she has not said she did not receive the bills that were billing her for servicesshe claims were not performedbOur only contact in our records stating service should be stopped was a note received with a payment on 10/29/We have been able to produce crew reports and truck GPS records showing we performed the servicedWe supplied a detail page answer to her better business complaint, I will disagree with the office being rude to this customerAny attempt to contact [redacted] has resulted in her hanging up on usShe does not allow any dialogue; she yells that we are wrong and hangs upWe have not been able to discuss the situation with her or reach a compromise-The balance remains dueShe has not attempted to contact us except thru a negative review in ***'s list and the Revdex.com.I don’t believe the only issue here is ‘were the services performed.' The additional issue is given the maintenance agreement that she was sent and her prior methods of communicating with us – when did she informed Nickett Landscaping she no longer required service? The service was stopped when we received her note 'last service of the year.’ There is a difference between services not done and services not neededThere should be accountability on both sides.We are answering this rebuttal in the spirit of fairness and the willingness to compromise but it is a two way street.Sincerely,November N

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because:The business fails to admit the charges claimed to be earned are in fact not earned for the there was no work done, which I personally witnessedThe business claims there is a GPS report, which shows where the crew went, but it is not a sufficient evidence for the work completedThe crew came to my next door neighbor, and I did see them coming and going through my property, as well as I saw them doing nothing at my propertyI have records of my calls to the business which supports my statement I contacted them to resolve the error on their partThat is when I encounted rude treatmentThere is no Agreement signed by me the business can produce to evidence I accepted their termsWhat is going on now is the owner trying to save face for the matter was brought out to publicI absolutely disagree with their claimsNickett Landscaping are not entitled to any payment on my part Regards, [redacted]

I am rejecting this response because:it did not address the issue.Namely, my complaint was the business requests the payment for the services NOT delivered. There was no grass to cutI was home and saw them arriving to my neighbor's property, and NOT doing anything at mineNevertheless, they send me a bill! I am requesting them to eliminate the charges.There was no work to be done (nothing to cut, the grass did not grow enought yo be cut).I observed them not doing anything on my property.It is outrageous they keep claiming the money.Besides, the business repcame to my property to collect the payment and left a hand written note in at my door.They are rude on the phone and totally dismiss any sttemts to discuss the issue.Thanks,**

July 13, 2016This customer contacted our company on 06/19/stating he had just returned from being out of town and noticed his garage was punctured and dentedHe believed it was done by our company because no one else is on his propertyAccording to our records, our head mowing foreman cut his
property on 06/15/16.The Mowing foreman contacted the homeowner regarding the damageHe explained he was the employee who cut the lawn that day and assured him he did not notice or cause any damage to the garage door, Initially the homeowner claimed the trailer attached to the truck must have done the damageThe foreman explained the trailer was not parked in the driveway and the damage on the garage door was much lower than any parts of the trailer.Both the operations manage and the mowing foreman wanted to visited the property with the homeowner with the truck, trailer and equipment that was used to service his propertyThey offered to meet him when it was convenient for himThe homeowner said he was a busy man with a changing schedule and could not make himself available to meetThey tried to explain the trailer could not have damaged the garage door because it was not parked in the driveway at the time of the cutThe homeowner thought the damage was then caused by the equipmentThe operations manager and mowing foreman tried to explain the damage did not line up with any parts of the equipment being used that dayAfter extensive review and discussion, they explained that Nickett Landscaping could not take responsibility for any of the damage.The customer has since cancelled his service and his final balance of $172,for mowing remains outstandingHe had stated in his last conversation with us he would be making payment,Nickett Landscaping did a thorough investigation of the damage at the customer's propertyThe height of the damage is the main hindrance to be able to claim responsibility for any damageNone of the equipment, truck or trailer used by Nickett Landscaping has projecting parts at that height that could be responsible for the damage.While the customer claims Nickett landscaping was the only company at his property, the customer has a shared driveway that is accessed by other homeownersIt is completely possible other contactors used his driveway while he was away, Finally, during a recent visit to the property it was noted that the house was having Construction done around the property and specifically in the eaves directly above the garage doorHas the homeowner contacted the other contractors doing work on the house or filed complaints against them?Please be assured, if Nickett Landscaping did this damage we would absolutely take responsibility for it, in this case, there are too many questions and evidence to the contrary to accept responsibilityWe are sorry this homeowner feels we are responsible but we have responded to each inquiry and have been unable to satisfy the homeowner

I am rejecting this response because:The business fails to admit the charges claimed to be earned are in fact not earned for the there was no work done, which I personally witnessed. The business claims there is a GPS report, which shows where the crew went, but it is not a sufficient evidence for the work completed.
