Good Morning, [redacted] called to order a dumpster.   When he called he was asked what type of debris would be going into...

the dumpster.   This is common practice as certain disposal sites only take certain debris.   He stated that it would be brush & stumps.   He was quoted a price for this debris.   Upon removing the dumpster and taking it to the dump facility for this material, they rejected the load due to the fact there was trash, demolition, metal fencing as well as tree material.    We made numerous calls to the number we have on file and left messages,  no response.   We then estimated the weight of the dumpster and charged accordingly.   This prompted a response from the homeowner.   We explained that the price quoted was for the material they originally told  us was going to be in the can.    We told Ms. [redacted] that we cannot be stuck with this material as we now have to pay more to dump the dumpster due to the fact that they mixed the materials.   She was fine with the credit we offered her.   We then received a call from her friend [redacted] who was arrogant and rude and didn't give either Nick or myself a chance to talk.   We explained the whole situation to him which we shouldn't have even talked to him because he is not the customer.   He said that the landscaper told him that they could put everything in the dumpster.     If the customer had put in the dumpster what they said they were going to put in it, there would have been no problems.   It is not fair to us that we were stuck with a container of mixed debris and had to incur additional costs - fuel, driver time, additional dump fees because they were not honest to begin with. We charged $350 for two containers.   One with the brush, and one with the mixed debris that we had to dump.   We did refund the homeowner $267 and we feel this is fair and the homeowner was happy with the refund.      Gina M[redacted] Nick's Carting Inc. Review: I ordered 12 yard dumpster for a small roofing job on 1/10/14 which I paid a total of $420.08 using my [redacted] card. Once I finished with the job, I called the company to come to pick up the dumpster which they did. After a few days I received claiming the dumpster was overweight therefore, I have a to pay another $264.07. I visited their office to find out what was going on. They said that the way it worked and they had explained it to me when I first called which they did not. I asked to listen to the call, they said they did not record it. I asked how come the driver did not tell the weight of the dumpster before leaving my driveway. They answered was the weight in of the dumpster was done at the site where they unloaded it. Feeling that I being cheated by not having been made aware of this crazy weight in process, I asked for proof and told them be sure not to send me some made up staff. Well, they emailed weight in ticket dated 11/06/13 which clearly could not be my ticket because I ordered the dumpster on 1/10/14. Now instead of waiting for my response or the due date 1/31/14 on the statement they sent to, they went ahead charging the credit card that I gave them when I originally ordered the dumpster without my authorization. I have a copy of the emailed they sent me and I can forward it if needed.Desired Settlement: I would like to have my $264.07 refunded to my card because they clearly trying to cheat me out of my money. I also did not authorized the transaction. Why did they keep my credit card number on file?

Response:

Customer ordered a 12 yard dumpster for roofing. All dumpsters have a weight limit & it was explained at the time of purchase. His dumpster went over the weight limit as roofing material is heavy. He came to the office and was verbally abusive to the office staff. There were other customers there at the time as well as an insurance agent. He gave his credit card for payment & it was used for the rental of the dumpster as well as the overweight billing. This is our procedure. He was emailed a copy of his weight ticket. We do not have a dump facility and all our material is brought to a facility with board certified scales.

Review: [redacted]

I am rejecting this response because:

I was not made of any weighing process since the call could not be listened to of course they are going to claim that I was made aware.

Second, I asked for proof, they emailed me a bogus ticket dated November 2013 which clearly could not be because I ordered the dumpster this past January. They simply made it up.

Had I been explained of a weighing process, I would have asked questions to know how I going to know and verify the weight? I can just take their word for it.

Third, they charged my card without my authorization while disputing the bill. what kind of business does that?

Lastly, when a company send a bill it has a due date by which the customer must pay if the bill is not contested. Well, Nick's Carting could not wait to get their hands on my card.

The bill they sent me was due 1/31/2014, yet they charged my card on 1/28/2014 without my explicit authorization. The card was given to them for the original charge of $420 not for any other subsequent charges which they knew that was the reason they sent me a bill. If they were not out to get my money why not wait to clear out the dispute. Their explanation for having and using my card after the original transaction was "Lastly that each container has a credit card on file. Our software will not print out a ticket without one". That just absurd, they forgot I was offered cash on delivery option. What if I chose the COD, is that mean they would have been able to print out a ticket for the transaction.

Please see the attached weight ticket they sent to me.

Sincerely,

Review: My landscaper [redacted] and I rented a general dumpster from Nick's Carting. According to my landscaper, a general dumpster is appropriate for holding landscaping debris, and natural materials, no industrial materials. We each spoke with someone at Nick's Carting twice because of some inconsistencies with pricing We settled on $575, and I called and gave my debit card number and authorized billing for payment in full, $575. Apparently the contact phone number they used for the account was my landscaoer's, ###-###-####. When I received my bank statement, I saw the $575 charge, and an additional charge of $505 from Nick's Carting which I had no knowledge of and did not authorize.. I called them , they said that there was a lot of construction debris in the dumpster and that the additional charge was bcause of that.. I called my landscaper who stated that there was no construction debris in the dumpster and that he checked it prior to it's removal. I called back, told them what the landscaper said, and told them that they had no right to charge my credit card without contacting me by phone or mail. They stated that they called ###-###-####, the landscaper's number, several times and got no answer. [redacted] says he never got a call , voicemail, or message. The company then said that they had pictures of the construction debris in the dumpster, I asked them to send the pictures, they never did. They said they would come and dump the debris back at my house, which I said yes to because I knew there wasn't any and I wanted to get my $505 back, but another secretary(or owner), told me it was all gotten rid of on the initial day it was picked up. They called back and said they would be refunding $150 to my debit card . I called a friend who spoke with the owner's husband and wife on several occasions. The owner Nick said he would evaluate what was left of the construction debris and see what he could do. I remembered that the secretary , or owner wife stated it was all disposed of the day it was picked up , so I found this strange. When my friend called the next day, Nick the owner said he would reduce the bill another $117 . Apparently , he was vulgar,,swearing, lost control, and at the end of the conversation said he would not be returning any money. The owner /wife, or secretary called me several hours later and stated that they would be giving me a refund of $267. I said thank you, however, I do not feel this is appropriate and that there should be a full refund, and that Nick's Carting should be cited for using my credit card without my authorization. This is not appropriate business practice , to say the least, and other's should not have to experience this.Desired Settlement: Discontinuation of policy of charging a debit card without customer authorization

Refund of $505 to debit card
