I have both bought and sold with this auction house in the past. They are professional in the way they handle situations but at the same time they are very friendly and try to please the customer. As a buyer I though their art work was accurately described and they offered in-house shipping which made my buying process much easier. As a seller - I thought they were very easy going and made the selling process simple, I simply just emailed some pictures and basic information that I knew about my items and they handled the rest.
Review: I afford to send you an email because I have a serious problem with an auction house en [redacted] called "Nico Auctions".
terfeit is out of law, so I do not have to pay for him.
I live in France and I bought the following lot there. It was an ink on paper sold for [redacted]. There where no ambiguity in the lot description. [redacted]2
The auctioneer has the duty to check the authenticity, which is quite easy for [redacted]. A foundation deliver certificate of Authenticity and give opinion on artwork by email in a couple of days. I contacted them when I got the paper and they told me they already replied to another request, and they said the work is a counterfeit, a fake artwork.
Without any warenty of authenticity, the auctioneer must offer as "attributed to". So he made a mistake. All lot offered in his auctions are under his responsability. [redacted] is one of the most important post war artist, so it is easy to find out information about him.
I had some fees to get a serious appraisal, make professionnal pictures... Actually I did what the auctioneer must do before selling the work. I sent back the work, insured. Please note the auctioneer invoice 238 usd for a ship he paid 53 usd by USPS, packed in a used box, and without any insurance. I paid for a premium shipping insured, and got any premium services.
I paid 3308 usd (2576.32 euros from my account) and I got a 2325.48 euros refund on taht account (2946 USD rate usd +-0.788 euros) so 370 usd are missing, I ve deducted all banks fees and all other fees on that amount. All fees are listed below.
I don't know what I can do, the auctionneer make a mistake and I do not have to pay for it. I am agree to not ear money on that transaction, but I don't want to loose money for his mistake.
I hope I do not take so much of your time. I can send you all documents you need to check.
best regards,
mathieuDesired Settlement: Ideally I would like the work I bought or a similar , authentic one with COA and not a counterfeit, I guess it is impossibble. At least, I would like a full refund for covered my fees due to the inefficiency and mistake of the seller. C
Artwork price: 2576.32 euros (3308 usd)
Fees: Bank fees: 43 euros, tax: 77 euros shipping back: 59.69 euros appraisal: 318.51 euros so: 498.20 EUROS +-636 usd
total paid incluing all fees: 3074.52 euros
total refund: 2325.48 euros
so 749.04 euros are missing (+-956 usd)
