I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
Regards, *** *** Also, she still regrets to mention that she never told my husband and myself anything about a copyrighted CD that we would have to purchaseNothing at allA friend referred her to me, and said that she doesn't negotiate well and tried to charge more on an event that they were working onThere's no receipts, no contracts, nothing at allI don't deny what was written by her with our conversationsBut the fact that she did not let us know about the CD and charging us more for it aside from the shoot which was $115, was wrongShe did drop the price too $for the CD which I sent to herI have worked with photographers before, know many in the area here, and they all have done things differently than her, simply moving their copyright to the bottom corner so I could frame themAs if I'm going to sell them? I don't need someone's copyright to have permission to hang it on my wall in my home, so that I feel is ridiculousGranted if I wanted to sell the prints or post them to a website, I can understand that but not framing them and putting them on a wall in my homeShe was nice to start with, but the miscommunications came in after the shoot was over and the extra CD pricing surfacedShe doesn't negotiate with her clients

October 27,To Whom It may Concern, My name is Nicole C***, the photographer for Nicole Lynn PhotographyI am writing in response to a complaint that was filed against me by *** *** on October 21,1:02pm and assigned the ID # *** Please note that the
spelling of my name is Nicole, not Nichole, and same goes for my business nameAlso I have included print outs of our conversations via text message and e-mail in its entirety, to support my statementsAs requested I would like to tell "my side of the story" of the experience with this specific clientI received a text message from *** on Friday, July 24th @3:49pm, introducing herself and inquiring about Engagement photo pricesI sent her my Engagement Price sheet, *Please see first tag* I offered to get together for a consultation and for her to review some of my workShe responded with her "schedule is a bit hectic to meet right now, " She asked ifl had a website that she could look at instead, I informed her that my website is currently down, but that I have a Photography Facebook Page that she could check outShe stated that she did not have a face book account, and asked if I could e-mail her some picturesDue to my satellite internet connection at the time that would have been very time consuming for myself, so I suggested she look at a friends accountShe said she could work that out, and asked about my pricing againI asked her if she received the pricing sheet that I sent her previously, she said yesOnce she got back to me and informed me that she would like to work together, we conversed back and forth to set a , location/date/time, we settled for Saturday, September 26, @lOamAfter all was set up she confirmed that the price was $125, I told her it all depended on how many images she would like and sent her my price sheet for a second time*please see tag #3* On Friday August 14th she choose the imagesOn Thursday, September 24th she asked if possible "to drop down tier to 50pictures? I forget how many it was and how much." I told her sure no problem, and sent her my price sheet for the third time*please see tag #4* The photo shoot went very well I feel like we really connected and I got some good shotsAfter we were all done, we headed back to our cars, She gave me $for the SessionI told her I would get the pictures done ASAP since their wedding was scheduled for October 11,I also asked for permission to post a handful of pictures on my Photography face book page for their viewing pleasure and for my portfolio, they both agreed that was perfectly fine*** also asked for some of my business cards so that she could refer me to others, I gratefully gave her a handfulOn Wednesday, October 7th@ I 1:03PM I received a text "HeyNichole! I was wondering if any of the pictures were ready at all?" The following morning I responded to her with "They are not yet complete, but I will have a handful up on ***k this afternoon or later tonight! " She was happy and let me know that they wanted to use one for their invitation and photo pictureI was a little confused that she wanted to use the picture for her invitation, I remembered her wedding was approaching quickly, so I asked her when her wedding was again? She confirmed that it was October 11, On Thursday October gth @10:am, I informed her that the pictures were going up on ***k*Please see tag #5* She reminded me that she did not have face book, and asked ifl could send them to her via e-mail? I knew her wedding was around the comer so I decided to send them to her as they appeared on face book*please see tag#6* She asked if the seal was in the middle of every photoI responded "Yes, these are proofs I don't normally email them to clients but I know your wedding is around the comer as soon as I'm done with the rest if you would likeyou can purchase a CD without the water mark on them and have full copyright to them, or order prints without them as well." She then asked me "Can you move the seal for me to the lower part of the frame? You can use it for the photos on ***k for copyright purposes, but for us if they could be moved to the edges of the pictures that would be great." and then she asked how much the CD wasI informed her that it was $She was not happy about this and said that she was under the impression that the CD came with the shootI apologized for the misunderstanding but reminded her that the pricing sheet I sent her from the very beginning mentioned nothing of a CDAnd I sent her a screen shot of the original message where I sent her the price sheet*please see tag#7* I told her how I felt badly about all of this, and if she wanted to choose a select few images that she wanted to use for the wedding I would lower the cost of the CD for her, since she was so pressed for timeShe then said that she did not recall seeing a price list, and that the image I just sent her was to small to seeSo I sent her my price list again*please see tag #5* She then confirmed yes that she had paid the $for the session fee and imagesI said yes that I would send her the proof album with the images in itI told her that I would send her image with the watermark lowered for her wedding pictureShe then asked if album meant flash drive or disk of some sort I told her that it was a spiral bound proof album and sent her pictures of a sample album*please see tag #6* She then said how she did not realize it was an actual album, and asked if she could just have them onto a CD insteadI again apologized for the misunderstanding and pointed out that it specifically states that it is a "10x13" proof album, with a cover page." Also that the proof album comes with the session if she wished to also get the CD it would be an additional $She asked if I could lower the price of the CD, that if she realized it was going to be so costly they would not have gotten the pictures doneI apologized again, and told her that if she wanted all the pictures onto a Cd it was going to be $125, but that after she received the proofs, if she only wanted a select few I would give her a new lower priceOn October 8th @8:55pm She told me that she would like the Cd and if I could just mail it together with the proofs and she would mail me a checkI told her that the proofs were shipped separately, and that I would send her the cd once I received the checkThen on Saturday, October 10th She sent me a message saying how disappointed she was that I was charging her for pictures on a cd, and how she could go to *** arid get a case of Cds for $20, and how she contacted photographers in the Capital District to ask if they charged extra for images on a CDI explained to her that its not the actual price of the cd that I am pricing for but the copy right of my images, because once she has a digital copy of the images she can do whatever she wants with themAnd then I told her with "all due respect if she had brought her concerns to me before I took the pictures then she could have found another photographer that better suited hey expectations." She then went on to tell me that I was the one in the error because as a business owner it is my job to keep the customer happy and I should find a mutual middle ground to suit her needsI told her that I gave her the price sheet in black and white so I fulfilled my responsibility of letting her knowAnd that if she would like the CD to send me a check and I would send her the CDThursday, October 23, She decided to reduce the number of pictures that would be included on the Cd from to images so I reduced the price to $firmWe conversed about the images via e-mail, which I attached for your *tag #9*
