***s new floor was purchased in 2014, and [redacted] contacted the store with a problem with her floor November of ***, then stated due to her health issues she could not allow our floor technician to inspect the floor and submit information to the manufacturer [redacted] for a claim to be filed and she would contact us at a later date to inspect She stated she had peaking edges and seperation that just showed in her floors Once she was able to allow our techicinan in the house she called our store in january 2017, our techician inspected her house on january and took picturesSince we depend on [redacted] for manufacturing defects and warranty reimbursements we submitted a claim to [redacted] on january [redacted] denied the claim on feb citing other issues besides the [redacted] flooring itself [redacted] then contacted [redacted] and informed her what [redacted] had said and offered to bring the Regional Manger of [redacted] to her house on april to confirm [redacted] claims department was correct On April when [redacted] and [redacted] arrive at her house she states that she now has a large hump in middle of floor that recently appeared We pull back plank on the hump and it comes up easy but glue is transfered on the back of the plank and ridges are pressed in the plank showing proper installation The halex sublfoor is humped in one spot only showing sign moisture had been present at one time but cannot be confirmed [redacted] hen talked [redacted] into hiring and paying for a independent certified inspector with ***s permission in order to get a second opinion and to better explain what the issue might be [redacted] an independent certifed inspecctor notified [redacted] and [redacted] on june that she did not want the floor inspected that she was not going to go that route Niemanns american flooring can submit [redacted] s inspection report and forward the voicemail she left Mark [redacted] stating she does not want the floor inspected Signs show there is an issue with the house causing the floor to peak and hump NIemanns, nor [redacted] with [redacted] are building inspectors and would depend on a certified indpendent inspector to make the call in order to make [redacted] and or NIemanns pay for the replacement Please contact [redacted] , for any other info needed

The employees of Niemanns American Flooring and [redacted] offered to fix there hour repair that was caused by some cause (as we stated in first response) within there house almost a year later As this customer stated in there own handwriting when we left there house it awesome and we went above and beyond there expectations and that we did more than expected and they are very pleased We are sorry they don't understand that there problem can be caused by other factors than shaw the manufacturer or install related Niemanns American Flooring even offered to fix there non warranted problem at no charge but this customer wants a full refund for a simple fix

I Continue to stand with the original complaint that I filed on November 15, After reading *** ***s response to our complaint in which he clearly avoided the issue regarding the flooring issues we are currently experiencing with our flooringAs a result of Niemanns now stating that the issues are a result of some type of abuse to the flooring by us the homeownersWe catagorically and firmly deny that we caused this problemThere has been a independent flooring inspector, flooring installer, and Niemanns employee *** viewing the flooring and at no time was the mention of abuse ever discussed or alleged until *** *** decided to once again invent a straw man excuse as to why the flooring is moving away, buckling, and shifting in a manner that is not consistent with the factsWhen we first brought this matter to *** ***s attention he blamed it on house settling, then shifted to the homebuilders, and then change his excuse to the installerNow *** *** is attempting to place blame on the customer*** *** also attempts to speak for us by stating that we want something for freeI would like to remind *** *** that we paid Niemanns American Flooring almost $7,dollars for new flooring and installation and a year labor guarantee*** *** refuses to directly respond to this fact instead he has lowered himself to attempt to attack our characterAs a result I will reject his response in full and the only resolution that we seek is the return of the labor cost's we paid Niemanns to install this floor*** *** has continually refused to respond to the damage the first installer did to our new interior door jams, instead reusing a December 16, written comment which praised *** *** and his installersNiemanns American Flooring sold us a product and service with a labor guarantee that *** *** refuses to uphold and as result and reasonable resolution we have asked for is return the labor cost we paid ($2405.90).As a result of Niemanns American Flooring refusing to honor the labor guarantee we now have to have another flooring installer repair the floor and replace the interior door jams that the first installer caused.I will use any and all avenues that are at our disposal to inform and hopefully protect any potential future customer from patronizing this businessI will also continue to use social media to show proof (photos) of the work Niemanns American Flooring did to our new homeAt no time was we ever unprofessional with and employee of NiemannsIt is *** *** that has lied in order to attempt to silence usIt was *** *** who chose to post our personal information on his companies website and not allow us to comment by locking out customer or visitor comments.As a result I reject his response and again offer to resolve this issue by returning the $2,to us

NIemanns American Flooring deeply regrets the inspectors sent by Shaw Flooring (the manufacturer) decision to not cover this customers problemsIt was determined through the manufacturers inspection that there were circumstances not caused by manufacturing defects or problems after the final
installation of the flooring. As the attachment states that in December this customer had their flooring fully replaced by the Niemann''s American Flooring trying to make the customer happy even when the manufacturer had declined the claimThe customer was extremely satisfied with their their flooringFurthermore, NIemanns replaced the entire floor very quickly, by customer request, when only a few planks and base needed to be repaired. Many circumstances within the house can cause a floating floor to slightly expand/shrink/gap and are not related to manufacturing or install. Ranging from new house settling, improper humidity, temperature, moisture levels, improper maintenance, furniture movement across the flooring without protection and more. Even with the flooring installation and product being in perfect condition and the customer satisfied for for months, *** *** offered to fix this customers problems with their flooring. The simple fix requires less than man hours and only makes sense to keep a customer happy. The customer asked *** *** to explain how the fix would take place. He explained to the customer Niemanns follows all manufacturing install, repair and replacement guidelines to keep the product from voiding any warranty from the manufacturerTo do fixes outside the manufacturers guidelines would void the warranty and it not our practice. The customer did not like the way Shaw recommended to repair. So we asked the customer to watch a you tube video that the manufacturer SHAW had posted on you tube to help the customer better understand the process and to give them confidence on the repair and the process. We felt a video with step by step instructions would communicate much better and allow the customer to see how the repair would work and know that this is the manufacturers recommendation. The customer refused to allow us to fix per manufacturers guidelines and would not watch the video to give the video a chance to help them understand the processNiemanns American Flooring cannot fix a non warranted problem at no charge against the manufacturers guidelinesThe customer states in the complaint that Niemanns is going to glue the floor down during this fix but that is not the case in this situationFurthermore, Niemanns American Flooring is not aware of, if any, verbal communication conversations with the customer and company policy does not allow installers to communicate unprofessionally or dictate what customers will be repaired or how as the installers are independent contractors of Niemann's, therefore can not speak on behalf of the company. One of the advantages of dealing with Niemanns is that follow we manufacturers guidelines for install and *** *** and *** *** are the only representatives of the company that dictate what installers will fix. After the customer made several slanderous comments on our Business *** page, we again tried to reach out to them to see if they were interested in the manufacturers suggested repair and offered to send out someone the next business day to reevaluate the situation and set up a time for the repairThe customer continued to yell and cuss as done previously at Niemann's staff demanding fixes that are not appropriate for the repairs that are neededAfter talking with the builder of the home and several independent contractors that were doing work on the customers home, we found out that they were all going through the same thing as well as not being paid and wanting work done for free that was not agreed upon and filings with the Attorney Generals officeAt this point, we are under the impression after replacing and entire floor worth $that there is nothing we can do to make this customer happy short of not making them pay for the goods that were delivered, installed and deemed by the manufacturer in perfect working orderThus, after numerous attempts to repair the issues we have removed ourselves from the situation as our crews and staff do not deserve the treatment that we have all experiences and the customer will continue to abuse the staff and take advantage of the business in order to get something for nothingAgain, the situation could not be caused by floor installers at time of Installation because the flooring was beautiful for approx months per there written satisfaction review attached. Something like abuse, house conditions, or neglect caused damage to there floor months later

I am rejecting this response because:
The written compliment was done in December 2016! We Did not have the current flooring issues then, that we have now! Once again, We have a 2 year labor guarantee with the retailer. Luxury vinyl tile flooring is a floating floor system. [redacted] has chosen to ignore the labor guarantee, relied on a December 2016 work order comment, has ignored the door jams damaged done by the first installers, and has chosen to repair the floor in a manner that is only a temporary fix. This is unacceptable and once again we request a refund for the amount we paid for the installation of this floor in the amount of $2405.90.
