Dear [redacted], I have received the complaint filed against me by Ms. [redacted] regarding the preparation of income tax returns for 2012. I did prepare Ms. [redacted] income taxes for 2012,with information provided by her which was emailed to me. I have never met Ms. [redacted] personally, and...

communicated with her by email and telephone. Because of the distance, I had to obtain signatures via email, which because she had contacted me late in the season, it took me some time to finish her return and get her the forms that required signatures. It also took some time for her to return the signed forms. Because of some miscommunications as well as the fact that Ms. [redacted] was out of the country for a time, I agreed to prepare Ms. [redacted] taxes free of charge. Therefore, I was considered a non-paid preparer by the IRS. Once the return was filed, the IRS will disclose no information to me as a preparer. It is the  taxpayer's responsibility to follow through with the IRS if refunds are not received, etc. due to privacy rules established by the IRS to protect the taxpayer. If Ms. [redacted] never received her refund, that is something that I would not be able to investigate. Ms. [redacted] should have contacted the IRS directly as she would be the only individual to be able to ascertain that information from them. In September of 2014, Ms. [redacted] did receive a letter from the IRS, stating that they had different information on file for Ms. [redacted] regarding her 2012 tax return. At that time, I prepared an amended return along with a letter to the IRS asking for an abatement of penalties charged due to the different information. Again, I prepared this for no charge. And the IRS would have responded directly to Ms. [redacted] and not to me, of which I never received a copy of any response that she received. Ms. [redacted] has always been provided a copy of any forms that we have prepared, and I am more than happy to mail her a copy of all of the forms again, as I notice a different address on the complaint than I have on file for her. I now show three different addresses for Ms. [redacted], which could be some of the confusion. Unfortunately, when you are dealing with the IRS, speed is not one of their strong points, and because the IRS corresponds directly with the taxpayer and not me as an unpaid preparer, it makes the time frame lengthen even more.
