We ordered products from this company that were to be red and blue. We received product that was orange and blue. They are not willing to resolve.We worked with Nimblewear to design a cycling kit. We chose a template from their website that matched the colors of our logo. Their designer was able to design a kit using the template and colors that we liked. Shortly thereafter that designer left the company and we were assigned a new designer. The new designer completed the design of the remaining items. We approved an emailed picture of a proof of each item that contained the colors red, blue, and white that Nimblewear sent us and paid the full amount of our order up front. We received the product approximately 3 months later and the items were orange and blue instead of red and blue. We contacted Nimblewear to make them aware of this and their response was that we approved the proof, we signed off on the terms and conditions and this was 100% our problem. I have the emails that were sent to me stating these exact words. We have had several telephone conversations where Nimblewear has stated they are working on improving their processes so this does not happen again and will offer us 50% off a new order. We believe the entire order should be provided at zero cost for producing product that was clearly the wrong color. Nimblewear's response is that will not happen and they believe they provided the colors that they should have. It is clear from the proof they emailed of each item that we did approve that the colors were to be red and blue. Nimblewear is saying we are wrong. I have tried to explain to them that we are not disagreeing about the shade of red, we are disagreeing about the difference between 2 completely different colors, red and orange. Why did the blue turn out the same but the red did not? Desired SettlementWe ordered 38 pieces of cycling clothing for our cycling club that were supposed to be red and blue but recieived all 38 pieces in orange and blue. We believe these items should be proved to our club in the right colors at no cost to us. We have worked with other companies to produce items for our club and none of them have struggled with the colors. Business Response We were asked to produce cycling kits by [redacted] We were provided a vector image of a logo provided by them. They worked with the designer to produce a design that they wanted. The designs for approval were provided to them. They approved the design as created and the entire design was based off of the vector image provided by them. Upon receipt of the items they called telling us we produced the wrong color and they were supposed to be red. We print by [redacted] or [redacted] colors that are within the vector image. The customer was unfamiliar with what their color of the logo was. She was asked to verify the [redacted] color that we received from them. She called and verified that the [redacted] was the same color as provided and that is what was produced. She admitted she wasn't familiar with the vectore process or design. In printing there are 1000's of color options and naming a color is ambiguous. They must be exact. We don't change logo colors and use what was provided. Since there wasn't a manufacturing issue we were not able to reproduce the kits at zero cost. We offered a resolution and she was unwilling to work on that position. Her suggestions was either reproduce or she was going to go to social media. We stand behind the process and the printing we produced.We also state the terms and conditions that the customer is responsible for colors, logos use and placement, etc for all order. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)At no point in the entire design phase or approval phase is a color code used or discussed. It is not even included in the proof we were provided and asked to approve. We chose a template right off of Nimblewear's website as a starting point because the colors matched our logo. In all of the email correspondence and telephone conversations with the designers, red and blue are discussed repeatedly. I did share I was unfamiliar with color codes and inexperienced as this was my first order. I was provided an emailed picture of the items I wanted to order and I did approve those pictures because they were red and blue. You would like to believe that a company that talks about 1000s of color combinations may have pointed out that according to them, the final color printed would be orange instead of red as was discussed through the entire process. Nimblewear is correct that they offered resolution of a discount on a new order. I did share that was unacceptable because they knew we wanted red and blue clothing. Why wouldn't they have mentioned any of this and let the entire order go through and then tell us that we are wrong and accountable. This is a horrible business practice and I cannot believe a company could operate this way. Not everyone who orders from them is experienced. I did share that I would be pursuing this with the Revdex.com because I did not want anyone else to have an experience like we did. It is unbelievable to me in this day and age that a company would not do the right thing for its customer. The pictures are clear for what was approved vs. what was produced. Please let me know where to send you the proofs, the template from Nimblewear's website, and the email correspondence discussing red and blue items. We also have a piece of fabric that was produced using the same vector logo. The fabric is red, not orange. We have worked with other companies to produce other items providing the same vector logo and none of them have missed on the colors red or blue. Nimblewear didn't miss on the blue so why the red?Final Business Response We offered a solution to the customer even after there was discussion and she wasn't familiar with vector images. We asked her to verify the internal color from the individual who produced the logo and it was the one we printed. Since she doesn't have a [redacted] printer and produce on the same fabric there isn't any way to reproduce this and state that we produced the incorrect color. It is with regret that they are unhappy regarding the color as we produce 10,000 items per month and do not run into this issue. We also reviewed several documented files of a difference of color and never was a specific red, orange, blue ever discussed. Again we take the color off the vector image. I have attached photos which show a difference of color one being their painted wall with a "red" bike hanging and their logo adjacent to it. As you can see from their logo it is not in the family of a fire engine red. Also these terms and conditions were always for their review and are standard in the industry when dealing with printing. [redacted] Finally the customer has been wearing the items throughout different events and races.
