Complaint: [redacted] I am rejecting this response because:We have had problems with our cabinets since construction began The day before we closed escrow (1/7/16), I explained via e-mail the persisting problems ( e-mail attached) I also snapped photographs of just some of the problemsThey can be viewed at https://www.dropbox.com/sh/ [redacted] These depict some of the esthetic problems However, they do not depict mechanical problems I was assured the cabinets were under warranty and that we should go ahead and close escrow and fix the cabinets after we moved in The cabinet maker/installer was at our home the day we closed escrow trying to fix some of the problems so we could at least move in He was at our home the entire day, and we still had problems The escrow release we signed to hold escrow funds was for exterior paint only It had nothing to do with the cabinets, as I was, again, assured cabinets would be fixed under our warranty.A few days later (e-mail attached), I asked to meet to arrange repairs Actually, I sent several e-mails to set up appointments (e-mails 3, and attached) I made appointments for the repairs However, the cabinet installer canceled several times This lingered on for three months On March 23, I attempted to reach out again to have my cabinets fixed (e-mails and attached) On March 28, 2016, the cabinet maker said he had done the best he could do (e-mail attached).Ninety Degree Construction came to our home and inspected our cabinets They agreed that our cabinets were not acceptable and assured us they would fix them properly They contacted a new cabinetmaker, Western Idaho Cabinets On April 28, 2016, I was notified that Blane from Western Cabinets would come out and evaluate our cabinets (e-mail attached).By June 8, 2016, over a month after I was told Blane from Western Cabinets would provide an evaluation, I still had not heard anything (e-mail attached) Western Cabinets did finally come out, and we were assured that Western Cabinets would take care of everything, fix all the esthetics as well as mechanical problems that we agreed on with Ninety Degree Construction Blane from Western Cabinets told me these cabinets were a major problem and that he would not have these cabinets installed in his home By mid-July, I was told Western Cabinets was ready to install new cabinets and make necessary adjustments, etc However, I found out from the installer that he wasn’t from Western Cabinets and that Western Cabinets didn’t even make the replacements Ninety Degree Construction had the original cabinetmaker remake the cabinets I was very disappointed because I was lied to (e-mails 11, 12, and attached) Lanny, the installer, also said he would not have these cabinets in his home He tried to make some repairs However, the lacquer he used was a different sheen than the original lacquer Along with visible sanding marks, this actually made the cabinets worse Lanny only had time to work on the kitchen cabinets which left the rest of the house as is.Ninety Degree Construction came out yet again We all agreed the cabinets ended up worse At this point, they called Franklin Cabinets to come out and assess my cabinets I guess they felt a fourth company could try to resolve the agreed-upon issues Franklin Cabinets produced an estimate for approximately $(attached in respondent’s response) This estimate was only partial and didn’t include fixing esthetics as well as other issues we were having (e-mails 14, 15, 16, 17, and attached) In March of 2017, we sat down with Ninety Degree Construction to try to come to a resolution We were offered money to fix the mechanical issues but not the esthetic issues, etc Ninety Degree also offered the original cabinetmaker come out and make the necessary fixes Since the monetary offer wasn’t enough to fix all the problems, we agreed to allow the original cabinetmaker come back out to make fixes It took over a month just to schedule an appointment (e-mail attached).The original cabinetmaker came out to finally fix our cabinets on April 28th However, work could not be performed because I wouldn’t sign a new contract limiting what work was to be performed I just wanted my cabinets fixed properly, and I didn’t want to be held to only certain fixes.At this point, I just want my cabinets fixed We have been through hell We have been gracious to allow so many people into our home to try to fix the problems.Ninety Degree Construction has agreed to pay us $5,so we can secure proper and timely repairs We agreed to the settlement However, we cannot come to an agreed-upon written settlement agreement Respondent has uploaded their proposed agreement We, the [redacted] s, will agree to a settlement document pertaining to the cabinet issues only We will not agree to sign a document that supersedes our original purchase contract, as requested by the respondent.My last attachment is the settlement agreement that we will agree to I have made a couple changes to reflect that this settlement pertains to the cabinetry and that this contract will not supersede our original building contract signed in August of Sincerely, Ninety Degree Construction and the ***'s entered into a Settlement Agreement May 22nd, which includes the original cabinet complaint by the homeowner. Please find the attached fully executed Settlement Agreement along with a copy of the cleared settlement check, which cleared on May 26th, in the amount of $5,500.00. We hereby consider this matter mutually closed by both parties

Ninety Degree Construction has been in constant contact with Ms*** over the past year and a half regarding her home and her cabinets. We have had our cabinet contractor visit the home over times during that period to repair and replace numerous warranty as well as non-warranty
items. The contractor even went as far as to completely replace every cabinet face in the home in an attempt to appease Ms***. A bit of history to explain the attachments. You will find the signed walk-thru sheet that both Mrand Ms*** signed prior to closing on the home that states that they accept the home as finished and completeWe have this document signed so that buyers have a chance to address anything they feel is not complete or not finished, in which in this case the only thing that was not done was some exterior paint on the trim and re-hang the gutters. Both were delayed because of weather. Funds were withheld at closing to cover those items in case they were not complete, however, we did complete them and they funds were released (see Escrow release)The cabinet issue continued to persist as Ms*** felt overall that her cabinets were not "high quality", however, they are the same cabinet package that we install in all of our homes and the same quality she viewed in one of our model homes prior to the start of construction. In order to put some closure on the issue, members from Ninety Degree met with Ms*** in April of and created a punchlist of final adjustments that would need to be made to satisfy both parties(See #Revdex.com-Complaint Response).Ms*** refused to sign the document because she said there might be more adjustments she notices later. This never-ending cycle is what we wanted to end. Ms*** then presented us with a bid that a third party cabinet company gave her to make adjustments to her standard, including fixing esthetics (which is not covered by warranty). The total bid was $5,(see #Revdex.com-Complaint Response). Even though our bid from our contractor was $1,(see #Complaint Response), we agreed that this issue needed to be resolved so we told Ms*** that we would pay $5,to her to cover the costs, but we wanted her to sign an agreement that after the payment was made both parties would release each other from future liability and end this never ending cycle (see #Revdex.com Complaint Response)She again refused to sign.In the meantime, we have also complete her Year walk-through and she has signed it stating that all items they believe to be covered by the warranty are complete (see #Revdex.com-Complaint Response).At this point in time, we feel we have made every reasonable attempt to satisfy Ms***, however, she does not understand that we must also protect ourselves from the continued time and expense of trying to make her feel comfortable with something that is not covered by our warranty in the first place. We have stated to Ms*** that if she wants to make suggestions on how to modify the agreement then we would be open to reviewing those (See #Revdex.com-Complaint Response)Ninety Degree Construction is ready to move past this issue and has offered to settle with Ms*** even though we don't admit to any faultHowever, we are not willing to settle for any amount without an agreement in place to end this cycle of frustration.
