Initial Business Response /* (1000, 5, 2015/08/26) */
Please be advised that I am legal counsel for DDW Automotive, Inc("DDW")DDW
hereby disputes the complaint submitted by Mr***DDW performed all work and services requested by Mr*** in a workman-like manner, using reasonable
skill and care, and within the price set forth in its estimate to Mr***
By way of background, Mr*** is the owner of a Ford Class C, year
Motorhome During July of Mr***, a resident of the State of Virginia, was traveling to the State of Iowa for an extended visit due an illness in his familyMr***'s Motorhome broke down in the State of Ohio on his way to IowaThe Motorhome was towed,
with the driveshaft still being enabled, after it broke down in the State of OhioMr*** allegedly had the vehicle repaired in the State of Ohio and then continued his trip to Iowa
Unfortunately, Mr***'s motorhome broke down again in the State of Indiana due to a transmission issueMr*** contacted DDW in July of informing DDW
that the vehicle was being towed to DDW's facility in Osceola, IndianaWhen the motorhome arrived, DDW had previously scheduled work ahead of the motorhome and informed Mr*** that it would be a day or so before DDW's employees could diagnose the problem with motorhome's transmissionMr*** decided to rent a car to continue his travel to the State of Iowa
As promised, DDW diagnosed the problem the next dayDDW, by its President David ***, contacted Mr*** and informed him that the cost to repair the motorhome's transmission would be approximately $2,This price was quoted contemplating that DDW would rebuild the entire transmission from parts due to its uniqueness
During this conversation, Mr*** informed DDW that he had made an insurance
claim against the Ohio tow truck company's insurerMr*** alleged that the towing of the vehicle with the driveshaft being enabled damaged the transmissionDDW did confirm that the transmission was completely destroyed when they inspected the transmission
At Mr, ***'s request, DDW photographically documented the condition of the transmission when it was received by DDWDDW, at Mr***'s request, provided these
photographs to him, Mr***, in turn, sent the photographs to the Ohio tow truck company's insurerDuring this period of time, DDW had located a case which houses the transmission in Chicago, IllinoisPrior to the insurance company approving the work, the case was soldAccordingly, DDW located a new, remanufactured transmission for the vehicle from
AutoZoneDDW provided a revised estimate to the insurance company in the amount of $2,that reflected the increase in cost as a result of the new, remanufactured transmission (a true, accurate and complete of the estimate that was sent to the insurance company's adjuster, Maurice Flynn is attached hereto as Exhibit "1")The estimate was in the amount of $2,
The insurance company approved the claim and DDW installed the transmission at Mr***'s requestThe transmission carries with it a limited warranty from *** which is attached(a true, accurate and complete copy of the warranty is attached hereto as Exhibit
"2")DDW performed all work requested of it and installed the transmissionWhen Mr*** obtained the vehicle from DDW the transmission was operable and worked properly
Mr*** did allege that the vehicle was not driving properlyThe problem that Mr*** complained of concerned the engine of the vehicleIndeed, it is DDW's opinion that the vehicle was only operating on perhaps of cylinders at the time Mr*** provided the vehicle to DDWAs was explained to Mr***, DDW is not an engine repair shop but was only engaged to perform work relative to the transmission as reflected by the estimate
DDW ultimately charged Mr*** the total amount of $2,This is less than the quote provided to the insurance company(See, Invoice attached as Exhibit "3")
Please be advised that $1,of the money paid to DDW was actually funds that were payable from the Ohio tow track company's insurance carrierDDW received a check in this
amount from the insurance company and it was made payable to Mr***DDW forwarded the cheek in the amount of $1,810,to Mr***, Mr*** then deposited that check in his account and paid DDW the amount of $1,via credit card transaction on July 31, Mr*** then paid the balance due and owing to DDW of $on August 7, via another credit card transaction(See receipts of payment attached as Exhibit "4")
Please be advised that there is no basis for the complaintDDW performed all work pursuant to its estimateMoreover, the work apparently satisfied the Ohio tow truck company's insurance company as payment was made by the insurance company to DDWAccordingly, Mr***'s complaint is without merit
Initial Consumer Rebuttal /* (3000, 7, 2015/08/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The vehicle was not operable upon receiving it back from DDW The transmission would not shift from 1st, to 2nd, to 3rd automatically which an automatic transmission is suppose to do and it barely moved when in gear It had no acceleration when pushing on the gas which is the same issue it was dropped off with
The transmission would also not allow the vehicle to start in Neutral which it is suppose to do
Beyond those very Transmission related issues
The letter states the entire issue with the repair performed in it's own words, "Indeed, it is DDW's opinion that the vehicle was only operating on perhaps of cylinders at the time Mr*** provided the vehicle to DDW."
This states very eloquently the entire basis of my complaint the vehicle was running the same way when dropped off as picked up; therefore it leads me to believe it was not the transmission that needed to be fixed, but an engine issue the entire time as DDW States in their letter; however they did not state this until after taking full advantage of $for the transmission
If DDW suspected an engine issue at of cylinders when dropped off they should have made this clear immediately with their diagnosis, but instead they told me it was a Transmission issue and needed to be rebuiltThey were glad to assist with pictures for the damage claim, and were happy to receive the $from the claim and the $out of pocket from me
The day of pick upI told them it was not running correctly Then and only then did they state "it needed a tune up and was likely and engine issue and we're not an engine shop"
It is completely unethical in the repair business to take advantage of a situation where a customer states what they believe to be the issue, then when the fix does not 'fix' the issue as in the new Re manufactured transmissionthen blame the non-fix on an issue that they believe existed as they indicate in their own letterwas there when it was first dropped off!
It is my belief that DDW took full advantage of the situation knowing that I was from out of town, and that insurance was going to pay for some of the repair They choose not to say anything regarding the engine or cylinder issue until after they put in and were paid for a new transmission and labor which did not even fix the issue for which the vehicle was brought to them
This letter further does not address the behavior of Mr*** at DDW when he was upset at me for asking for the old Core of the old Transmission to both prove a new one had been truly put in and to receive the Core Charge Back from Autozone for which I paid He left for minutes making myself, wife and children wait for him to get back throwing a child-like tantrum
The bottom line of my complaint remains and is fully merited: DDW performed a 'repair service' and the vehicle was returned to me in the exact same condition with the exact same symptoms as when it was taken there In fact, in their own words they admit they believed it to be an engine issue (of cylinders), when it was dropped off, but choose to not reveal this until after taking $from me and returning a vehicle that sits at *** *** in Mishawaka
It is absolutely ridiculous that any repair-service business would state they performed repair and then give a vehicle back in the same condition and state it was in operable condition
To say that the vehicle was operable when picked upis a flat out lie My wife and children can attest to the vehicle barely making it out the parking lot and breaking down and having to be towed to its current position at Zoleman Tire
The fact of the initial complaint remainsthe vehicle was dropped off as not running, with my statement that there was no acceleration when pushing on gasIt was picked up at DDW after their 'repair'and had no acceleration when pushing on the gas The same problem for which it was dropped off at DDW and the same problem which DDW returned the vehicle
I fully expect DDW to refund the money for the repair that did not fix the issue
Final Consumer Response /* (4200, 12, 2015/09/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I wish there was a proposed solution to accept, but sadly there's no proposed resolution to the complaint
He is correct thought in statement which I had to confirm with my credit company, but yesI did file for the entire $with the Credit Card Company and indeed confirm that they did refund me based on all the information I submitted to them
TO that End the Credit Card Company has satisfied my claim for Financial Refund for the $NOT DDW
Furthermore, I still do not have the RV and it sits at *** Inc We received a Temporary Credit when I created the dispute which has now been finalized
While not necessary since DDW believes I used the money to gain some advantage here is a breakdown of what that temporary credit was used to accomplish in getting us back our home in Virginia:
Purchase a VAN to get us from Indiana to Virginia as the RV was not able to be driven when picked up from DDW We had to remove certain items from the RV to take back home (clothes, toys, etc)
Pay for Hotels since we were not able to camp in the RV on the way back to Virginia
Pay for Gas
Pay for Food since we were not able to cook on the way back to Virginia
The financial part of this is satisfied now through my credit card company; however the ethical part of this claim remains unresolved
HOW any business gives a vehicle back to a customer when it does not run after supposedly fixing it IF the vehicle was doing the same thing it was when dropped off, and if the transmission was doing the same thing it was when dropped offit can only lead one to believe that it was indeed NOT the transmission, but in fact a tuor engine issue issue all along
The Vehicle still sits at *** *** Inc on Mckinley Ave in Mishawaka, Is not running!
LOST in all this is that when picked upthey told me it was running the exact same way as when dropped offwhich means that contrary to their statement they did in fact start it and try to move it when first dropped off In fact I told them it would start and move some when dropped off
DDW took full advantage of this fact when I stated that it may be due to Towing with the drive shaft on when the fuel pump when out
What this business did is wrong, and they are in fact wrong with his Revdex.com reporting as wellin fact DDW appears to have dissolved and reorganized many times in various named formats similar to their current one..something I wish I would have looked at more closely before leaving my vehicle there! in fact when I first went to start this complaint an Alert was out on this Business stating "it may no longer be in business" and had an older address than the one I left the RV at
I was at the mercy of Roadside assistance, had to find and take it to the closest shop I could find which was DDW..and got back a vehicle that still to this day almost Months Later..still does not move and is stuck in Mishawaka, In at ***
Financially The Credit Card Company has taken care of my refund of the $so I no longer request DDW to refund that; however this complaint still shows ethically they know what they did was wrong
It also shows they had no intent on resolving the dispute and it is why I had to go through my credit card company to get the Refund!
Furthermore, when searching for a spot for roadside to take it DDW Automotive & Transmission is the name that comes up on their website listing This lead me to believe they handled ALL Automotive and Transmission issues NOT just transmissionYou can search this for yourself on Google.com Type in DDW Osceola, IN and DDW Automotive & Transmission will appear on the result set with a Phone number, hours, etc..which would lead most customers like myself to believe they can handle any automotive or transmission issue
Finally, what was done by this business is wrong My credit card company had to refund me financially and in doing so believed that the repair done at this shop was not done correctly to fix the vehicle since it was in the same state when dropped off
I hope the Revdex.com takes this into account when judging the resolution of the complaint there is no proposed resolution from the Business? They did what they did and 'that is that' is their attitudeI'm glad that this complaint can become a permanent part of the businesses Revdex.com record so other potential customer's will see it so it can serve as a warning
You are only as good as your last customeryears in business means nothing if you take advantage of anyone!
Final Business Response /* (4000, 10, 2015/09/09) */
I installed a remanufactured transmission from Auto zone The insurance company paid $towards the transmission Mr*** was to pay $ We did install the remanufactured in the motor home The original transmission was damaged beyond rebuilding with a new transmission case The RV was towed to our shop (DDW) because the RV would not move because of transmission damage NOT because of the engine running poorly Mr*** was aware of this We are a transmission shop, not a engine tune up shop Our sign reads DDW Transmission NOT DDW Transmissions and tune up shop We did not know how bad the engine ran when the RV was towed to our shop, we could not move REV because towing company removed the driveshaft We removed the transmission pan and determined that yes there is a internal problem with the original transmission Mr*** made a claim against the towing company in Ohio because he believed that they damaged the transmission by owing he RV with the driveshaft installed the first time it broke downDDW Automotive never started the engine before the original transmission was removed because the driveshaft was removed We didn’t know that the engine ran poorly until after we installed the remanufactured transmission Yes It would not shift because of VERY poor engine performance The insurance company paid $toward the remanTrans Mr*** was to pay $ Mr*** stopped payment on the that the insurance company paid and not the remainder $Why??? I that that Mr*** committed insurance fraud
DDW Automotive has been in business for years We have a very good reputation and to my knowledge we have never been turned into the Revdex.com from an unhappy customer We ALL know that we can’t make everyone happy I believe that Mr*** is not mechanically inclined enough to know how a transmission needs a engine that runs properly to make it shift I’ll bet that after *** tuned the engine that transmission did indeed ship 1-2- DDW did NOT scam Mr***, NOT I’m sure Mr*** will still complain when the Revdex.com contact him with this response He’s a good talker but please look at my side of the story Why did he not demand the whole $2411.92? He committed insurance fraud for $ Now please let this matter be DONE Thank you for listening Dave at DDW
