Review: Mr. [redacted], owner of NJ Yacht sales Inc, (AKA New Jersey Yacht Sales; AKA Total Marine) advertised a 2007 Sea Ray boat for sale on the website www.yachtworld.com where he placed in writing the boat had 100 hours running time on the engine (the equivalent of a cars odometer reading). I inquired about the boat speaking with Mr. [redacted] many times via phone. I asked many questions about the boats condition and the hours on the engine. Mr. [redacted] assured me over and over the boat had "about 100 hours" on it and that there were some repairs to the body of the boat that needed to be completed. I asked about the mechanical operation of boat and he assured me that the "boat runs fine" and it needed a total of (in his professional estimation) $2,000 to $3,000 in total repairs - all of which were for fiberglass repairs to the body of the boat.

I purchased the boat based on Mr. [redacted]'s representations of its condition, both on the website listing and verbally. After having it shipped to me, placing the key in the ignition, the boat had 259 hours on the engine - not 100 as he assured me. Also the boat required nearly $5,000 in body repairs and furthermore would never operate properly due to overheating problems - cooling systems issues. The boat now has a cracked block due to cooling system malfunction and requires a new engine. Total repairs charges for the body work and mechanical are now in the $20,000 range - not $2,000 to $3,000 as Mr. [redacted] professed to me as accurate.

While the NJ Attorney Generals Office found fault with Mr. [redacted], they could not force him to make any payments related to this matter.Desired Settlement: I would like Mr. to refund my purchase price, including the costs of shipping and all of the repair costs I have paid for this boat. I will get an exact figure once the current repair work is complete but expect the total number of purchase price shipping and repairs to be approaching $40,000.

Alternatively, if Mr. [redacted] had been honest about the hours on, and condition of the boat, the resulting offer would have been $10,000 less than my previous offer for the purchase. He can refund to me this amount ($10,000) and I will keep the boat.

mr. [redacted] purchased this boat that we were representing in absentia. he had asked me what I knew about the boat and I told all that I knew of the boat which included that this boat was damaged in hurricane sandy. that information was fully disclosed to him verbally by me. I told him all that I knew of the boat which was not all that much(basically what the eyes could see). we always encourage our buyers to have a marine survey and or a mechanical inspection by qualified marine technicians. mr [redacted] decided not to have any of this done. he also decided not to come see this boat with his own eyes. he was making this purchase basically in the blind. I told him and provided detailed photos of all that I noticed as far as damage. I also had the seller of the boat run the boat on land and do some maintenance to it before the transaction was completed, so that I knew before it left that it was running correctly. the engine in this seemed to be running very well when it left new jersey. regarding the difference in the engine hours...I was unaware of that there were more than what was told to me by the seller. the engine hours on this boat are still considerably very low. average engine ours are typically between 50-100 hours per year, which would be appx 350-700, and this boat only had 259 as mr [redacted] stated. we are sorry that there was a discrepancy in the hours, as it is what we were told as well. if there is a problem with the engine now in this boat, it had to have happenned after mr [redacted] purchased it, as I previously stated, it seemed to be running well before it left nj for tennessee. we have been selling boats since 2001 and I personally have sold over 1500 boats since 1996. we would never want a buyer to be less than happy, but of course this does happen. mr [redacted] should have had a marine survey and a mechanical inspection on this boat prior to completing his purchase. this is common practice in the marine industry and he knows this because we spoke about it. in the advertisement that he found this boat on(yachtworld.com), there is a disclosure at the bottom of every advertisement that states roughly ,"the information that is provided is believed to be accurate but can not be guaranteed. all buyers should have a marine survey and do their due dilligence ensure the accuracy of the information provided'. also mr [redacted] signed the closing statement before he wired the final payment, and on this closing statement it states that "this boat was purchased without the buyer doing a marine survey/inspection". we are very sorry that mr [redacted] is not happy with his purchase, but maybe he should act accordingly here by being accountable for the fact that he made this purchase without looking at it in person and without having any kind of inspections or a marine survey. also something that needs to be noted is that I personally reached out for mr [redacted] at least 10 different times after he received the boat and told me that he was not happy. I reached out for him by phone, email and text.......he never responded back with the exception of one time to ask a question if I knew if there was any water intrusion in the engine room(this was by email). I asked him repeatedly to call me back and he would not. we are brokers for boats. the same as real estate agents are for homes. we dont own the boats or maintain them. we advertise them and hope to sell them for the sellers.would a home buyer expect his realtor to pay for a new roof on a house that he purchased? especially if the buyer never had a home inspection or came to look at the house before he finalized the purchase?????????? how in any way shape or form could the real estate agent be at fault??????????????? mr [redacted] unforntunatly made a bad decision to not come see the boat and not have any type of inspections. I TEACH ACCOUNTABILITY TO MY 8 YR OLD CHILD MR [redacted], ITS TIME FOR YOU TO BE ACCOUNTABLE FOR YOUR LACK OF DUE DILLIGENCE!!!!

I am rejecting this response because:This is pretty simpleMr. [redacted] displayed an ad with false information - albeit with a disclaimer in the fine printMr. [redacted]s disclaimer applies to the advertisement (I'm not saying it absolves any liability)- it does not extend to his many false assertions regarding the condition of the boat in question.By enthusiastically answering my many questions with much confidence about the condition of the boat, Mr. [redacted] assumed responsibility for my knowledge. Not covered by his legally questionable disclaimer. Regarding my questions of engine hours, running condition, physical damage: He never once stated he "didn't know", or he was "unsure" - he always had a confident answer. Engine hours were "about 100"; "the boat runs fine"; "It will cost $2,000 to $3,00 max to fix the boat" "body damage only"..and so on. He never stated I should have an inspection, quite the opposite as he discouraged me from getting an inspection. When I asked about one, his exact response was "only if you want that warm and fuzzy"(feeling). My huge mistake for certain. FYI, I ordered a new engine today. Installed it's about $9,000 for a remanufactured (used) one. Having looked inside the boats engine as it has been disassembled, it is so clogged with rust, it is impossible to run without overheating. Yes, I ave photos. Mr. [redacted] mentions the closing document, I have attached the addendum to the document which I signed and sent. Knowing I was taking a chance, I hoped he was someone of good character. He never responded to, nor refuted any information on that document. Mr. [redacted] is a man lacking in moral and ethical character. I feel sorry for his 8 year old. Mr [redacted] should read the definition of accountability; also honesty and integrity as long he has his dictionary open. I stopped corresponding with Mr. [redacted] for the same reason I would stop putting lemon juice in a cut. It just felt better, and it was a painful & useless exercise. This will end up in court.
