Review: I purchased an automobile and a two year extended warranty in May 2014. In June of 2015 the automobile was involved in an accident and deemed a total loss by the insurance company. From past experience I knew that I was due a refund on the unused portion of the extended warranty. After contacting the warranty company they confirmed that we were due a refund based on a prorated rate on the total amount of what I paid for the warranty. Their contract also states the same. They informed me that I had to go thru the dealer for the refund and what paperwork needed to be submitted. I gave the dealer all the necessary paperwork. After a month of no response I called the warranty company. They informed me that the dealer never submitted any paperwork. I went back to the dealer and requested he resubmit the paperwork. He did. The warranty company issued him a refund based on what he paid for the warranty prorated based on time left on the warranty. He then was supposed to use that same rate and issue us our refund based on what we paid. We paid $1,000. He also said he refuses to refund me anything because the amount paid for the warranty was financed. The insurance company has already paid the finance company in full, so the refund is due us as confirmed by the finance company. I have all the documentation as well as emails to substantiate this claim. Also, he emailed me the breakdown from the warranty company of what he was refunded. On it states that the refund they issued to him was based on a purchase price of $495 which means he profited $505 on the sale of this warranty. He is not allowed to keep that entire profit. Part of our refund due is supposed to come from that profit. Again, the contract states he must refund me for what "I" paid for the warranty. We have spoken to other dealers in the area who have confirmed that is the procedure as well.Desired Settlement: Based on the prorated rate determined by the warranty company we are due a refund of $456.90 less a $50 processing fee for a total refund of $406.90. Thank you

Response:

[redacted] bought a 2004 Volvo from us. We, as a dealership have a flat fee for registering the vehicle in NY State. This fee includes vehicle inspection, registration fee as well as fee for the title. Originally, [redacted]’s vehicle was supposed to be registered in NY so he was charged the registration fee. We issued the NY plates but since he had Pennsylvania driver’s license he was missing one point to be able to register the car in NY. He said that he will provide us with that. Then he informed us that he will probably register the car in Pennsylvania. We attempted to contact him on multiple occasions but we were not able to get hold of him. We were finally able to contact him and he told us that now he lives in Florida. We agreed that we will send the [redacted] to pick up New York plates that we issued and we will send him all the paperwork including title and refund for registration fees since he will not be registering the car in NY. Till this day we are trying to contact him but even on the phone number provided with Revdex.com we are not able to reach him. We have all the proofs that we were reaching out to him. List of phone calls as well as tracking number for [redacted] and [redacted] . We want to resolve this problem as soon as possible and we have no intention to keep his $350 registration fee.
