we have sent out check for town fees via certified mail on Monday 3/*/along with original paper work.we are trying to set up time and date to correct tile issue, Client is getting back to us with time that works for her and her schedule, we called again today to set up

This simply put is a misunderstanding, Paid receipt has been sent out to client, No mechanical sub ever threaten to put lean on home, we have explained to client that grout cracking after new construction is and we are trying to make appointment to fix issue but clients schedule is
very busy. The condensate pump freezing up is not a design flaw or install flaw it is due to sub-frigged temps and has been addressed at the moment client called but they have not been available to have us correct The a/c condensers is my fault totally, I put them on side yard rather than rear yard due to being right off there patio doors and deck I tried to do the right thing not even realizing it would be a variance for side yard set back with the room they had.I accept the issue as mine and let the client know I will fix issue and move units to rear yard and cover cost to do soWhen I called client to discuss they said they didn't put compliant through and I'm waiting to talk to them both together to retract this complaint Noah Construction stands behind all work, and prides itself on customer service, we are working diligently to correct this clients issues in a timely fashion but weather is an issue as well as access to home

We were able to come to an alternate resolution.  The attached document (a copy of which [redacted] signed, scanned and emailed to me) outlines the details he has agreed to, including covering the cost of the architect and town permit fees and repair of cracked grout in the coming days.  This issue will be resolved once the promised check is in hand (latest by 3/*/15) and work has been completed.

Review: Multiple problems:

1) Since December **, 2014 have failed to provide "paid in full" statement, as requested 12/**/14, 1/*/15, 1/**/15, 1/**/15, 2/**/15, 2/**/15 and 2/**/15, both via phone and email. Most recent requests, no response at all. Our agreement clearly states we are entitled to such a document. Since several of their sub contractors have contacted us in the past about Noah not properly paying their bills and wanting to put a lien on our house, we would like such a statement should such a situation arise in the future. They cashed our final check Dec 2014.

2) No response to our complaints about cracks in bathroom grout around the window. Pieces of grout have fallen out. Potential for water to get under grout on window sill and cause damage to underlying wood structure. This follows multiple problems with the grout, tiling and structures in this bathroom. Sub contractor/ tile guy came back multiple times in August. However, tile is still crooked, grout not properly installed, window sill/frame is crooked. [redacted], the [redacted] of Noah, has not been back to our home since August and has never seen the problems.

3) Informed Noah about freezing line from new furnace in February 2015. Initial complaint about improper installation of furnace was in September 2014. Received a call from plumbing sub-contractor concerning frozen line coming from new furnace. Noah has not followed up with us concerning this design flaw.

4) A/C units were not installed according to plans/permits. Home[redacted] never authorized these changes or was made aware of possible permitting issues. CO from town was denied. Moving forward with architect to have him meet with town to resolve situation since we got no response from Noah. We will be billing them for any additional work that needs to be done, including architect and town fees as it relates to change in plans.Desired Settlement: We would like our paid in full statement to close out our records.

We would like Noah to send a different grout/tile guy to repair cracks or have Noah agree to pay bill to have third party tile/gout guy fix problem.

We will work directly with plumber. Any additional cost to us will be billed to Noah.

We would like an agreement from Noah that they will pay architect/town fees for proper permitting.
