I am rejecting this response because: The statements made by the author of the response Kevin N*** are falseI have the check register which clearly indicates the check number, amount and the name of the recipient Ali A*** for the tipHe had promised he would share it with the crew.
#*** Tip $Payable to Ali A*** on 10/25/See attachmentMy arborvitae bushes were severely chopped and I was told about itWhen I found out and questioned Ali A*** he responded that he told the crew to cut them in order to stain the exterior side of the deckHe said I should not worry about them as "they will grow back" Indeed they grew back and the holes opened by the cut branches are now widerNolan did not fulfill its two years warrantee because each time they came to correct the their defective labor they spot-painted instead of painting the entire wallAs a result the paint flaked and bubbled in a new spotI tried to explain this their crew supervisor Conal M*** but he refused to do the repair rightI have never called their workers names, or insulted, that is simply a lie; to the contrary I have been very kind and trusting of them..

I am rejecting this response because:The job on *** *** *** *** with Nolan Painting was not performed with good and honest workmanship by good and honest workersIt's so called "warrantee'' followed on their very same principles; selling the cutover , rather than servicing the customerTo convince the customer why the paint job cannot look right, instead of doing the paint job rightThe Nolan "crew leaders" and "supervisors' performed a lip service, rather than a service; I was charged an exorbitant amount of money to paint the exterior of a small home that the paint wore off as fast as the paychecks cleared

having been done 5 years ago. Nolan Painting offers a 2 year warrantee, see below: .Limited WarrantyNolan Painting Inc.'s warranty covers labor and material for a period of 2 years. If paint failure appears, we will supply labor and materials to correct the condition without cost. This warranty is in lieu of all other warrantics, cypressed or implied. Our responsibility is limited to correcting the condition as indicated above.This warranty excludes — and in no cvent will Nolan Painting Inc. be responsible for -- consequential or incidental damages caused by accident or abuse, normal wear and tear, temperature changes, settlement or moisture; i.e., nail pops or cracks caused by expansion and/or contraction. Cracks will be properly prepared as indicated at time of job, but will not be covered under this warranty,The exclusion also includes: Painted or stained horizontal walking surfaces (i.e. decks, floors and steps), dirt and mildew accumulation; paint failure due to rotted wood, structural desects, moisture intrusion, failure of previous paint coatings and insect infestation.we did come back during the warrantee period and take care of any issues that were pointed tout to us. Customer was hard on our people and made us redo and come back many times, which we did.Customer called Nolan Painting employees names and insulted them. Many of the customer's Statements are untrue, Ali has no memory of receiving a tip. If he had received one, he would have shared it with his coworkers.All did not cut any shrubs.I did speak with the customer on the phone in late August 2014. This was the first time the customer had contacted Nolan Painting since the warrantee period ended (2011). The customer said my people were bad workers and had a bad work ethic. Review: I hired Nolan Painting to repair and and repaint the exterior of my home.

- Their salesman Jon M[redacted] did not state that the garage door is included/or excluded. It was my clear and logical assumption that all the exterior will be repaired and repainted, garage door included.

When the Nolan crew came to perform the job I questioned their crew leader Ali A[redacted] why the workers were not prepping the garage door. He said it was not included in his order and if I want it painted it will cost an extra $300.

-They were contracted to re-stain the deck but failed to stain the exterior side of the railing. When I pointed out that they missed it, without my approval Ali A[redacted] ordered the painters to chop my mature arborvitae bushes in order to paint the railing. The railing was easily accessible without the need to damage mature landscaping. Up to this day the bushes have not re-grown and the holes resulted in loss of my privacy from the neighboring driveway.

-The painters painted over all draining holes in the window frames which resulted in getting water damage in the living room wall during a rainstorm and wood rotting in more than one windows.

-Nolan Painting charged $7,300 to repair and repaint the exterior wood siding of my small house but their work failed miserably. The paint bubbled and peeled just a few months after the job completed in several walls. While I was within their warrantee period I asked them to repaint the problem walls. Each time their field supervisor Conal M[redacted] came out to observe the problem area he'd approved only spotty repairs and refuse to have the wall properly sanded and painted. As a result the paint will bubble and peel in a new spot in the same wall shortly after. Each time he had a different excuse as to why the paint did not hold up. First he said "Paints are no longer lasting because they do not contain lead" Next he said the wood siding is old and paint will never look perfect. None of these statements were mentioned prior to hiring them to do the work.

- When I paid the last installment I tipped the workers with a separate check for a $100 which I handed to Ali A[redacted] asking them to buy lunch for the crew. Despite his promise to do so he never did. He kept the tip for himself.

- I had to have the garage door repainted as Nolan's paint came off and the wood revealed was rotted. The new painter pointed out that Nolan had not prepped the door properly and the old dark green paint came out in large pieces. I took pictures and send them to Nolan requesting that the owner meets me at my house to observe the work and work out a resolution. Kevin N[redacted] called and told me he is not willing to do so.

My complaint goes much further than "improper or inferior repair" It includes "a sales representation that misrepresents the service" and "repairs that resulted in additional damage"Desired Settlement: want my money back
