Nor-Cal Restaurant Design

Review: On Oct/17/2014 Mr.[redacted] of Nor-Cal Restaurant Design agreed do the drawing of hood and grease trap of my restaurant ,required by The City of Oakland and Alameda Health Dept for the amount of $1200.Which we had a written agreement and I paid him on that day in full.He agreed to finish the drawing within a week,but,he did not summit it until Nov/19/2015.Later,when the Health inspector did not approve his drawing,he asked for additional $900 to get the job done,he is even asked me to pay for blue print of $49.85 out of my own pocket!I had no choice, but paid other $900 for this project to go on...Desired Settlement: I would like Mr.[redacted] to refund the $900 which I have overpaid him,and the $49.85 for the blue print.So,the total of refund that I am asking is $949.85-

Dear, Mr. [redacted] The following letter is a response to your letter dated March 20, 2015. I received your letter regarding the business call [redacted]. Mr.[redacted] the owner did not tell you the whole story about why he had to pay the $949.85. Our original agreement was $1,200.00 to the drawings for his project. When I meet with him and pervious owner, they had a sketch on what that wanted the new layout to be. Now I went with their layout. After the heath inspector did not approve it, Mr. [redacted] wanted me to redesign the new layout for free. I told him “I would not do it for free”. Now Mr. [redacted] and the pervious owner could have simply went to another design if they choose to do so. I did not hold a gun to his head. I simply told him the additional cost would be $900.00. He agreed to this amount and wrote me the check for the re-design. You confirm this with Mr. [redacted] of the Alameda County Health Department. I do not work for free. He could’ve simply said no. Also I told him that he would have to pay for his own printing. I did my job become after I re-design the plans were approved by both Alameda County Health and the City of Oakland. I am rejecting this response because:the fact is:Mr.[redacted] agreed to do the drawings approved by both city and health department for $1200 in writing.then he delayed the work about a month,which costed me one month rent,and the health inspector did not approve his drawings,because he placed mop sink and water heater right next to a commercial hood and deep fryer.and then,he asked for another $900 to correct his own mistake.

This is the bottom line Mr. [redacted] agreed to paid the additional $900.00. I did not force him or hold a gun to head. He had the options 1# Go hire someone else.option 2#. Agree to pay the additional $900.00. This was not my mistake, him and the previous owner agreed to the layout. This is the last time I will comment on this matter. If Mr. [redacted] would like to settle this matter in a court of law. Then that works for me.

I am rejecting this response because:Mr. [redacted] were supposed to do alldrawing required by The Alameda County Health Department and the City ofOakland for $1200 according to the written agreement ,when The Department ofHealth asked him for correction, he should not be asking for additionalpayments.He said that if I did not give him another$900, then he will not finish the drawing for me, which means I wasted onemonth of time and $1200 for nothing!He took the job on Oct/17/2014, and said hewill get it done in couple of days, but, he did not summit the drawing untilNov/23/2014.
