Initial Business Response / [redacted] (1000, 10, 2015/06/05) */ There are several issues and dates that are incorrect as stated by [redacted] regarding his purchase of an actual Brand New (and quite rare) Nordic Track Pro ski machine This is only the second actual New unused Nordic Track that I have offered for sale in the last yearsThe Original Chaska, Minnesota made Nordic Track ski machines have been out of production since I have sold and shipped approximately 6,+ restored, refurbished, and repaired Original Nordic Track ski machines since they went out of business and sold the name Nordic Track to Icon Fitness in Utah Mr [redacted] first contacted me in June of the year and asked if he could make payments on the only New Nordic Track Pro that I then had in inventoryMy usual inventory of ski machines varies from to used machines but I had just the one New Pro model that I acquired from a couple in Northfield, MN who got it from the Original Nordic Track Company as a brand new replacement for a ski machine they were having problems with Whatever the problem they had with their Origianl purchase ended up being resolved befroe they ever opened the box of the replacement, which they ended up keeping in storage for several years until I bought it I agreed to accept payments over a reasonable amount of time and Mr [redacted] sent me a check for as first payment towards the plus shipping for a total of This payment is dated 7/26/on the envelope which I still have There is quite a discrepency as to the dates referenced by Mr [redacted] He states he first contacted me in 2013, yet his dated check for the first payment is on 7/26/It took him almost years to finally finish this transaction For some time it looked like he abandoned his interest in finishing the transaction and I thought he would probably just ask for his payments back which totalled His second payment of is dated 8/15/on the envelope His 3rd payment for is dated 3/1/and it appeared as though had abandoned the transaction Now years go by from 3/1/and he, by his own admission , had other priorities and the ski machine was way down his list of priorities and he had let it go for so long that he did not think he would ever have the money to complete the transaction anywaySo after these years and some months he wants to finish the transaction I had held the New Nordic Track for nearly yearsI did let him know that I was in the middle of my usual Spring order queue which can be as long as weeks for customers that Have Already Paid and are in the queueAlso , I was still recovering from knee replacement surgery and so am a bit slower but all my costomers were aware and OK with thisHe said no problem with a delay in shipping and finally sent the last payment of which is dated on the envelope as 3/20/or years and months from his first contactWhile I was shipping through the order queue he was anxious about the wait so I agreed to give him a choice of a Free pulse ring, a pulse watch, or a pulse strap and monitor system as compensation for the delayAll he had to do was let me know which one he wantedHe did not let me know his choice even up to his shipment date so I decided to send it later after he chooses one of the types of pulse monitoring It does require some athletic coordination to use these ski machines and they are not for everybody but most of my website customers really know what they want in the now last generation vintage market and are buying thier 2nd or 3rd machine to replace aging equiptmentI have a devoted customer base who generally appreciates the restoration work that I doAnd these machines are still very viable, in fact , my largest identifiable group within my customer base are Medical Doctors who realize the low impact nature of the Original Nordic Track machinesMr [redacted] claimed that the New machine was defective but based on his explanations it is clear that he is not willing or able to master the simple forward backward motion with simple resistanceMore than million of these machines were sold through the 80s and 90s and it is a proven exercise platformHe said it was missing a metal piece on the skiThere is no metal on the skis and I beleive he is referring to the hard wax inserts on the ski sides which sometimes fall out during shipmentThese are designed to wear down and leave a slight wax coating on the wood inner sidesThey have nothing to do with the performance of the machineHis machine was tested before shipment and worked excellentHis description of what he describes as "the skis coming out from underneath you" is a description from someone who very probably has not tried it yet and is unwilling to do soOr he will not read the manual which describes the simple sliding resistance clip (no moving parts - just a self tensioning metal clip that slides up and down the upright)I offered unlimited phone support to walk him through any problems, a free video for beginners, new skis, and of course agreed to send the 2nd set of grips which I had by mistake not sentI made sure that it was not damaged in shipment and he agreed At this point I submit verbatim actual emails from [redacted] ( below ) which may explain my reaction to Mr [redacted] 's last communication with me Exhibit #email from [redacted] (actual email forwarded to [redacted] and marked as exhibit #1) "Yes, I did respond about the pulse watch on Apr 10th but forget about the grips and the watchI'm disposing of the skier." When Mr [redacted] sent this last email stating that I should "forget about the grips and watchI'm disposing of the skier." He brought this payment issue up, not me His last ski machine purchase from Icon fitness of a new Classic Pro was , amazingly, defective and he was told by the Cotechnician to trash this brand new machine for a full refund as explained in his email to me in July So now he has brand new ski machines from different Companies and he was refunded by the first and told to "trash" the machine Now his second purchase of a brand new ski machine is according to him "excellent junk" and he wants another full refund from my Company right about the time his last free machine from Icon Fitness years ago is probably wearing out Finding a brand new ski machine when these have not been manufactured since is no small taskIt is ridiculous of him to say that this new Original Nordic Track is junk when it was sourced , verified, checked out ,and thoroughly tested by me I have hundreds of testimonials from customers all over the U.S., many posted on my website and all kept for perusal at any timeI have sold products on eBay for years and my rating is still 100% with thousands of sales and not one single unresolved problem I again offer a no charge replacement with free shipping in exchange for the returned merchandise I do ask that he use the same double wall box and packing materials that were used to safely ship the machine to him This transaction has now gone on for more than years including the several years it took for him to complete paymentMr [redacted] has threatened me with legal action , the state police,and the Revdex.comI believe this represents a fair settlement offer

have offered for sale in the last 14 years. The Original Chaska, Minnesota made Nordic Track ski machines have been out of production since 1997. I have sold and shipped approximately 6,000 + restored, refurbished, and repaired Original Nordic Track ski machines since they went out of business and sold the name Nordic Track to Icon Fitness in Utah..

Mr [redacted] first contacted me in June of the year 2012 and asked if he could make payments on the only New Nordic Track Pro that I then had in inventory. My usual inventory of ski machines varies from 250 to 325 used machines but I had just the one New Pro model that I acquired from a couple in Northfield, MN who got it from the Original Nordic Track Company as a brand new replacement for a ski machine they were having problems with . Whatever the problem they had with their Origianl purchase ended up being resolved befroe they ever opened the box of the replacement, which they ended up keeping in storage for several years until I bought it.

I agreed to accept payments over a reasonable amount of time and Mr. [redacted] sent me a check for 40.00 as first payment towards the 799.00 plus 79.00 shipping for a total of 878.00. This payment is dated 7/26/12 on the envelope which I still have . There is quite a discrepency as to the dates referenced by Mr [redacted]. He states he first contacted me in 2013, yet his dated check for the first payment is on 7/26/12. It took him almost 3 years to finally finish this transaction . For some time it looked like he abandoned his interest in finishing the transaction and I thought he would probably just ask for his 3 payments back which totalled 165.00 . His second payment of 50.00 is dated 8/15/12 on the envelope . His 3rd payment for 75.00 is dated 3/1/13 and it appeared as though had abandoned the transaction.

Now 2 years go by from 3/1/13 and he, by his own admission , had other priorities and the ski machine was way down his list of priorities and he had let it go for so long that he did not think he would ever have the money to complete the transaction anyway. So after these 2 years and some months he wants to finish the transaction . I had held the New Nordic Track for nearly 3 years. I did let him know that I was in the middle of my usual Spring order queue which can be as long as 3 weeks for customers that Have Already Paid and are in the queue. Also , I was still recovering from knee replacement surgery and so am a bit slower but all my costomers were aware and OK with this. He said no problem with a delay in shipping and finally sent the last payment of 713.00 which is dated on the envelope as 3/20/15 or 2 years and 9 months from his first contact. While I was shipping through the order queue he was anxious about the wait so I agreed to give him a choice of a Free pulse ring, a pulse watch, or a pulse strap and monitor system as compensation for the delay. All he had to do was let me know which one he wanted. He did not let me know his choice even up to his shipment date so I decided to send it later after he chooses one of the 3 types of pulse monitoring.

In response to Mr. [redacted]'s charges that no manual was sent I looked up the check off shipment list and I show it was included . It was never mentioned until now for some reason. I print these manuals in the 100s and I can send another. Mr. [redacted] blames me for not reminding him to make payments. There was no payment schedule. If he was supposed to pay monthly then he missed 6 payments between 8/15/12 and 3/1/13. Then he missed 23 payments between 3/1/13 and 3/20/15. Did he really need me to remind him that he missed 29 payments? He brought this payment issue up, not me.
His last ski machine purchase from Icon fitness of a new Classic Pro was , amazingly, defective and he was told by the Co. technician to trash this brand new machine for a full refund as explained in his email to me in July 2012. So now he has 2 brand new ski machines from 2 different Companies and he was refunded by the first and told to "trash" the machine . Now his second purchase of a brand new ski machine is according to him "excellent junk" and he wants another full refund from my Company right about the time his last free machine from Icon Fitness 4 years ago is probably wearing out . Finding a brand new ski machine when these have not been manufactured since 1997 is no small task. It is ridiculous of him to say that this new Original Nordic Track is junk when it was sourced , verified, checked out ,and thoroughly tested by me.
