MAR We at Tel-A_Rent do our best to resolve customer issues hence our rating and business longevityWe have been serving SW Missouri for over years and recently have been voted the BEST in RTO in SWMOAs per the complaint, we take the term harassment seriously and the actions that constitute harassment and therefore have never violated fair debt collectionOur contracts have NO grace periodTherefore if an account becomes one day late, legally, the item(s) legal ownership belongs to Tel-A-Rent, that being said, we try to work with customers at all costs and picking up our property is always a last resortMs [redacted] claims that she has given Tel-A-Rent the right to process payments on a debit card via auto-payment clauseShe states that we are processing the payment on the wrong date and/or later than usual or requestedAs any company who processes any kind of payment knows, sometimes actual processing times may varyAs an example: If a customer was to come in and pay a payment today, such payment MAY or MAY NOT appear on their bank statement immediatelySome banks are slower than others on processing timesWith our system, once a payment is processing, it may take 1-days to clear and post to their account(some prepaid bank cards have been instant, and other banks have been much slower depending on their location, processing times, and whether or not a weekend was involved) That being said we have no control over processingHowever, it is the sole responsibility for the customer to properly balance their account and assure that the funds promised are always available in the accountIn other words if a customer has only $in their account and promise $(or know an auto debit of $is coming out of their account soon) It lies solely on the responsibility of the customer to assure those funds are not touched and available for the proper processing of the draft regardless of when it posts to their accountShould several days go by and the money has not been drafted from the account, it does not make it ok to spend the monies because " it was not done in a timely manner"Instead a customer should call and ask why the funds have not been draftedThe money promised should always be availableThat is basic banking, proper account management and maintaining of a personal banking ledgerFurther, resolving of issues involves both partiesWhen the customer will not listen to reason, want to talk, or come to a common ground for resolution, problems can never be solvedMs [redacted] cannot communicate properlyYells, or simply hangs upThere is not resolving without calm negotiationTo address the issue if talking to minors, we are unaware of any driver ever doing thisA minor nor anyone not on the contract should ever attempt to communicate or talk about a contractual agreement they are no part ofDrivers have no way to tell the age of a party nor do we ask for ID'sIf a party wants to talk about the account, argue about an account, or engage in any conversation about an account it is solely at their discretion as we cannot control this, but our drivers simply must leaveWe have been taunted by these customers by making statements that nothing will happen, or that we have no legal right to take our property which is falseDue to this situation, yes, we must take proper legal actionsStarting with calling the police to make a report about failing to return rental property (also can be constituted as stealing)A felony in the state of MO(Missouri Revised Statutes - § — Failure to return rented personal property--prima facie evidence, when--law enforcement procedure--penalty--venue--notice, contents--exception& Section Beginning January 1, 2017--Stealing leased or rented property--evidence of intent to violate, when--law enforcement procedure--venue--penalties.) Therefore if an account becomes one day late, legally, the item(s) legal ownership belongs to Tel-A-Rent, that being said, we try to work with customers at all costs and picking up our property is always a last resort. Ms. [redacted] claims that she has given Tel-A-Rent the right to process payments on a debit card via auto-payment clause. She states that we are processing the payment on the wrong date and/or later than usual or requested. As any company who processes any kind of payment knows, sometimes actual processing times may vary. As an example: If a customer was to come in and pay a payment today, such payment MAY or MAY NOT appear on their bank statement immediately. Some banks are slower than others on processing times. With our system, once a payment is processing, it may take 1-3 days to clear and post to their account. (some prepaid bank cards have been instant, and other banks have been much slower depending on their location, processing times, and whether or not a weekend was involved) That being said we have no control over processing. However, it is the sole responsibility for the customer to properly balance their account and assure that the funds promised are always available in the account. In other words if a customer has only $100 in their account and promise $50 (or know an auto debit of $50 is coming out of their account soon) It lies solely on the responsibility of the customer to assure those funds are not touched and available for the proper processing of the draft regardless of when it posts to their account. Should several days go by and the money has not been drafted from the account, it does not make it ok to spend the monies because " it was not done in a timely manner". Instead a customer should call and ask why the funds have not been drafted. The money promised should always be available. That is basic banking, proper account management and maintaining of a personal banking ledger. Further, resolving of issues involves both parties. When the customer will not listen to reason, want to talk, or come to a common ground for resolution, problems can never be solved. Ms [redacted] cannot communicate properly. Yells, or simply hangs up. There is not resolving without calm negotiation. To address the issue if talking to minors, we are unaware of any driver ever doing this. A minor nor anyone not on the contract should ever attempt to communicate or talk about a contractual agreement they are no part of. Police are allowed to mediate. Further proper legal notation will be entered by a peace officer to support the case. We are within our legal right to call city or county police. When it gets this far, this is not a threat but rather a notice of something that is getting ready to happen. Tel-A-Rent will not simply close the account. A contract was signed and all monies are due, further there is never "interest" on a contract as this is not a credit card or bank loan. ALL Rent to own contracts are a set amount for a set period of time. No more no less. The only other fees that could be involved are late fees for failure to pay on time. Again, we do not calculate interest as these are not interest bearing contracts. Currently the amount to pay off account is $388. Due to the situation I will agree to let my manager settle for a lump sum (no payments) of $100 cash...even (NOTE: plus card fee of $1. Total $101 if paid with card over phone or otherwise) to close this account. No further action will be needed.
