Below is our follow up response for the complaint ID # [redacted]: Thank you for providing us with the opportunity to address this customer’s follow up to our response. North Star Finance, LLC dba North Cash (the “Company”) is a tribally owned and operated entity of the Fort Belknap Indian Community (the “Tribe”) on the Fort Belknap Reservation (the "Reservation"). The Company is wholly owned by the Tribe, was established for the Tribe's economic benefit, and is organized under and operated pursuant to Tribal law.  As an economic arm of the tribe, the Company shares the Tribe's sovereign immunity and, therefore, is not subject to state investigative or enforcement actions. While state law is irrelevant as applied to the activities of the Company, we would still like to take this opportunity to provide this customer with some background on our Company’s business practices and our actions in response to her complaint.  A $700 loan was requested via the internet by [redacted] and approved by the Company on May 4th, 2016 following our review and confirmation of [redacted]’s online loan application. To date, the customer has only made a partial repayment of the loan based on the terms and conditions within the consumer signed loan agreement. The Company offered to waive all remaining fees associated with the loan and consider her account paid in full however, [redacted] had no interest in reaching a resolution, and instead, began filing complaints with various government agencies and the Revdex.com.  Due to our strong commitment to resolve each consumer complaint, the Company has agreed to refund [redacted] any money paid over the principal of $700, after which we will consider the matter closed.  Although the Company has every right to pursue repayment of the loan taken by [redacted], it is frankly more effort than it is worth and we will simply not lend to [redacted] again. We assure you that North Star Finance is fully regulated by, and is in compliance with, the sovereign laws of the Fort Belknap Indian Community and all applicable federal laws.Furthermore, we can attest that our Tribal lending business does not engage in excessive or abusive collection practices and offers a dedicated customer service team to resolve all customer complaints, as exemplified by our response to [redacted].                  By signing the Loan Agreement, the customer agreed to be bound solely by the laws of the Fort Belknap Tribe. In addition, in regards to the loan, the customer agreed to comply with all of the terms and conditions of the Loan Agreement upon execution. North Cash relied upon the customer’s representations in good faith and approved her loan based upon such representations. Per the customer’s request, the fees have been waived on the customer’s account. However, the terms of her contract will stand.Let me know if you have any questions or concerns. Please ensure that our response is posted in regards to this compliant.
