Coast Capital Partners, LLCby *** *** She moved into *** *** *** ** ***On10/12/2015, they gave us notice that they were moving, and moved out 10/20/She isasking to have the last month’s rent pro-ratedI have attached a copy of her lease which stateson the front page, She did not give notice till the 12th of OctoberNotice should have been given no later than Sept30thThe lease also states,This part of the lease was initialed by the tenant and her roommate thatthey were in complete understanding of these terms.In regards to the other complaints in her Statement, she disputes the charge for a blind, saying itwas broke when they moved inI have attached a work order that shows that we replaced abroken blind in DecThat is the only broken blind that was ever reported to us.*** called and reported ants on 01/05/Maintenance took care of it immediatelyNofurther reports were madeI’ve attached the work order that shows when the job was completed.Our Pet policy is on page of the leaseIt doesn’t mention dogs or cats, it only states that nopets are permitted without prior written consent, and a signed Pet AgreementIn 2014, ***went to the Humane Society without checking with us first, at which point we could have toldher that dogs are not permitted.Regarding the mold, this was never reported until 10/12/2015, the day she gave notice to moveoutWe went in and didn’t find anything, and took pictures for our own records.“The tenantMUST tell the landlord at least days before the currentlease ends, whether or not he/she wishes to renew.”“Last month’s rent shall NOT be prorated daily or weekly if Tenant moves out during anyportion of any month.”Grills were never allowed on balconies or patios, as stated in the lease on page 3, underOrdinances and StatutesThe law does not permit any open flame within 10’ of the building, sowe provide a picnic area where we’ve installed grills and picnic tables for the residents to use.She states in the last sentence in her complaint, her resolution would be to pro-rate Novemberrent, which I told her we cannot do, as her lease is a legal and binding contractIn August 2014,they renewed their lease for another yearThere was also a reminder on that renewal saying,This was signed by both *** and her roommateAttached is a copy of that renewal.I hope this puts an end to the disputeWe do not want a negative report with the Better BusinessBureau, so please feel free to contact me if you have any questions, or if you need moredocumentation.Respectfully,Kelley B***Property ManagerNorth Coast Capital Partners*** * *** *** ***

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Mike and I are very frustrated with Kelley's response. I did actually give Laura the notice on 10/7/15, nothing that was spoken over the phone seems to be documented. I emailed Laura on 10/12 to confirm our leaving.It is true that [redacted] replaced a blind in 2014. There are three blinds in the living room. The one that was replaced was by our couch not the blinds by the door. We are talking about two different sets of blinds. We did not break any of them.In regards to the ants, I did contact them in 2014 and 2015. We should not be punished for solving the problem ourselves! How long would Kelley have let 50+ ants run around her bathroom before she took to the internet for a solution? Maintenance was putting the same traps beside of the traps that I bought on my own. I solved the problem myself.We were not going to pick up a dog the day that I talked to Laura on the pet policy. I had simply made an appointment to go look at a dog. Our neighbors all had pets. The lady above us has a dog. There is even a lady with a Rottweiler, which clearly does not meet the weight restrictions we were told. The same is true about the grill, Laura sold us on the bottom floor with a patio because we could have a grill. Again, this is our word versus theirs. Laura told us in person so this would not have been documented. Everyone has a grill. When the bulletin was posted about not being allowed, they told us we could use the 'picnic area'. What picnic area? We walked around the entire complex but could not find anything. Maybe, they were wanting us to drive across town to [redacted]?I tried several times to attach pictures of the mold. Kelley has already seen the pictures and they try to talk around it. They have mold. They have a serious mold problem. One of the pictures shows a drawer that has Mike's dress slacks. They are not worn frequently and when I opened the drawer I found a lot of mold on them. We threw them all away. I was not messing around with the mold. Laura and Kelley keep trying to sweep it under the rug. Just because I do not have a picture of it on the wall does not mean that it was not in the apartment. I realize now that I should have taken a lot more pictures. Shirts that I had worn two or three months ago had mold all over them, this makes me think that it really started to grow over the summer. We threw away a lot of clothes.Exceptions can be made to the rent prorating rule. They prorated to get us in because it gave them more money. We were good tenants. We were never late on one rent payment. We were obviously not problem tenants. We fixed things on our own. I am meeting them half way but they are not budging. I am offering to pay for the cleaning and part of the rent to give them a full month notice. It is not like we are trying to be unreasonable.The truly sad thing about this situation is that everyone told us not to move in to [redacted] before we signed the lease. I wish we had listened to the reputation they have in town. Now they are trying to take the $549 deposit and charge me $430 more. They will be losing out in the long run due to word of mouth.
