I Purchased a vehicle on December 4, 2019 from North Corpus Christi Honda. On December 3, 2019, I received a text from car salesman *** who wanted to know if I was still interested in trading mt truck and in getting a new car. I stated to her that I was not able to because I had recently taken out a loan and used my title as collateral in which she responded that they took in vehicles with liens. I went ahead and headed to the dealership and spent a good 10 hours just to get all the paperwork going. What I do remember is that when *** handed me paperwork I signed incomplete paperwork because I was told that they would fill it in as they ran my credit. After two days of waiting for my car to get a new windshield which by the way was a lie because they never put a new one, I got my car and returned their loaner. On December 19, 2019, The GM reached out to me claiming that I did not disclose the lien information to them and decided that they wanted the car back. I told him that all that was a lie and that I had already been financed and could not return the car because that would mean I would voluntary surrender my vehicle and it would stay on my credit. I let the General Manager know that I had text messages between the car salesman and myself where I let them know about the lien and text messages that state that the General Manager knew about the lien but failed to do proper paperwork. This dealership has not only been harassing me, they forged a document claiming that I lied about it and they also sent a wrecker to try and pick up the car all while I was financed through Credit Acceptance and had already given my first payment. On February 14, 2020, I received a letter from Credit Acceptance that they closed my account and sent my payments to the dealership. The dealership had my truck from December 4, 2019 till now and refused to pay the lien. Also I had to go and pay for my plates and registration stickers because the dealership refused to release them to me.

We have resolved this matter with ***. We have purchased back the loan from Credit Acceptance. ***'s GMC Sierra was returned to her.

The facts of the matter are below.

Basically, *** did not disclose the existence of a title loan at the time she purchased the 2013 Accord from us on 12/04/2019. *** had traded in a 2006 GMC Sierra.On December 17, 2019 we found out the GMC Sierra was encumbered with a title loan. After many conversations, *** finally acknowledged the existence of the title loan. *** further elaborated that her brother had stolen (her word) the title to secure the loan.In the past two months we've had numerous difficult conversations with *** in an attempt to resolve this matter. *** was evasive at times and downright abusive at others.On January 9, 2020 I sent a certified letter to *** explaining our position (see attached).Subsequently on 02/10/2020 we advised the financing company (Credit Acceptance) of our intention to cancel the loan and have it reassigned back to us. The reassignment was done on the same day.We notified *** of the cancellation of the loan and advised her the payment she made to Credit Acceptance would be refunded to her. We asked her to bring back the 2013 Accord and her GMS Sierra will be returned to her. *** showed up on Tuesday, 02/1//20 without the Accord and caused a scene in our showroom. A young woman who was with *** intervened to calm *** down and said they will return with the Accord. On February 20, 2020, *** was at the dealership with her mom. Her mom was very apologetic for ***'s behavior. They left with a promise to bring the Accord back tomorrow and take possession of the GMC Sierra. Later that evening, we exchanged the vehicles at ***'s residence.I am available if you need more information.

I am rejecting this response because:What the dealership is Claiming is not correct. Before I even took the time to go to the dealership and go through the whole process, I told the salesman(woman) *** about the lien and she said that the dealership did take vehicles with liens. I have it in text message along with all my conversations between ***, myself and what the sales manager had stated. I did not once state that my brother had stole my car title because when they asked me for the title on December 4, 2019, I stated to them that Titlemax had it. The night I signed the finance agreement, I did it over the computer at the dealership with *** and never received a copy of that. The only copies I received were mileage disclosures for both my trade in Gmc truck and the car I was financing the 2013 accord, the paper to insure the car, and the delivery report which had 2 papers. Those 4 documents were given to me 3 days later when they finally gave me my car. The reason that they held the car was because I was told they were putting a new windshield which did not happen and I also have that on text message. Now *** did reach out to me on the 20th of December and stated that I had failed to notify them about the lien. I asked to have *** present and I asked her if I had told her about the lien in which *** would not allow her to answer and told me I was not allowed to dictate the call. I then told them that I was going to see what my legal rights were and I would get back to them. I did reach out to my finance company Credit Acceptance and let them know the situation and they stated that I was responsible for the car because it was financed under my name and nothing was showing on their end in regards to a discrepancy. I also spoke to a lawyer with ***. I never once reached out to the dealership afterwards or anyone after December 20th. On January 24th, 2020 I responded to their email that was sent out January 15, 2020. Dealership also sent a wrecker to my house on January 29, 2020 and attempted to take my car while I was still financed through Credit acceptance. I did go to the dealership with my sister on February 17, 2020 because I wanted to know why they canceled my contract with the finance company. *** was very rude to me and my sister and stated that he was able to cancel anyone's contract for up to 6 months. I never caused a scene the way they state. On February 20, 2020 *** called me from his personal phone and stated that DMV had reached out to him and told him that they agreed with him and that I needed to return the vehicle to avoid any further problems. My mother accompanied me to the dealership to see what exactly what was going on. My mother made it clear to *** that she had read the messages and it was clear that they knew about the lien and failed to do the paperwork. My mother told me to return the car because *** and the dealership were not honest people and she didn't want me to get into problems. I agreed to return the car the next day but *** called me later in the day and told me that he was sending his salesman with my truck to switch vehicles. The same night that I got my truck, Titlemax sent a wrecker to pick up the GMC truck because no payment was made since December 2019. The next morning, DMV investigator, ***, stated in an email that he never once spoke to *** or told *** that he agreed with him. In the email *** stated that all he did was send an email to the dealership requesting paperwork. The fact that *** lied to me and used a scare tactic to get me to turn in my car is very unprofessional. If what they stated was true why wait 76 days to cancel a contract? I believe in honesty and I also believe that if you made a mistake as a business than you should handle it better. Titlemax reached out many times to the dealership to turn in the truck due to non payment and they would refuse. Titlemax even sent a wrecker which they(dealership) told the wrecker that if they picked up my car and brought it to them, then they would give up the truck. The dealership knew that I was going to not only be without a car but also without a truck. They stated that I allowed this issue to go this long but all in all they had the ability to cancel early on in the contract yet they waited after I made two car payments to cancel my contract with Credit Acceptance.
