North East Ohio Stump Grinding

This Complaint is rather surprising given the history Home Team has with Ms***. Ms*** signed a Seller-Financed Land Contract (“Contract”) on April 27, for the purchase of property located at *** *** ***, Detroit, MI 48227. Home Team is the servicer
for the Seller. The property was sold “as-is” and she was advised to obtain a city inspection, both in her purchase agreement and in the actual Contract. Ms*** chose not to. On or around July 25, 2017, Ms*** contacted our office and expressed interest in rescinding the Contract. She stated that the property was “too much” for her to maintain and she wanted to just “walk away” without any liability or recourse to Seller in exchange for Seller keeping all monies paid by her to dateAt Ms***’s request, Home Team was able to obtain approval by Seller, and drafted a Settlement Agreement, Estoppel Affidavit and Deed in Lieu of Forfeiture. These documents were executed and notarized on July 28, 2017, but only after it was fully explained to Ms*** that it may not be in her best interest to sign the documents, that she should seek independent counsel, and that in the event that she changed her mind, she would have fifteen (15) days to revoke the rescission of the Contract. Approximately one week later, she came to our office with her mother and expressed interest in retaining the property. She further indicated that the reason she initially wanted to walk away from the property was because she was having issues with DTE Energy. When she took legal ownership of the property, there were no current our outstanding issues with DTE, but as courtesy to Ms***, Home Team made several calls to DTE to find out what the problem was in hopes of helping her resolve it. After speaking with the representative at DTE, it was determined that her account was being investigated for fraudHome Team was unable to get additional information regarding the type of fraud placed on the account, but nevertheless, was advised it would be resolved within 7-business days and Home Team informed her of same. On August 11, 2017, Ms*** contacted our office stating that she did not have electricity because the fraud on her account with DTE had not yet been resolved. As yet another courtesy to Ms***, Home Team paid for her to stay in a hotel over the weekend so that she would not have to be without electricity, costing Home Team $517.35. On August 14, 2017, Ms*** contacted Home Team and told us she had found an apartment, would be moving out of the property, and would like all monies paid by her to be returned to her. Home Team indicated to her that the rescission date of her signed Settlement Agreement of July had passed, but that we would make the request to Seller anyway for a potential refund. She was informed that there was no legal obligation for Seller to refund any portion of her payments to date. Seller was not agreeable to refunding Ms*** any of the money paid per the Contract. Ms*** is a US Veteran and moved to Michigan by herself. Home Team is appreciative of her services and sympathetic to her situation in being in a State without family/friends. Home Team, at all times, did everything it could to ensure Ms*** was in the best position possible. In an effort to further assist her, Home Team advised that it would return the portion of money paid directly to Home Team for closing costs, so that she would have extra money moving forward. Ms*** was agreeable and thankful for this, and came to our office, received a check and left on good terms. Home Team also advised that she could remain in the property for additional time, free of charge, until she found housing. On September 11, 2017, the property was confirmed vacant and Ms*** had relocated
