North Hills Tire & Wheel

My husband needed a set of tires and wheels for a truck he had purchased, and let the owner *** know it was an emergency due to the ones on the truck being unsafe and were causing damage to the vehicle. *** told him that he didn't have any in stock but would have them by Tuesday. My husband said great and paid for the tires and wheels (in cash). Tuesday comes around, my husband calls *** to set up a time to come by to get the set. *** says they haven't shown up yet but will definitely be there Wednesday. Nothing. My husband calls *** again, the tires and wheels still aren't there, now it'll be Friday. This is when my husband reminds *** that this purchase was an emergency, and if they don't have what he'd purchased then he needed a refund so he could get safe tires and wheels for the truck. The response was that *** had been having a lot of problems getting product from the company he purchased them from (never mentioned that before, being an emergency, it might have been good to know that) and there's no refunds on special order items. This was an items that was never presented as a special order, he just didn't have them in stock at the time; theses weren't extravagant by any means and he didn't seem to have much of anything in stock at the time. My husband reminded *** again, that this was an emergency and they were promised by Tuesday, now it's Wednesday, and he's saying Friday. ***'s response, "there's no way in hell you're getting your money back" then he hung up on my husband. My husband called *** back and stated that this wasn't going to work, he either needed the refund or he'd come up there with the police. *** then started back peddling, and offered another set he had on hand, he sent my husband a picture of the wheels and he apparently already had the tires. To be done with the entire situation, my husband agreed but since *** wasn't willing to wait for my husband to get up there to get them, we had to ask a friend to pick them up for us. Well guess what, they weren't the same as the picture he sent, and they are quite horrible looking. When my husband shared this with me I couldn't believe it. So I called *** myself the next day to try and work this out, when he wouldn't quit talking over me, I tried to explain that there are purchaser rights and we had the right to receive a refund since he'd broken the purchase agreement. His excuse was only that he'd been in business for 38 years, don't call me again. Then as he'd done to my husband, he hung up on me. We are out over $1100.00, and don't have what we ordered. *** seems to think that you should be happy with what he gives you since he's been in business for 38 years, instead of receiving what you ordered. The sales ticket states "No refund without sales ticket", I have it, there is no mention of no refunds on "special orders" nor did my husband see any stating that, nor did *** mention it till we asked for a refund.
