I am responding to this complaint and will reply by item:1.? The first problem addressed placing a lien without giving the insurance a chance to pay.? It is our policy when we find out about a motor vehicle accident to place the lien against the personal injury settlement right away.? According to Minnesota State Law the lien must be filed within days after release from the hospital.? This lien is placed against the personal injury settlement and is not a lien against any property.? 2.? Once the personal injury settlement has occurred, the lien is then removed.? The reason the staff member could not see the lien was because the flag that is on the account indicating the lien was systematically removed when the account was satisfied.? This was not supposed to happen this way.? The flag stays on typically and we monitor daily for zero balances, and when the account is at zero we remove the lien from the personal injury settlement.? 3.? Upon receiving the call on January 5th when the employee noted the account, the account changed from closed to billed and it entered our work queue to release the lien.? Because it entered the work queue, we released the lien on 1/11/17.? Again, this lien is only against the personal injury settlement and not against at property or home.? I will follow this up with a letter to the patient and copy the Revdex.com for your records.? If you have any questions, please feel free to contact me at ###-###-####.? Judy ***Manager

I am responding to this complaint and will reply by item:1.  The first problem addressed placing a lien without giving the insurance a chance to pay.  It is our policy when we find out about a motor vehicle accident to place the lien against the personal injury settlement right away. ...

According to Minnesota State Law the lien must be filed within 180 days after release from the hospital.  This lien is placed against the personal injury settlement and is not a lien against any property. 2.  Once the personal injury settlement has occurred, the lien is then removed.  The reason the staff member could not see the lien was because the flag that is on the account indicating the lien was systematically removed when the account was satisfied.  This was not supposed to happen this way.  The flag stays on typically and we monitor daily for zero balances, and when the account is at zero we remove the lien from the personal injury settlement. 3.  Upon receiving the call on January 5th when the employee noted the account, the account changed from closed to billed and it entered our work queue to release the lien.  Because it entered the work queue, we released the lien on 1/11/17. Again, this lien is only against the personal injury settlement and not against at property or home. I will follow this up with a letter to the patient and copy the Revdex.com for your records.  If you have any questions, please feel free to contact me at ###-###-####. Judy [redacted]Manager
